Senate File 559 S-3207 Amend Senate File 559 as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < DIVISION I 4 FY 2023-2024 APPROPRIATIONS 5 Section 1. GOALS AND ACCOUNTABILITY —— ECONOMIC 6 DEVELOPMENT. 7 1. For the fiscal year beginning July 1, 2023, the goals 8 for the economic development authority shall be to expand and 9 stimulate the state economy, increase the wealth of Iowans, and 10 increase the population of the state. 11 2. To achieve the goals in subsection 1, the economic 12 development authority shall do all of the following for the 13 fiscal year beginning July 1, 2023: 14 a. Concentrate its efforts on programs and activities that 15 result in commercially viable products and services. 16 b. Adopt practices and services consistent with free 17 market, private sector philosophies. 18 c. Ensure economic growth and development throughout the 19 state. 20 d. Work with businesses and communities to continually 21 improve the economic development climate along with the 22 economic well-being and quality of life for Iowans. 23 e. Coordinate with other state agencies to ensure that they 24 are attentive to the needs of an entrepreneurial culture. 25 f. Establish a strong and aggressive marketing image to 26 showcase Iowa’s workforce, existing industry, and potential. 27 A priority shall be placed on recruiting new businesses, 28 business expansion, and retaining existing Iowa businesses. 29 Emphasis shall be placed on entrepreneurial development through 30 helping entrepreneurs secure capital, and developing networks 31 and a business climate conducive to entrepreneurs and small 32 businesses. 33 g. h. Prepare communities for future growth and development 1 through development, expansion, and modernization of 2 infrastructure. 3 i. Develop public-private partnerships with Iowa businesses 4 in the tourism industry, Iowa tour groups, Iowa tourism 5 organizations, and political subdivisions in this state to 6 assist in the development of advertising efforts. 7 j. Develop, to the fullest extent possible, cooperative 8 efforts for advertising with contributions from other sources. 9 Sec. 2. ECONOMIC DEVELOPMENT AUTHORITY. 10 1. APPROPRIATION 11 a. There is appropriated from the general fund of the state 12 to the economic development authority for the fiscal year 13 beginning July 1, 2023, and ending June 30, 2024, the following 14 amount, or so much thereof as is necessary, to be used for the 15 purposes designated in this subsection, and for not more than 16 the following full-time equivalent positions: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,807,359 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . (1) For salaries, support, miscellaneous purposes, 20 programs, marketing, and the maintenance of an administration 21 division, a business development division, a community 22 development division, a small business development division, 23 and other divisions the authority may organize. 24 (2) For business development operations and programs, 25 international trade, export assistance, workforce recruitment, 26 and the partner state program. 27 (3) For transfer to a fund created pursuant to section 28 15.313 for purposes of financing strategic infrastructure 29 projects. 30 (4) For community economic development programs, tourism 31 operations, community assistance, plans for Iowa green corps 32 and summer youth programs, the main street and rural main 33 street programs, the school-to-career program, the community 34 development block grant, and housing and shelter-related 35 -2- SF 559.2117 (1) 90 ko/ns 2/ 26
programs. 1 (5) For achieving the goals and accountability, and 2 fulfilling the requirements and duties required under this Act. 3 (6) The full-time equivalent positions authorized under 4 this section are funded, in whole or in part, by the moneys 5 appropriated under this subsection or by other moneys received 6 by the authority, including certain federal moneys. 7 c. Notwithstanding section 8.33 , moneys appropriated in 8 this subsection that remain unencumbered or unobligated at the 9 close of the fiscal year shall not revert but shall remain 10 available for expenditure for the purposes designated in this 11 subsection until the close of the succeeding fiscal year. 12 2. FINANCIAL ASSISTANCE RESTRICTIONS 13 a. A business creating jobs through moneys appropriated in 14 subsection 1 shall be subject to contract provisions requiring 15 new and retained jobs to be filled by individuals who are 16 citizens of the United States who reside within the United 17 States, or any person authorized to work in the United States 18 pursuant to federal law, including legal resident aliens 19 residing in the United States. 20 b. Any vendor who receives moneys appropriated in 21 subsection 1 shall adhere to such contract provisions and 22 provide periodic assurances as the state shall require that the 23 jobs are filled solely by citizens of the United States who 24 reside within the United States, or any person authorized to 25 work in the United States, pursuant to federal law, including 26 legal resident aliens residing in the United States. 27 c. A business that receives financial assistance from 28 the authority from moneys appropriated in subsection 1 shall 29 only employ individuals legally authorized to work in this 30 state. In addition to all other applicable penalties provided 31 by current law, all or a portion of the assistance received 32 by a business which is found to knowingly employ individuals 33 not legally authorized to work in this state is subject to 34 recapture by the authority. 35 -3- SF 559.2117 (1) 90 ko/ns 3/ 26
3. USES OF APPROPRIATIONS 1 a. From the moneys appropriated in subsection 1, the 2 authority may provide financial assistance in the form of a 3 grant to a community economic development entity for conducting 4 a local workforce recruitment effort designed to recruit former 5 citizens of the state and former students at colleges and 6 universities in the state to meet the needs of local employers. 7 b. From the moneys appropriated in subsection 1, the 8 authority may provide financial assistance to early stage 9 industry companies being established by women entrepreneurs. 10 c. From the moneys appropriated in subsection 1, the 11 authority may provide financial assistance in the form of 12 grants, loans, or forgivable loans for advanced research and 13 commercialization projects involving value-added agriculture, 14 advanced technology, or biotechnology. 15 d. The authority shall not use any moneys appropriated in 16 subsection 1 for purposes of providing financial assistance for 17 the Iowa green streets pilot project or for any other program 18 or project that involves the installation of geothermal systems 19 for melting snow and ice from streets or sidewalks. 20 4. WORLD FOOD PRIZE 21 In lieu of the standing appropriation in section 15.368 , 22 there is appropriated from the general fund of the state to the 23 economic development authority for the fiscal year beginning 24 July 1, 2023, and ending June 30, 2024, the following amount 25 for the world food prize: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 27 5. The economic development authority shall submit an 31 annual report on or before January 15 to the general assembly 32 regarding the tourism office’s activities funded with moneys 33 appropriated under this subsection. and criteria that allow the general assembly to quantify 1 and evaluate the effectiveness and economic impact of the 2 tourism office’s activities related to advertising, promoting, 3 placement, and implementation of the economic development 4 authority’s strategic plan for tourism and travel. 5 8. EMPOWER RURAL IOWA 6 a. There is appropriated from the Iowa skilled worker and 7 job creation fund created in section 8.75 to the economic 8 development authority for the fiscal year beginning July 1, 9 2023, and ending June 30, 2024, the following amount, or so 10 much thereof as is necessary, to be used for the purposes 11 designated: 12 Empower rural Iowa program: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 700,000 14 b. The authority shall adopt rules pursuant to chapter 20 17A to establish criteria for the distribution of the moneys 21 appropriated in this subsection. 22 9. CULTURAL AFFAIRS ACTIVITIES 23 a. The economic development authority 31 shall submit an annual report to the general assembly no later 32 than November 1, 2023, that details the amount of every direct 33 loan, forgivable loan, tax credit, tax exemption, tax refund, 34 grant, or any other financial assistance awarded to a person 35 -7- SF 559.2117 (1) 90 ko/ns 7/ 26
during the prior fiscal year by the authority under an economic 1 development program administered by the authority. The report 2 shall identify the county where the project associated with 3 each such award is located. 4 Sec. 5. INSURANCE ECONOMIC DEVELOPMENT. From the 5 moneys collected by the insurance division in excess of the 6 anticipated gross revenues under section 505.7, subsection 7 3 , during the fiscal year beginning July 1, 2023, $100,000 8 shall be transferred to the economic development authority for 9 insurance economic development and international insurance 10 economic development. 11 Sec. 6. IOWA FINANCE AUTHORITY. 12 1. There is appropriated from the general fund of the state 13 to the Iowa finance authority for the fiscal year beginning 14 July 1, 2023, and ending June 30, 2024, the following amounts, 15 or so much thereof as is necessary, to be used for the purposes 16 designated: 17 a. VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES. The 11 department of workforce development shall require a unique 12 identification login for all users of workforce development 13 centers operated through electronic means. 14 Sec. 14. UNEMPLOYMENT COMPENSATION PROGRAM. 15 1. Notwithstanding section 96.9, subsection 4 , paragraph 16 “a”, moneys credited to the state by the secretary of the 17 treasury of the United States pursuant to section 903 of the 18 federal Social Security Act are appropriated to the department 19 of workforce development and shall be used by the department 20 for the administration of the unemployment compensation program 21 only. This appropriation shall not apply to any fiscal year 22 beginning after December 31, 2023. 23 2. Notwithstanding subsection 1, up to $800,000, or 24 so much thereof as may be necessary, of the unemployment 25 compensation modernization incentive payments made to the 26 state’s unemployment trust fund account as a special transfer 27 under section 903 of the federal Social Security Act, pursuant 28 to the federal Assistance for Unemployed Workers and Struggling 29 Families Act, of the American Recovery and Reinvestment Act of 30 2009, Pub. L. No. 111-5, are appropriated to the department of 31 workforce development for the fiscal year beginning July 1, 32 2023, and ending June 30, 2024, for the purpose of modification 33 of space for unemployment insurance administrative law judge 34 offices and conference rooms in which to hold unemployment 35 -13- SF 559.2117 (1) 90 ko/ns 13/ 26
insurance appeal hearings. 1 Sec. 15. IOWA SKILLED WORKER AND JOB CREATION FUND. 2 1. There is appropriated from the Iowa skilled worker and 3 job creation fund created in section 8.75 to the following 4 departments, agencies, and institutions for the fiscal year 5 beginning July 1, 2023, and ending June 30, 2024, the following 6 amounts, or so much thereof as is necessary, to be used for the 7 purposes designated: 8 a. ECONOMIC DEVELOPMENT AUTHORITY 9 (1) For the purposes of providing assistance as described in 10 section 15.335B for the high quality jobs program: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,700,000 12 From the moneys appropriated in this subparagraph, the 13 economic development authority may use not more than $1,000,000 14 for purposes of providing infrastructure grants to main street 15 communities under the main street Iowa program and may allocate 16 not more than $300,000 for the purposes of supporting statewide 17 worker education and quality preapprenticeship programs. 18 (2) As a condition of receiving moneys appropriated in 19 this lettered paragraph “a”, an entity shall testify upon the 20 request of the joint appropriations subcommittee on economic 21 development regarding the expenditure of such moneys. 22 b. STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS 23 (1) STATE BOARD OF REGENTS. shall be allocated for the university of northern Iowa. 1 (b) The institutions shall provide a one-to-one match 2 of additional moneys for the activities funded with moneys 3 appropriated under this subparagraph (1). 4 (c) The state board of regents shall submit a report by 5 January 15, 2024, to the governor and the general assembly 6 regarding the activities, projects, and programs funded with 7 moneys appropriated under this subparagraph (1). The report 8 shall be provided in an electronic format and shall include a 9 list of metrics and criteria mutually agreed to in advance by 10 the board of regents and the economic development authority. 11 The metrics and criteria shall allow the governor’s office and 12 the general assembly to quantify and evaluate the progress 13 of the board of regents institutions with regard to their 14 activities, projects, and programs in the areas of technology 15 commercialization, entrepreneurship, regional development, and 16 market research. 17 (2) IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. companies. 1 (c) It is the intent of the general assembly that the 2 industrial incentive program focus on Iowa industrial sectors 3 and seek contributions and in-kind donations from businesses, 4 industrial foundations, and trade associations, and that moneys 5 for the center for industrial research and service industrial 6 incentive program shall be allocated only for projects which 7 are matched by private sector moneys for directed contract 8 research or for nondirected research. The match required of 9 small businesses as defined in section 15.102 for directed 10 contract research or for nondirected research shall be $1 11 for each $3 of state funds. The match required for other 12 businesses for directed contract research or for nondirected 13 research shall be $1 for each $1 of state funds. The department of workforce 22 development shall establish an application process and criteria 23 to award grants pursuant to this subparagraph division to 24 community colleges. The criteria shall be based on need for 25 instruction in English as a second language in the region 26 served by each community college as determined by factors 27 including data from the latest federal decennial census and 28 outreach efforts to determine regional needs. 29 (d) From the moneys appropriated in this numbered 30 subparagraph, $210,000 shall be transferred to the department 31 of health and human services for purposes of administering a 32 program to provide access to international resources to Iowans 33 and new Iowans to provide economic and leadership development 34 resulting in Iowa being a more inclusive and welcoming place 35 -18- SF 559.2117 (1) 90 ko/ns 18/ 26
to live, work, and raise a family. The program shall provide 1 supplemental support services for international refugees to 2 improve learning, English literacy, life skills, cultural 3 competencies, and integration in a county with a population 4 over 350,000 as determined by the 2020 federal decennial 5 census. HOUSING RENEWAL PILOT PROGRAM. 28 1. For purposes of this section , “nonprofit Iowa 29 affiliate” : 30 a. “Eligible participant” includes cities, counties, 31 consortiums of local governments, and organizations exempt from 32 taxation pursuant to section 501(c)(3) of the Internal Revenue 33 Code. 34 b. “Nonprofit Iowa affiliate” means a nonprofit Iowa 35 -21- SF 559.2117 (1) 90 ko/ns 21/ 26
affiliate of a nonprofit international organization whose 1 primary activity is the promotion of the construction, 2 remodeling, or rehabilitation of one-family or two-family 3 dwellings for use by low-income families. 4 2. a. A housing renewal program fund is created in the 5 state treasury under the control of the Iowa finance authority. 6 The fund shall consist of moneys appropriated to or deposited 7 in the fund. Moneys in the fund are appropriated to the Iowa 8 finance authority to establish and administer a housing renewal 9 pilot program. 10 b. For the fiscal year beginning July 1, 2022, and ending 11 June 30, 2023, there is appropriated from the general fund of 12 the state to the Iowa finance authority five hundred thousand 13 dollars for deposit in the housing renewal program fund. 14 c. Notwithstanding section 8.33, moneys appropriated in 15 this section that remain unencumbered or unobligated at the 16 close of the fiscal year shall not revert but shall remain 17 available for expenditure for the purposes designated until the 18 close of the succeeding fiscal year. 19 c. d. Notwithstanding section 12C.7, subsection 2 , 20 interest or earnings on moneys in the housing renewal program 21 fund shall be credited to the fund. Payment of interest, 22 income generated from the sale of an ownership unit pursuant to 23 subsection 6, recaptures of grant financial assistance awards, 24 and other repayments under the housing renewal pilot program 25 shall be deposited in the fund. 26 3. a. The Iowa finance authority shall provide moneys 27 from the housing renewal program fund to a nonprofit Iowa 28 affiliate that shall use the moneys to award grants financial 29 assistance under the housing renewal pilot program to eligible 30 participants. 31 b. Eligible participants under paragraph “a” shall use 32 a grant financial assistance awarded under the housing 33 renewal pilot program only for purposes of the acquisition, 34 rehabilitation, and resale of ownership units; the acquisition 35 -22- SF 559.2117 (1) 90 ko/ns 22/ 26
and demolition of blighted structures; and the redevelopment 1 of ownership units. 2 4. Twenty-five percent of moneys appropriated to the 3 housing renewal program fund shall be allocated to rural 4 communities financial assistance awards for eligible 5 participants located in the eighty-eight least populated 6 counties in the state. 7 5. a. The nonprofit Iowa affiliate may partner with a city, 8 a county, a consortium of local governments, or an organization 9 exempt from taxation pursuant to section 501(c)(3) of the 10 Internal Revenue Code ; however, the nonprofit Iowa affiliate 11 shall determine the geographic location of all projects for 12 which a grant is awarded shall determine the criteria used 13 to evaluate eligible participants and to award financial 14 assistance to eligible participants selected by the nonprofit 15 Iowa affiliate . 16 b. The nonprofit Iowa affiliate shall not award a grantee an 17 eligible participant more than one hundred thousand dollars per 18 ownership unit. A grantee may use up to five percent of a grant 19 for administration expenses related to the grantee’s project. 20 The nonprofit Iowa affiliate may use up to five percent of the 21 financial assistance awarded to an eligible participant for 22 administrative expenses related to the housing renewal pilot 23 program. 24 c. (1) A grantee An eligible participant shall have a 25 maximum of thirty-six months from the date a contract is 26 executed between the nonprofit Iowa affiliate and the grantee 27 eligible participant for the grantee’s eligible participant to 28 complete the eligible participant’s project. The grantee’s 29 eligible participant’s project shall be considered complete 30 when all grant funds financial assistance awarded to the 31 grantee have eligible participant has been expended, and all 32 ownership units that are covered by the contract are finished 33 and available for sale. 34 (2) If a grantee Unless the nonprofit Iowa affiliate 35 -23- SF 559.2117 (1) 90 ko/ns 23/ 26
authorizes additional time for good cause shown, if an eligible 1 participant has no project activity within thirty-six twelve 2 months from the date a contract is executed between the 3 nonprofit Iowa affiliate and the grantee eligible participant , 4 the grant financial assistance award shall be returned to the 5 Iowa finance authority for deposit in the housing renewal 6 program fund. 7 d. A grantee An eligible participant shall sell each 8 completed ownership unit to a homebuyer whose income is under 9 the one hundred twenty percent area median income and who must 10 occupy the ownership unit as the homebuyer’s primary residence. 11 The deed to the ownership unit must contain a restrictive 12 resale requirement that prohibits the homebuyer or a subsequent 13 owner from selling the ownership unit to a person with an 14 income above the one hundred twenty percent area median income 15 for five calendar years from the date the grantee eligible 16 participant sold the ownership unit to the first homebuyer 17 whose income is under the one hundred twenty percent area 18 median income. 19 6. A grantee may The nonprofit Iowa affiliate shall use 20 income generated from the sale of an ownership unit only for 21 the purpose of additional eligible expenses awarding financial 22 assistance to eligible participants under the housing renewal 23 pilot program. 24 7. The Iowa finance authority shall not use more than five 25 percent of moneys allocated appropriated to the housing renewal 26 program fund for administration and oversight of the housing 27 renewal pilot program. 28 8. The Iowa finance authority shall adopt rules pursuant to 29 chapter 17A to administer this division. 30 9. 8. The Iowa finance authority, in coordination with the 31 nonprofit Iowa affiliate, shall submit a report to the general 32 assembly on or before December 31, 2023 2024 , describing the 33 community, economic, and financial impact of the housing 34 renewal pilot program. 35 -24- SF 559.2117 (1) 90 ko/ns 24/ 26
9. This section is repealed July 1, 2025. 1 DIVISION IV 2 REGIONAL INDUSTRY SECTOR PARTNERSHIPS —— RULES 3 Sec. 19. Section 260H.7B, Code 2023, as amended by 2023 Iowa 4 Acts, Senate File 514, section 2195, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 3. The department of workforce development 7 shall adopt rules pursuant to chapter 17A to implement this 8 section. 9 DIVISION V 10 APPRENTICESHIP TRAINING PROGRAM —— DEFINITIONS 11 Sec. 20. Section 15B.2, subsection 9A, as enacted by 12 2023 Iowa Acts, Senate File 514, section 2251, is amended by 13 striking the subsection. 14 DIVISION VI 15 NEW JOBS TRAINING AGREEMENTS 16 Sec. 21. 2015 Iowa Acts, chapter 138, section 8, is amended 17 to read as follows: 18 SEC. 8. IOWA NEW JOBS TRAINING AGREEMENTS. An Iowa 19 community college that entered into a new jobs training 20 agreement pursuant to chapter 260E , which was effective in 21 April 2012 2021 , with an Iowa employer may enter into a new 22 agreement with such employer pursuant to chapter 260E , which 23 will be effective September 2015 2023 , and may use the base 24 employment determined in April 2012 October 2021 as the base 25 employment for determining the new jobs eligible under the 26 new agreement if the base employment determined in April 2012 27 October 2021 was 2,125 2,335 employees. The new agreement 28 under chapter 260E shall be limited to seven years from the 29 effective date of the agreement. > 30 2.
