Page 78, after line 19 by inserting: 5 < DIVISION ___ 6 STATE CHILD CARE ASSISTANCE —— CHILDREN NEEDING SPECIAL NEEDS 7 CARE, INITIAL ELIGIBILITY, AND REIMBURSEMENT 8 Sec. ___. Section 237A.1, Code 2023, is amended by adding 9 the following new subsection: 10 NEW SUBSECTION . 7A. “Children needing special needs care” 11 or “special needs child” means a child or children with one or 12 more of the following conditions: 13 a. The child has been diagnosed by a physician or by a 14 person endorsed for service as a school psychologist by the 15 department of education to have a developmental disability 16 which substantially limits one or more major life activities, 17 and the child requires professional treatment, assistance in 18 self-care, or the purchase of special adaptive equipment. 19 b. The child has been determined by a qualified intellectual 20 disability professional to have a condition which impairs the 21 child’s intellectual and social functioning. 22 c. The child has been diagnosed by a mental health 23 professional to have a behavioral or emotional disorder 24 characterized by situationally inappropriate behavior which 25 deviates substantially from behavior appropriate to the 26 child’s age, or which significantly interferes with the child’s 27 intellectual, social, or personal development. 28 Sec. ___. Section 237A.13, Code 2023, is amended by adding 29 the following new subsection: 30 NEW SUBSECTION . 1A. A family shall only be initially 31 eligible for state child care assistance if the family’s gross 32 monthly income does not exceed the lesser of: 33 a. (1) (a) For the fiscal year beginning July 1, 2023, one 34 hundred sixty percent of the federal poverty level applicable 35 -1- S 3194.2046 (3) 90 dg/rh 1/ 3 #1. #2.
to the family size for children needing basic care. 1 (b) For the fiscal year beginning July 1, 2024, one hundred 2 seventy percent of the federal poverty level applicable to the 3 family size for children needing basic care. 4 (c) For the fiscal year beginning July 1, 2025, one hundred 5 eighty percent of the federal poverty level applicable to the 6 family size for children needing basic care. 7 (d) For the fiscal year beginning July 1, 2026, one hundred 8 ninety percent of the federal poverty level applicable to the 9 family size for children needing basic care. 10 (e) For the fiscal year beginning July 1, 2027, and for 11 each fiscal year thereafter, two hundred percent of the federal 12 poverty level applicable to the family size for children 13 needing basic care. 14 (2) Two hundred percent of the federal poverty level 15 applicable to the family size for children needing special 16 needs care. 17 b. Eighty-five percent of the state median gross monthly 18 income. 19 Sec. ___. Section 237A.13, subsection 8, Code 2023, is 20 amended by adding the following new paragraph: 21 NEW PARAGRAPH . e. Families with an income of more than 22 one hundred forty-five percent of the federal poverty level 23 but not more than the maximum income necessary to be eligible 24 for state child care assistance whose members, for at least 25 twenty-eight hours per week in the aggregate, are employed 26 or are participating at a satisfactory level in an approved 27 training program or educational program. > 28 3.
