DEPARTMENT OF INSPECTIONS, APPEALS, AND LICENSING 29 —— LICENSE OR REGISTRATION FEES. 30 1. For the fiscal year beginning July 1, 2023, and ending 31 June 30, 2024, the department of inspections, appeals, and 32 licensing shall collect any license or registration fees or 33 electronic transaction fees generated during the fiscal year 34 as a result of licensing and registration activities under 35 -8- SF 557.2007 (3) 90 es/ns 8/ 29
chapters 99B , 137C , 137D , and 137F . 1 2. From the fees collected by the department under this 2 section on behalf of a municipal corporation with which 3 the department has an agreement pursuant to section 137F.3 , 4 through a statewide electronic licensing system operated by 5 the department, notwithstanding section 137F.6, subsection 2 , 6 the department shall remit the amount of those fees to the 7 municipal corporation for whom the fees were collected less 8 any electronic transaction fees collected by the department to 9 enable electronic payment. 10 3. From the fees collected by the department under this 11 section, other than those fees described in subsection 2, 12 the department shall deposit the amount of $800,000 into the 13 general fund of the state prior to June 30, 2024. 14 4. From the fees collected by the department under this 15 section, other than those fees described in subsections 2 and 16 3, the department shall retain the remainder of the fees for 17 the purposes of enforcing the provisions of chapters 99B , 137C , 18 137D , and 137F . Notwithstanding section 8.33 , moneys retained 19 by the department pursuant to this subsection that remain 20 unencumbered or unobligated at the close of the fiscal year 21 shall not revert but shall remain available for expenditure 22 for the purposes of enforcing the provisions of chapters 99B , 23 137C , 137D , and 137F during the succeeding fiscal year. The 24 department shall provide an annual report to the department 25 of management and the legislative services agency on fees 26 billed and collected and expenditures from the moneys retained 27 by the department in a format determined by the department 28 of management in consultation with the legislative services 29 agency. 30 Sec. 9. The insurance division expenditures for examination 3 purposes may exceed the projected receipts, refunds, and 4 reimbursements, estimated pursuant to section 505.7, subsection 5 7, including the expenditures for retention of additional 6 personnel, if the expenditures are fully reimbursable and the 7 division first does all of the following: 8 (1) Notifies the department of management, the legislative 9 services agency, and the legislative fiscal committee of the 10 need for the expenditures. 11 (2) Files with each of the entities named in subparagraph 12 (1) the legislative and regulatory justification for the 13 expenditures, along with an estimate of the expenditures. 14 Sec. 13. Section 10A.104, subsection 15, as enacted by 10 2023 Iowa Acts, Senate File 514, section 1430, is amended by 11 striking the subsection and inserting in lieu thereof the 12 following: 13 15. Perform fire control duties pursuant to section 14 10A.511. 15 Sec. 31. NEW SECTION . 10A.507 Licensing and regulation 16 fund. 17 1. A licensing and regulation fund is created in the state 18 treasury under the control of the department of inspections, 19 appeals, and licensing. Moneys in the fund are appropriated 20 to the department to be used to fulfill the administration and 21 enforcement responsibilities of the department and boards under 22 the purview of the department under this subchapter. 23 2. The fund shall consist of moneys and fees collected by 24 the department for deposit in the fund. 25 3. Notwithstanding section 8.33, moneys in the fund 26 that remain unencumbered or unobligated at the close of the 27 fiscal year shall not revert but shall remain available for 28 expenditure for the purposes designated in succeeding fiscal 29 years. Notwithstanding section 12C.7, subsection 2, interest 30 or earnings on moneys deposited in the fund shall be credited 31 to the fund. 32 Sec. 32. Section 88A.5, Code 2023, as amended by 2023 Iowa 33 Acts, Senate File 514, section 1766, is amended to read as 34 follows: 35 -19- SF 557.2007 (3) 90 es/ns 19/ 29
88A.5 Fees to general licensing and regulation fund. 1 All fees collected by the department under the provisions 2 of this chapter shall be transmitted to the treasurer of state 3 and credited by the treasurer to the general fund of the state 4 licensing and regulation fund created in section 10A.507 . 5 Sec. 33. Section 89.9, Code 2023, as amended by 2023 Iowa 6 Acts, Senate File 514, section 1797, is amended to read as 7 follows: 8 89.9 Disposal of fees. 9 All fees provided for in this chapter shall be collected 10 by the director and remitted to the treasurer of state, to 11 be deposited in the boiler and pressure vessel safety fund 12 pursuant to section 89.8 licensing and regulation fund created 13 in section 10A.507 , together with an itemized statement showing 14 the source of collection. 15 Sec. 34. Section 89A.19, Code 2023, as amended by 2023 Iowa 16 Acts, Senate File 514, section 1820, is amended by striking the 17 section and inserting in lieu thereof the following: 18 89A.19 Fees. 19 All fees collected by the director pursuant to this chapter 20 shall be remitted to the treasurer of state, to be deposited in 21 the licensing and regulation fund created in section 10A.507. 22 Sec. 35. Section 101A.12, Code 2023, as amended by 2023 23 Iowa Acts, Senate File 514, section 1550, is amended to read 24 as follows: 25 101A.12 Deposit and use of fees. 26 The fees collected by the director in issuing licenses 27 pursuant to this chapter shall be deposited in the state 28 general fund licensing and regulation fund created in section 29 10A.507 . 30 Sec. 36. Section 103.7, Code 2023, as amended by 2023 Iowa 31 Acts, Senate File 514, section 1561, is amended by striking the 32 section and inserting in lieu thereof the following: 33 103.7 Fees. 34 All licensing, examination, renewal, and inspection fees 35 -20- SF 557.2007 (3) 90 es/ns 20/ 29
under this chapter shall be deposited in the licensing and 1 regulation fund created in section 10A.507. 2 Sec. 37. Section 105.9, subsection 3, Code 2023, is amended 3 by striking the subsection and inserting in lieu thereof the 4 following: 5 3. All fees collected under this chapter shall be deposited 6 in the licensing and regulation fund created in section 7 10A.507. 8 Sec. 38. Section 135.11A, subsection 1, Code 2023, as 9 amended by 2023 Iowa Acts, Senate File 514, section 1580, is 10 amended to read as follows: 11 1. Each board under chapters chapter 100C, 103, 103A, 12 105, or 147 that are is under the administrative authority 13 of the department , except the board of nursing, board of 14 medicine, dental board, and board of pharmacy, shall receive 15 administrative and clerical support from the department and 16 may not employ its own support staff for administrative and 17 clerical duties. The executive director of the board of 18 nursing, board of medicine, dental board, and board of pharmacy 19 shall be appointed pursuant to section 135.11B . 20 Sec. 39. Section 147.80, subsection 3, Code 2023, is amended 21 to read as follows: 22 3. The board of medicine, the board of pharmacy, the 23 dental board, and the board of nursing shall retain individual 24 executive officers pursuant to section 135.11B , but shall 25 make every effort to share administrative, clerical, and 26 investigative staff to the greatest extent possible . 27 Sec. 40. Section 147.82, Code 2023, as amended by 2023 28 Iowa Acts, Senate File 514, section 1624, is amended to read 29 as follows: 30 147.82 Fee retention. 31 All fees collected by a board listed in section 147.13 or by 32 the department, and fees collected pursuant to sections 124.301 33 and 147.80 and chapter 155A by the board of pharmacy, shall be 34 retained by each board or by the department deposited in the 35 -21- SF 557.2007 (3) 90 es/ns 21/ 29
licensing and regulation fund created in section 10A.507 . The 1 moneys retained by a board shall be used for any of the board’s 2 duties, including but not limited to the addition of full-time 3 equivalent positions for program services and investigations. 4 Revenues retained by a board pursuant to this section shall 5 be considered repayment receipts as defined in section 8.2 . 6 Notwithstanding section 8.33 , moneys retained by a board 7 pursuant to this section are not subject to reversion to the 8 general fund of the state. 9 Sec. 41. Section 542.4, subsection 4, Code 2023, is amended 10 to read as follows: 11 4. All moneys collected by the board from fees authorized 12 to be charged by this chapter shall be received and accounted 13 for by the board and shall be paid monthly to the treasurer of 14 state for deposit in the general fund of the state licensing 15 and regulation fund created in section 10A.507 . Expenses 16 of administering this chapter shall be paid from moneys 17 appropriated to the department pursuant to section 10A.507 18 and from appropriations made by the general assembly, which 19 expenses may include but shall not be limited to the costs 20 of conducting investigations and of taking testimony and 21 procuring the attendance of witnesses before the board or its 22 committees; all legal proceedings taken under this chapter for 23 the enforcement of this chapter ; and educational programs for 24 the benefit of the public and licensees and their employees. 25 Sec. 42. Section 542B.12, Code 2023, is amended to read as 26 follows: 27 542B.12 Disposition of fees. 28 The staff shall collect and account for all fees provided 29 for by this chapter and pay the fees to the treasurer of state 30 who shall deposit the fees in the general fund of the state 31 licensing and regulation fund created in section 10A.507 . 32 Sec. 43. Section 543B.14, Code 2023, as amended by 2023 33 Iowa Acts, Senate File 514, section 1669, is amended to read 34 as follows: 35 -22- SF 557.2007 (3) 90 es/ns 22/ 29
543B.14 Fees and expenses. 1 All fees and charges collected by the real estate commission 2 under this chapter shall be paid into the general fund of the 3 state, except that deposited in the licensing and regulation 4 fund created in section 10A.507. Of the moneys deposited 5 in the fund, twenty-five dollars from each real estate 6 salesperson’s license fee and each broker’s license fee shall 7 be appropriated to the department of inspections, appeals, and 8 licensing for the purpose of hiring and compensating a real 9 estate education director and regulatory compliance personnel. 10 All expenses incurred by the commission under this chapter , 11 including compensation of staff assigned to the commission, 12 shall be paid from funds appropriated for those purposes. 13 Sec. 44. Section 543D.6, subsection 2, Code 2023, as amended 14 by 2023 Iowa Acts, Senate File 514, section 1674, is amended 15 to read as follows: 16 2. All fees collected by the board shall be deposited into 17 the commerce revolving licensing and regulation fund created in 18 section 546.12 and are appropriated to the director on behalf 19 of the board 10A.507 to be used to administer this chapter , 20 including but not limited to purposes such as examinations, 21 investigations, and administrative staffing. Notwithstanding 22 section 8.33 , moneys retained by the director pursuant to this 23 section are not subject to reversion to the general fund of 24 the state. However, the appraisal management company national 25 registry fees the board collects on behalf of the appraisal 26 subcommittee as defined in section 543E.3 shall be transmitted 27 to the appraisal subcommittee in accordance with federal laws 28 and regulations. 29 Sec. 45. Section 543E.10, subsection 2, Code 2023, as 30 amended by 2023 Iowa Acts, Senate File 514, section 1685, is 31 amended to read as follows: 32 2. Except as provided in subsection 3 , all fees collected 33 under this chapter shall be deposited into the commerce 34 revolving licensing and regulation fund created in section 35 -23- SF 557.2007 (3) 90 es/ns 23/ 29
546.12 and are appropriated to the director 10A.507 to be 1 used to administer this chapter including but not limited 2 to purposes such as examinations, investigations, and 3 administrative staffing. Notwithstanding section 8.33 , moneys 4 appropriated pursuant to this subsection are not subject to 5 reversion to the general fund of the state. 6 Sec. 46. Section 544A.11, subsection 2, Code 2023, is 7 amended to read as follows: 8 2. Section 544B.14, subsection 2, Code 2023, is 12 amended to read as follows: 13 2. All fees shall be collected by the secretary, paid to the 14 treasurer of state , and deposited in the general fund of the 15 state licensing and regulation fund created in section 10A.507 . 16 Sec. 48. Section 544C.3, subsection 1, paragraph e, Code 17 2023, is amended to read as follows: 18 e. Establishing fees for registration as a registered 19 interior designer, renewal of registration, reinstatement of 20 registration, and for other activities of the board pertaining 21 to its duties. The fees shall be sufficient to defray the 22 costs of administering this chapter , and shall be deposited in 23 the general fund of the state licensing and regulation fund 24 created in section 10A.507 . 25 Sec. 49. Section 546.10, subsection 3, paragraph b, Code 26 2023, as amended by 2023 Iowa Acts, Senate File 514, section 27 1704, is amended by striking the paragraph. 28 Sec. 50. Section 546.10, subsection 5, Code 2023, as amended 29 by 2023 Iowa Acts, Senate File 514, section 1704, is amended 30 by striking the subsection and inserting in lieu thereof the 31 following: 32 5. All expenses required in the discharge of the duties and 33 responsibilities imposed upon the department, the director, and 34 the licensing boards by the laws of this state shall be paid 35 -24- SF 557.2007 (3) 90 es/ns 24/ 29
from moneys appropriated for those purposes. 1 Sec. 51. REPEAL. Section 89.8, Code 2023, is repealed. 2 Sec. 52. TRANSITION PROVISIONS. 3 1. Any unobligated and unencumbered moneys in the boiler 4 and pressure vessel safety revolving fund created in section 5 89.8, Code 2023, as of July 1, 2023, shall be transferred for 6 deposit in the licensing and regulation fund created in section 7 10A.507, as enacted by this Act. 8 2. Any unobligated and unencumbered moneys in the revolving 9 elevator safety fund created in section 89A.19, Code 2023, 10 as of July 1, 2023, shall be transferred for deposit in the 11 licensing and regulation fund created in section 10A.507, as 12 enacted by this Act. 13 3. Any unobligated and unencumbered moneys in the 14 electrician and installer licensing and inspection fund created 15 in section 103.7, Code 2023, as of July 1, 2023, shall be 16 transferred for deposit in the licensing and regulation fund 17 created in section 10A.507, as enacted by this Act. 18 4. Any unobligated and unencumbered moneys retained by any 19 board or the department of public health for the bureau of 20 professional licensure pursuant to section 147.82, Code 2023, 21 as of July 1, 2023, shall be transferred for deposit in the 22 licensing and regulation fund created in section 10A.507, as 23 enacted by this Act. 24 5. All fees collected under chapters 543D and 543E and 25 deposited into the department of commerce revolving fund 26 created in section 546.12, Code 2023, as of July 1, 2023, shall 27 be transferred for deposit in the licensing and regulation fund 28 created in section 10A.507, as enacted by this Act. 29 DEPARTMENT OF REVENUE 30 IOWA LOTTERY DIVISION 31 MAJOR PROCUREMENT CONTRACTS 32 Sec. 53. Section 99G.3, subsection 18, Code 2023, as amended 33 by 2023 Iowa Acts, Senate File 514, section 2300, is amended 34 to read as follows: 35 -25- SF 557.2007 (3) 90 es/ns 25/ 29
18. “Vendor” means a person who provides or proposes to 1 provide goods or services to the department pursuant to a major 2 procurement contract, but does not include an employee of the 3 department under this chapter, a retailer, or a state agency or 4 instrumentality thereof. 5 Sec. 54. Section 99G.8, subsection 13, Code 2023, as amended 6 by 2023 Iowa Acts, Senate File 514, section 2309, is amended 7 to read as follows: 8 13. Board members shall not have any direct or indirect 9 interest in an undertaking that puts their personal interest 10 in conflict with that of the department under this chapter 11 including but not limited to an interest in a major procurement 12 contract or a participating retailer. 13 Sec. 55. Section 99G.9, subsection 2, Code 2023, as amended 14 by 2023 Iowa Acts, Senate File 514, section 2313, is amended 15 to read as follows: 16 2. Approve, disapprove, amend, or modify the terms of major 17 lottery procurements recommended by the administrator. 18 Sec. 56. Section 99G.22, subsections 1, 3, 4, and 6, Code 19 2023, as amended by 2023 Iowa Acts, Senate File 514, section 20 2324, are amended to read as follows: 21 1. The department shall investigate the financial 22 responsibility, security, and integrity of any lottery system 23 vendor who is a finalist in submitting a bid, proposal, or 24 offer as part of a major procurement contract. Before a major 25 procurement contract is awarded, the division of criminal 26 investigation of the department of public safety shall conduct 27 a background investigation of the vendor to whom the contract 28 is to be awarded. The administrator shall consult with the 29 division of criminal investigation and shall provide for the 30 scope of the background investigation and due diligence to 31 be conducted in connection with major procurement contracts. 32 At the time of submitting a bid, proposal, or offer to the 33 department on a major procurement contract, each vendor shall 34 be required to submit to the division of criminal investigation 35 -26- SF 557.2007 (3) 90 es/ns 26/ 29
appropriate investigation authorization to facilitate this 1 investigation, together with an advance of funds to meet the 2 anticipated investigation costs. If the division of criminal 3 investigation determines that additional funds are required 4 to complete an investigation, the vendor will be so advised. 5 The background investigation by the division of criminal 6 investigation may include a national criminal history check 7 through the federal bureau of investigation. The screening 8 of vendors or their employees through the federal bureau of 9 investigation shall be conducted by submission of fingerprints 10 through the state criminal history repository to the federal 11 bureau of investigation. 12 3. A major procurement contract shall not be entered into 13 with any lottery system vendor who has not complied with 14 the disclosure requirements described in this section , and 15 any contract with such a vendor is voidable. Any contract 16 with a vendor that does not comply with the requirements for 17 periodically updating such disclosures during the tenure of 18 the contract as may be specified in such contract may be 19 terminated. The provisions of this section shall be construed 20 broadly and liberally to achieve the ends of full disclosure 21 of all information necessary to allow for a full and complete 22 evaluation by the department of the competence, integrity, 23 background, and character of vendors for major procurements. 24 4. A major procurement contract shall not be entered into 25 with any vendor who has been found guilty of a felony related 26 to the security or integrity of the lottery in this or any 27 other jurisdiction. 28 6. If, based on the results of a background investigation, 29 the department determines that the best interests of the 30 department, including but not limited to the department’s 31 reputation for integrity, would be served thereby, the 32 department may disqualify a potential vendor from contracting 33 with the department for a major procurement contract or from 34 acting as a subcontractor in connection with a contract for a 35 -27- SF 557.2007 (3) 90 es/ns 27/ 29
major procurement contract. 1 Sec. 57. Section 99G.37, Code 2023, as amended by 2023 2 Iowa Acts, Senate File 514, section 2343, is amended to read 3 as follows: 4 99G.37 Competitive bidding Major procurement contracts . 5 All major procurement contracts under this chapter must 6 be competitively bid entered into in accordance with chapter 7 8A, subchapter III, part 2. Procurement Major procurement 8 contracts shall take into consideration the greatest integrity 9 for the Iowa lottery. In any bidding process, the services 10 of the department of administrative services shall may be 11 utilized. 12 Sec. 58. Section 99G.39, subsection 1, Code 2023, as amended 13 by 2023 Iowa Acts, Senate File 514, section 2345, is amended 14 to read as follows: 15 1. Upon receipt of any revenue from lottery games , the 16 director shall deposit the moneys in the lottery fund created 17 pursuant to section 99G.40 . At least fifty percent of the 18 projected annual revenue accruing from the sale of tickets 19 or shares shall be allocated for payment of prizes to the 20 holders of winning tickets. After the payment of prizes, the 21 expenses of conducting the lottery shall be deducted from the 22 department’s revenue under this chapter prior to disbursement. 23 Expenses for advertising production and media purchases shall 24 not exceed four percent of the department’s gross revenue under 25 this chapter for the year. 26 Sec. 59. REPEAL. 2023 Iowa Acts, Senate File 514, section 27 2301, is repealed. > 28 2.
