If,
after
investigation,
the
department
of
education
4
determines
that
a
school
district
or
an
employee
of
a
school
5
district
has
violated
the
provisions
of
subparagraph
(1)

related
to
library
programs
containing
only
age-appropriate
7
materials,
beginning
January
1,
2024,
the
school
district
8
or
employee
of
the
school
district,
as
applicable,
shall
be
9
subject
to
the
following:

(a)
For
the
first
violation
of
subparagraph
(1),
the
11
department
of
education
shall
issue
a
written
warning
to
the
12
board
of
directors
of
the
school
district
or
the
employee,
as
13
applicable.
14
(b)
(i)
For
a
second
or
subsequent
violation
of
15
subparagraph
(1),
if
the
department
of
education
finds
that
16
a
school
district
knowingly
violated
subparagraph
(1),
the
17
superintendent
of
the
school
district
shall
be
subject
to
18
a
hearing
conducted
by
the
board
of
educational
examiners
19
pursuant
to
section
272,2,
subsection
14,
which
may
result
in
20
disciplinary
action.
21
(ii)
For
a
second
or
subsequent
violation
of
subparagraph
22
(1),
if
the
department
of
education
finds
that
an
employee
23
of
the
school
district
who
holds
a
license,
certificate,
24
authorization,
or
statement
of
recognition
issued
by
the
board
25
of
educational
examiners
knowingly
violated
subparagraph
(1),
26
the
employee
shall
be
subject
to
a
hearing
conducted
by
the
27
board
of
educational
examiners
pursuant
to
section
272.2,
28
subsection
14,
which
may
result
in
disciplinary
action.
