Senate File 496 S-3070 Amend the amendment, S-3069, to Senate File 496, as follows: 1 1. By striking page 1, line 2, through page 4, line 27, and 2 inserting: 3 < 1. By striking everything after the enacting clause and 4 inserting: 5 < Section 1. Section 256.11, subsection 2, Code 2023, is 6 amended to read as follows: 7 2. The kindergarten program shall include experiences 8 designed to develop healthy emotional and social habits and 9 growth in the language arts and communication skills, as 10 well as a capacity for the completion of individual tasks, 11 and protect and increase physical well-being with attention 12 given to experiences relating to the development of life 13 skills and age-appropriate and research-based human growth and 14 development. A kindergarten teacher shall be licensed to teach 15 in kindergarten. An accredited nonpublic school must meet the 16 requirements of this subsection only if the nonpublic school 17 offers a kindergarten program. 18 Sec. 2. Section 256E.7, subsection 2, Code 2023, is amended 19 by adding the following new paragraph: 20 NEW PARAGRAPH . 0j. Be subject to and comply with the 21 requirements of section 280.33 relating to the publication 22 of a list of topics covered when providing human growth and 23 development instruction, and the adoption of a policy allowing 24 the parent or guardian of a student to excuse the student from 25 instruction related to a selected topic or selected topics in 26 the health or human growth and development instruction, in the 27 same manner as a school district. 28 Sec. 3. NEW SECTION . 279.77 Library catalog. 29 1. Each school district shall maintain a publicly available 30 catalog of books and other materials that are available to be 31 checked out in libraries operated by the school district. 32 2. a. Each school district that maintains in electronic 33 form a catalog of books and other materials that are available 34 to be checked out in libraries operated by the school district 35 -1- S 3069.1090 (1) 90 jda/jh 1/ 4 #1.
as of this effective date of this Act shall do all of the 1 following: 2 (1) Publish the catalog on the school district’s internet 3 site on or before January 1, 2026. 4 (2) As of the effective date of this Act and until the 5 school district publishes the catalog on the school district’s 6 internet site pursuant to subparagraph (1), grant physical 7 access to the catalog to members of the general public 8 for at least three hours each week during the school year, 9 not including during the summer months when school is not 10 in session or during a vacation period, at times that are 11 convenient to the general public. 12 (3) Publish the dates and times the school district will 13 grant physical access to the catalog to members of the general 14 public on the school district’s internet site. 15 b. Each school district that maintains in other than 16 electronic form a catalog of books and other materials that are 17 available to be checked out in libraries operated by the school 18 district shall do all of the following: 19 (1) Grant physical access to the catalog to members of the 20 general public for at least three hours each week during the 21 school year, not including during the summer months when school 22 is not in session or during a vacation period, at times that 23 are convenient to the general public. 24 (2) Publish the dates and times the school district will 25 grant physical access to the catalog to members of the general 26 public on the school district’s internet site. 27 Sec. 4. NEW SECTION . 279.78 Parent or guardian request to 28 prohibit a student from checking out books or materials from a 29 school library. 30 1. a. A parent or guardian who has physical custody of 31 a student enrolled in a school district may submit a signed 32 notice to the school district requesting that the student be 33 prohibited from checking out from a library operated by the 34 school district a book or any other material that is described 35 -2- S 3069.1090 (1) 90 jda/jh 2/ 4
in the notice and included in the catalog maintained by the 1 school district pursuant to section 279.77. 2 b. A parent or guardian who has physical custody of a 3 student enrolled in a school district may submit the notice 4 described in paragraph “a” beginning two weeks prior to the 5 start date of the school district’s school calendar and at 6 any time during the school calendar year. A notice submitted 7 pursuant to paragraph “a” shall be valid for the current school 8 year and the succeeding school year and may be renewed by the 9 parent or guardian at any time. 10 2. Each school district shall maintain a list of the notices 11 submitted pursuant to subsection 1 that remain valid. The only 12 school district employees who may access the list are qualified 13 teacher librarians and administrators. The list shall be 14 confidential and shall not be a public record subject to 15 disclosure under chapter 22. For purposes of this subsection, 16 “administrator” means the same as defined in section 272.1. 17 3. A school district shall not allow a student enrolled in 18 the school district to check out a book or any other material 19 from a library operated by the school district if the list 20 described in subsection 2 indicates that a parent or guardian 21 who has physical custody of the student submitted a notice 22 described in subsection 1, paragraph “a” , requesting that the 23 student be prohibited from checking out the book or other 24 material. 25 Sec. 5. NEW SECTION . 280.33 Human growth and development 26 instruction. 27 1. The board of directors of each public school district and 28 the authorities in charge of each accredited nonpublic school 29 shall publish on the school district’s or accredited nonpublic 30 school’s internet site a list of the topics the school district 31 or accredited nonpublic school covers when providing the human 32 growth and development instruction required under section 33 256.11, subsections 2, 3, and 4. 34 2. a. and the authorities in charge of each accredited nonpublic 1 school shall adopt a policy that allows a parent or guardian 2 who has physical custody of a student enrolled in the school 3 district or accredited nonpublic school to excuse the student 4 from any classes, lectures, assignments, activities, or any 5 other instruction related to any selected topic or topics in 6 the health or human growth and development instruction in 7 the student’s grade, as specified by the parent or guardian, 8 by submitting a request to the school district or accredited 9 nonpublic school. 10 b. The policy described in paragraph “a” must include a copy 11 of the form to be used by a parent or guardian to excuse the 12 student from any classes, lectures, assignments, activities, or 13 any other instruction related to any selected topic or topics 14 in the health or human growth and development instruction. 15 c. The board of directors of each public school district and 16 the authorities in charge of each accredited nonpublic school 17 shall annually inform the parents and guardians of students 18 enrolled in the school district of the opportunity to excuse a 19 student from any classes, lectures, assignments, activities, or 20 any other instruction related to any selected topic or topics 21 in the health or human growth and development instruction. 22 3. The requirements in this section applicable to public 23 school districts are in addition to the requirements provided 24 in section 279.50. > 25 2.
