Senate File 496 S-3069 Amend Senate File 496 as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < Section 1. Section 256.11, subsection 2, Code 2023, is 4 amended to read as follows: 5 2. The kindergarten program shall include experiences 6 designed to develop healthy emotional and social habits and 7 growth in the language arts and communication skills, as 8 well as a capacity for the completion of individual tasks, 9 and protect and increase physical well-being with attention 10 given to experiences relating to the development of life 11 skills and age-appropriate and research-based human growth and 12 development. A kindergarten teacher shall be licensed to teach 13 in kindergarten. An accredited nonpublic school must meet the 14 requirements of this subsection only if the nonpublic school 15 offers a kindergarten program. 16 Sec. 2. Section 256E.7, subsection 2, Code 2023, is amended 17 by adding the following new paragraph: 18 NEW PARAGRAPH . 0j. Be subject to and comply with the 19 requirements of section 280.33 relating to the publication 20 of a list of topics covered when providing human growth and 21 development instruction, and the adoption of a policy allowing 22 the parent or guardian of a student to excuse the student from 23 instruction related to topics in the health or human growth 24 and development instruction, in the same manner as a school 25 district. 26 Sec. 3. NEW SECTION . 279.77 Library catalog. 27 1. Each school district shall maintain a publicly available 28 catalog of books and other materials that are available to be 29 checked out in libraries operated by the school district. 30 2. a. Each school district that maintains in electronic 31 form a catalog of books and other materials that are available 32 to be checked out in libraries operated by the school district 33 as of this effective date of this Act shall do all of the 34 following: 35 -1- SF 496.1035 (1) 90 jda/jh 1/ 4 #1.
(1) Publish the catalog on the school district’s internet 1 site on or before January 1, 2026. 2 (2) As of the effective date of this Act and until the 3 school district publishes the catalog on the school district’s 4 internet site pursuant to subparagraph (1), grant physical 5 access to the catalog to members of the general public 6 for at least three hours each week during the school year, 7 not including during the summer months when school is not 8 in session or during a vacation period, at times that are 9 convenient to the general public. 10 (3) Publish the dates and times the school district will 11 grant physical access to the catalog to members of the general 12 public on the school district’s internet site. 13 b. Each school district that maintains in other than 14 electronic form a catalog of books and other materials that are 15 available to be checked out in libraries operated by the school 16 district shall do all of the following: 17 (1) Grant physical access to the catalog to members of the 18 general public for at least three hours each week during the 19 school year, not including during the summer months when school 20 is not in session or during a vacation period, at times that 21 are convenient to the general public. 22 (2) Publish the dates and times the school district will 23 grant physical access to the catalog to members of the general 24 public on the school district’s internet site. 25 Sec. 4. NEW SECTION . 279.78 Parent or guardian request to 26 prohibit a student from checking out books or materials from a 27 school library. 28 1. a. A parent or guardian who has physical custody of 29 a student enrolled in a school district may submit a signed 30 notice to the school district requesting that the student be 31 prohibited from checking out from a library operated by the 32 school district a book or any other material that is described 33 in the notice and included in the catalog maintained by the 34 school district pursuant to section 279.77. 35 -2- SF 496.1035 (1) 90 jda/jh 2/ 4
b. A parent or guardian who has physical custody of a 1 student enrolled in a school district may submit the notice 2 described in paragraph “a” beginning two weeks prior to the 3 start date of the school district’s school calendar and at 4 any time during the school calendar year. A notice submitted 5 pursuant to paragraph “a” shall be valid for the current school 6 year and the succeeding school year and may be renewed by the 7 parent or guardian at any time. 8 2. Each school district shall maintain a list of the notices 9 submitted pursuant to subsection 1 that remain valid. The only 10 school district employees who may access the list are qualified 11 teacher librarians and administrators. The list shall be 12 confidential and shall not be a public record subject to 13 disclosure under chapter 22. For purposes of this subsection, 14 “administrator” means the same as defined in section 272.1. 15 3. A school district shall not allow a student enrolled in 16 the school district to check out a book or any other material 17 from a library operated by the school district if the list 18 described in subsection 2 indicates that a parent or guardian 19 who has physical custody of the student submitted a notice 20 described in subsection 1, paragraph “a” , requesting that the 21 student be prohibited from checking out the book or other 22 material. 23 Sec. 5. NEW SECTION . 280.33 Human growth and development 24 instruction. 25 1. The board of directors of each public school district and 26 the authorities in charge of each accredited nonpublic school 27 shall publish on the school district’s or accredited nonpublic 28 school’s internet site a list of the topics the school district 29 or accredited nonpublic school covers when providing the human 30 growth and development instruction required under section 31 256.11, subsections 2, 3, and 4. 32 2. a. The board of directors of each public school district 33 and the authorities in charge of each accredited nonpublic 34 school shall adopt a policy that allows a parent or guardian 35 -3- SF 496.1035 (1) 90 jda/jh 3/ 4
who has physical custody of a student enrolled in the school 1 district or accredited nonpublic school to excuse the student 2 from any classes, lectures, assignments, activities, or any 3 other instruction related to any topics in the health or human 4 growth and development instruction in the student’s grade, as 5 specified by the parent or guardian, by submitting a request to 6 the school district or accredited nonpublic school. 7 b. The policy described in paragraph “a” must include a copy 8 of the form to be used by a parent or guardian to excuse the 9 student from any classes, lectures, assignments, activities, or 10 any other instruction related to any topics in the health or 11 human growth and development instruction. 12 c. The board of directors of each public school district and 13 the authorities in charge of each accredited nonpublic school 14 shall annually inform the parents and guardians of students 15 enrolled in the school district of the opportunity to excuse a 16 student from any classes, lectures, assignments, activities, or 17 any other instruction related to any topics in the health or 18 human growth and development instruction. 19 3. The requirements in this section applicable to public 20 school districts are in addition to the requirements provided 21 in section 279.50. > 22 2.
