Page 59, after line 11 by inserting: 2 < DIVISION ___ 3 COURT APPOINTED SPECIAL ADVOCATES AND CHILD ADVOCACY BOARD 4 Sec. ___. Section 10A.104, subsection 2, Code 2024, is 5 amended to read as follows: 6 2. Appoint the administrators of the divisions within 7 the department and all other personnel deemed necessary for 8 the administration of this chapter , except the state public 9 defender, assistant state public defenders, administrator 10 of the racing and gaming commission, labor commissioner, 11 workers’ compensation commissioner, director of the Iowa 12 state civil rights commission, and members of the employment 13 appeal board , and administrator of the child advocacy board 14 created in section 237.16 . All persons appointed and employed 15 in the department are covered by the provisions of chapter 16 8A, subchapter IV , but persons not appointed by the director 17 are exempt from the merit system provisions of chapter 8A, 18 subchapter IV . 19 Sec. ___. Section 237.16, subsections 1, 3, 4, and 5, Code 20 2024, are amended to read as follows: 21 1. The child advocacy board is created within the department 22 of inspections, appeals, and licensing . The state board 23 consists of nine members appointed by the governor, subject 24 to confirmation by the senate and directly responsible to 25 the governor. One member shall be an active court appointed 26 special advocate volunteer, one member shall be an active 27 member of a local citizen foster care review board, and one 28 member shall be a judicial branch employee or judicial officer 29 appointed from nominees submitted by the judicial branch. The 30 appointment is for a term of four years that begins and ends as 31 provided in section 69.19 . Vacancies on the state board shall 32 be filled in the same manner as original appointments are made. 33 3. An employee of the department or the department 34 of inspections, appeals, and licensing , an employee of a 35 -1- H 8348.4388 (2) 90 pf/ko 1/ 3 #1.

child-placing agency, an employee of an agency with which the 1 department contracts for services for children under foster 2 care, a foster parent providing foster care, or an employee of 3 the district court is not eligible to serve on the state board. 4 However, the judicial branch employee or judicial officer 5 appointed from nominees submitted by the judicial branch in 6 accordance with subsection 1 shall be eligible to serve on the 7 state board. 8 4. The department and the department of inspections, 9 appeals, and licensing shall jointly develop written protocols 10 detailing the responsibilities of the each department with 11 regard to children under the purview of the state board. The 12 protocols shall be reviewed by the department departments on an 13 annual basis. 14 5. The director of the department of inspections, appeals, 15 and licensing shall employ appropriate staff for the state 16 board in accordance with available funding. 17 Sec. ___. Section 237.18, Code 2024, is amended by adding 18 the following new subsection: 19 NEW SUBSECTION . 8. Employ appropriate staff in accordance 20 with available funding. 21 Sec. ___. Section 237.21, subsection 5, Code 2024, is 22 amended to read as follows: 23 5. Members of the state board and local boards, court 24 appointed special advocates, and the employees of the 25 department and the department of inspections, appeals, and 26 licensing are subject to standards of confidentiality pursuant 27 to sections 217.30 , 228.6, subsection 1 , sections 235A.15 , 28 600.16 , and 600.16A . Members of the state and local boards, 29 court appointed special advocates, and employees of the 30 department and the department of inspections, appeals, and 31 licensing who disclose information or records of the board or 32 department, other than as provided in subsections 2, 3, and 4 , 33 section 232.126 , and section 237.20, subsection 2 , are guilty 34 of a simple misdemeanor. > 35 -2- H 8348.4388 (2) 90 pf/ko 2/ 3
