Of the moneys appropriated pursuant to 17 this subparagraph division, five hundred thousand dollars or 18 one-third of the moneys appropriated, whichever is higher, 19 shall be deposited in the water quality initiative fund created 20 in section 466B.45 467.312 for purposes of supporting the 21 water quality initiative administered by the division of soil 22 conservation and water quality as provided in section 466B.42 23 467.311 . 24 Sec. ___. Any collected civil penalty and interest on a civil 5 penalty shall be credited to the Iowa nutrient water quality 6 research fund created in section 466B.46 467.323 . 7 Sec. ___. Section 459.604, subsection 2, Code 2024, is 8 amended to read as follows: 9 2. Moneys assessed and collected in civil penalties, and 10 interest earned on civil penalties, arising out of a violation 11 involving an animal feeding operation shall be credited to the 12 Iowa nutrient water quality research fund created in section 13 466B.46 467.323 . 14 Sec. ___. Section 459A.502, Code 2024, is amended to read 15 as follows: 16 459A.502 Violations —— civil penalty. 17 A person who violates this chapter shall be subject to 18 a civil penalty which shall be established, assessed, and 19 collected in the same manner as provided in section 455B.191 . 20 Any collected civil penalty and interest on a civil penalty 21 shall be credited to the Iowa nutrient water quality research 22 fund created in section 466B.46 467.323 . A person shall not 23 be subject to a penalty under this section and a penalty under 24 section 459.603 for the same violation. 25 Sec. ___. Section 466B.48, subsection 1, Code 2024, is 28 amended to read as follows: 29 1. The state board of regents shall establish and maintain 30 in Ames as part of Iowa state university of science and 31 technology an Iowa nutrient water quality research center 32 advisory council. 33 Sec. ___.
