Section 257.10, subsection 10, paragraph d, 4 Code 2024, is amended to read as follows: 5 d. The use of the funds calculated under this subsection 6 and any amount designated for professional development purposes 7 from the school district’s flexibility account under section 8 298A.2, subsection 2 , shall comply with the requirements of 9 chapter 284 . If all professional development requirements of 10 chapter 284 are met and funds received under this subsection 11 remain unexpended and unobligated at the end of a fiscal year 12 beginning on or after July 1, 2017, the school district may 13 transfer all or a portion of such unexpended and unobligated 14 funds for deposit in the school district’s flexibility account 15 established under section 298A.2, subsection 2 . At the end 16 of a fiscal year beginning on or after July 1, 2022, the 17 school district may use all or a portion of funds under this 18 subsection for the purposes authorized under subsection 9 , 19 paragraph “d” . At the end of a fiscal year beginning on 20 or after July 1, 2024, the school district may use all or 21 a portion of funds under this subsection for any trainings 22 required as a condition for a school employee to carry a weapon 23 at the school during school hours. > 24 2. A school district shall install and maintain school 28 infrastructure, as defined in section 423F.3, subsection 29 6, paragraph “a” , subparagraph (5), so that such school 30 infrastructure performs as expected for the operational life 31 of the school infrastructure. 32 2. is not included on the list established by the department 1 of homeland security and emergency management pursuant to 2 section 423F.3, subsection 6, paragraph “a” , subparagraph (5), 3 subparagraph division (a), subparagraph subdivision (vii), 4 subparagraph part (C). 5 3. If a school district purchases school infrastructure, 6 as defined in section 423F.3, subsection 6, paragraph 7 “a” , subparagraph (4), or other school safety and security 8 equipment, including radios, cameras, panic buttons, automated 9 locks, or shatter-resistant window film, the school district 10 shall install and maintain in an operable condition such school 11 infrastructure or school safety and security equipment. 12 Sec. ___. Section 423F.3, subsection 6, paragraph a, Code 13 2024, is amended by adding the following new subparagraph: 14 NEW SUBPARAGRAPH . (5) (a) Additionally, “school 15 infrastructure” includes software or other innovative 16 technology, and the cost of subscription and monitoring fees 17 associated with such software or other innovative technology, 18 that meets all of the following requirements: 19 (i) Is designed to detect and alert school district 20 employees and first responders if there is a visible, 21 unholstered firearm on property owned by the school district. 22 (ii) Is capable of integrating with local public safety 23 answering point technology. 24 (iii) Is designed to integrate with a school district’s 25 existing security camera infrastructure. 26 (iv) Was developed in the United States without the use of 27 any third-party data or open-source data. 28 (v) Was developed in the United States by an organization in 29 which a majority interest and a controlling interest is owned 30 by shareholders who are citizens of the United States. 31 (vi) Is not associated with any company that is owned or 32 controlled by the People’s Republic of China. 33 (vii) All of the video processing, data processing, 34 and data storage occurs on school district property or on 35 -2- HF 2652.4382.S (1) 90 mb 2/ 6
servers located within the United States that follow data 1 retention policies that are consistent with rules adopted by 2 the department of homeland security and emergency management. 3 The department of homeland security and emergency management 4 shall adopt rules pursuant to chapter 17A to administer this 5 subparagraph subdivision. The rules adopted by the department 6 of homeland security and emergency management shall do all of 7 the following: 8 (A) Establish security standards related to the 9 transmission and storage of video and data. 10 (B) Establish model data retention policies related to the 11 storage of video and data. 12 (C) Establish a list of organizations that satisfy the 13 standards established by the department of homeland security 14 and emergency management pursuant to this subparagraph 15 subdivision. An organization may submit a request to the 16 department of homeland security and emergency management to be 17 included on this list. 18 (viii) Was developed by an organization that is on the 19 list established by the department of homeland security and 20 emergency management pursuant to subparagraph subdivision 21 (vii), subparagraph part (C). 22 (ix) Beginning July 1, 2025, is designated by the secretary 23 of homeland security as qualified anti-terrorism technology 24 under 6 U.S.C. §441 et seq. 25 (b) For purposes of this subparagraph, “school 26 infrastructure” does not include the cost of personnel. > 27 3. Section 279.84, subsections 2 and 3, if enacted 6 by 2024 Iowa Acts, House File 2586, section 1, are amended to 7 read as follows: 8 2. The board of directors of each school district with 9 a total enrollment of at least eight thousand students shall 10 employ, or retain the services of, at least one private school 11 security officer or school resource officer to guard each 12 attendance center where students enrolled in grade nine, grade 13 ten, grade eleven, or grade twelve regularly attend classes, 14 unless a majority of the members of the board of directors of 15 the school district vote to not employ or retain a private 16 school security officer or a school resource officer. A 17 private school security officer employed or retained by the 18 board of directors of a school district pursuant to this 19 subsection shall be required to participate in the annual live 20 scenario training and quarterly live firearms training provided 21 approved by the department of public safety pursuant to section 22 724.6, subsection 1, paragraph “a” , subparagraph (3). 23 3. The board of directors of each school district with 24 a total enrollment of less than eight thousand students is 25 encouraged to employ, or retain the services of, at least one 26 private school security officer or school resource officer 27 to guard each attendance center where students enrolled in 28 grade nine, grade ten, grade eleven, or grade twelve regularly 29 attend classes. A private school security officer employed 30 or retained by the board of directors of a school district 31 pursuant to this subsection shall be required to participate 32 in the annual live scenario training and quarterly live 33 firearms training provided approved by the department of public 34 safety pursuant to section 724.6, subsection 1, paragraph “a” , 35 -4- HF 2652.4382.S (1) 90 mb 4/ 6 #8. #9.
subparagraph (3). > 1 < Sec. ___. Section 724.6, subsection 1, paragraph a, 2 subparagraph (3), if enacted by 2024 Iowa Acts, House File 3 2586, section 2, is amended to read as follows: 4 (3) A person may be issued a permit to carry weapons if the 5 person is a school employee of a school district, a private 6 school, or an institution of higher education as defined 7 in section 722.11. The person shall complete a prescribed 8 firearm safety training course offered pursuant to section 9 724.9, subsection 1, prior to being issued a permit, and not be 10 disqualified under section 724.8. A person issued a permit to 11 carry weapons under this subparagraph shall receive one-time, 12 in-person legal training, including training on qualified 13 immunity, annual emergency medical training, and annual 14 communication training that is approved by the department of 15 public safety. The department of public safety shall implement 16 required A person issued a permit to carry weapons under this 17 subparagraph shall complete annual live scenario training and 18 quarterly live firearm training approved by the department 19 of public safety for school employees of a school district, 20 a private school, or an institution of higher education that 21 has opted into participating in the professional permitting 22 of school employees. A school employee issued a professional 23 permit to carry by the department of public safety who is up 24 to date with department of public safety-approved all required 25 training, and the school district that employs the school 26 employee, shall be entitled to qualified immunity from criminal 27 or civil liability for all damages incurred pursuant to the 28 application of reasonable force at the place of employment. 29 The identity of a person who has been issued a permit pursuant 30 to this subparagraph shall be confidential and shall not be 31 a public record subject to disclosure under chapter 22.
