House File 2547 H-8195 Amend the amendment, H-8191, to House File 2547, as follows: 1 1. Page 11, after line 26 by inserting: 2 < DIVISION ___ 3 SCHOOL DISTRICTS —— FINANCES 4 Sec. ___. Section 257.31, subsection 5, unnumbered 5 paragraph 1, Code 2024, is amended to read as follows: 6 If a district has unusual circumstances, creating an unusual 7 need for additional funds, including but not limited to the 8 circumstances enumerated in paragraphs “a” through “n” this 9 subsection , the committee may grant supplemental aid to the 10 district from any funds appropriated to the department of 11 education for the use of the school budget review committee 12 for the purposes of this subsection . The school budget 13 review committee shall review a school district’s unexpended 14 fund balance prior to any decision regarding unusual finance 15 circumstances. Such aid shall be miscellaneous income and 16 shall not be included in district cost. In addition to or as 17 an alternative to granting supplemental aid the committee may 18 establish a modified supplemental amount for the district. The 19 school budget review committee shall review a school district’s 20 unspent balance prior to any decision to establish a modified 21 supplemental amount under this subsection . For budget years 22 beginning on or after July 1, 2024, if the school district is 23 granted a modified supplemental amount under this subsection, 24 the school district’s combined property tax rate per one 25 thousand dollars for all school district levies for the budget 26 year shall not exceed the combined property tax rate for all 27 such levies for the base year. 28 Sec. ___. Section 257.31, subsection 5, Code 2024, is 29 amended by adding the following new paragraph: 30 NEW PARAGRAPH . o. (1) The percentage of students enrolled 31 in the school district as the result of open enrollment under 32 section 282.18 is equal to or greater than forty percent of 33 the total number of students enrolled in the school district. 34 The committee shall not approve supplemental aid or a modified 35 -1- H 8191.3653 (2) 90 jda/jh 1/ 3 #1.

supplemental amount that exceeds an amount equal to fifty 1 percent of the product of the net increase in the school 2 district’s enrollment due to open enrollment multiplied by the 3 sum of the following amounts: 4 (a) The difference between the district’s regular program 5 district cost per pupil minus the regular program state cost 6 per pupil. 7 (b) The teacher salary supplement district cost per pupil. 8 (c) The professional development supplement district cost 9 per pupil. 10 (d) The early intervention supplement district cost per 11 pupil. 12 (2) Prior to filing a request for supplemental aid or a 13 modified supplemental amount based on the grounds specified 14 in this paragraph, the board of directors shall hold a public 15 hearing on the issue and shall publish the notice of the time 16 and place of the public hearing. Notice of the time and place 17 of the public hearing shall be published not less than ten nor 18 more than twenty days before the public hearing in a newspaper 19 that is a newspaper of general circulation in the school 20 district. 21 (3) A school district is not eligible for supplemental aid 22 or a modified supplemental amount under this paragraph if a 23 majority of the students enrolled in the school district as 24 the result of open enrollment are students receiving online 25 instruction from a private provider under section 256.43, 26 subsection 2. 27 Sec. ___. EFFECTIVE DATE. This division of this Act, being 28 deemed of immediate importance, takes effect upon enactment. 29 Sec. ___. APPLICABILITY. This division of this Act applies 30 July 1, 2024, for school budget years beginning on or after 31 that date. > 32 2.
