Section 257.31, subsection 5, unnumbered 8 paragraph 1, Code 2024, is amended to read as follows: 9 If a district has unusual circumstances, creating an unusual 10 need for additional funds, including but not limited to the 11 circumstances enumerated in paragraphs “a” through “n” this 12 subsection , the committee may grant supplemental aid to the 13 district from any funds appropriated to the department of 14 education for the use of the school budget review committee 15 for the purposes of this subsection . The school budget 16 review committee shall review a school district’s unexpended 17 fund balance prior to any decision regarding unusual finance 18 circumstances. Such aid shall be miscellaneous income and 19 shall not be included in district cost. In addition to or as 20 an alternative to granting supplemental aid the committee may 21 establish a modified supplemental amount for the district. The 22 school budget review committee shall review a school district’s 23 unspent balance prior to any decision to establish a modified 24 supplemental amount under this subsection . 25 Sec. ___. Section 257.31, subsection 5, Code 2024, is 26 amended by adding the following new paragraph: 27 NEW PARAGRAPH . o. (1) The percentage of students enrolled 28 in the school district as the result of open enrollment under 29 section 282.18 is equal to or greater than forty percent of 30 the total number of students enrolled in the school district. 31 The committee shall not approve supplemental aid or a modified 32 supplemental amount that exceeds an amount equal to fifty 33 percent of the product of the net increase in the school 34 district’s enrollment due to open enrollment multiplied by the 35 -1- HF 2547.3563 (3) 90 jda/jh 1/ 3 #1. #2.
sum of the following amounts: 1 (a) The difference between the district’s regular program 2 district cost per pupil minus the regular program state cost 3 per pupil. 4 (b) The teacher salary supplement district cost per pupil. 5 (c) The professional development supplement district cost 6 per pupil. 7 (d) The early intervention supplement district cost per 8 pupil. 9 (2) Prior to filing a request for supplemental aid or a 10 modified supplemental amount based on the grounds specified 11 in this paragraph, the board of directors shall hold a public 12 hearing on the issue and shall publish the notice of the time 13 and place of the public hearing. Notice of the time and place 14 of the public hearing shall be published not less than ten nor 15 more than twenty days before the public hearing in a newspaper 16 that is a newspaper of general circulation in the school 17 district. 18 (3) A school district is not eligible for supplemental aid 19 or a modified supplemental amount under this paragraph if a 20 majority of the students enrolled in the school district as 21 the result of open enrollment are students receiving online 22 instruction from a private provider under section 256.43, 23 subsection 2. 24 Sec. ___. EFFECTIVE DATE. This division of this Act, being 25 deemed of immediate importance, takes effect upon enactment. 26 Sec. ___. APPLICABILITY. This division of this Act applies 27 July 1, 2024, for school budget years beginning on or after 28 that date. > 29 3.
