b.
Notwithstanding
any
provision
of
this
chapter
to
the

contrary,
the
department
may
establish
by
rule
a
process
to

waive
or
alter
the
work
search
requirements
of
this
subsection
7
for
a
claim
for
benefits
if
an
individual
has
a
reasonable
8
expectation
that
the
individual
will
be
returning
to
employment
9
and
is
attached
to
a
regular
job
or
industry
or
is
a
member
10
in
good
standing
of
a
union
therein
eligible
for
referral
for
11
employment
,
and
if
the
individual’s
employer
will
continue
12
to
cover
the
cost
of
health
insurance,
and
other
employment
13
benefits
provided
to
the
employee
by
the
employer,
during
the
14
period
of
the
waiver
or
alteration
.
To
be
considered
attached
15
to
a
regular
job
or
industry,
an
individual
must
be
on
a
16
short-term
temporary
layoff.
If
work
is
not
available
at
the
17
conclusion
of
the
layoff
period
due
to
short-term
circumstances
18
beyond
the
employer’s
control,
the
employer
may
request
an
19
extension
of
the
waiver
or
alteration
for
up
to
two
weeks
from
20
the
department.
For
purposes
of
this
paragraph,
“short-term
21
temporary
layoff”
means
a
layoff
period
of
sixteen
weeks
or
22
less
due
to
seasonal
weather
conditions
that
impact
the
ability
23
to
perform
work
related
to
highway
construction,
repair,
or
24
maintenance
with
,
which
has
a
specific
return-to-work
date
25
verified
by
the
employer.
