The department of health and human services shall utilize 12 the moneys appropriated for deposit under this section for the 13 purchase, provision, maintenance, and replacement of opioid 14 antagonist medication administered by first responders to 15 persons experiencing an opioid-related overdose and to county 16 health departments for distribution to accredited schools and 17 institutions of higher education upon request. 18 3. If sufficient funds are not available through the 19 opioid settlement fund created in section 12.51, there is 20 appropriated from the Iowa coronavirus fiscal recovery fund 21 created in section 8.57G for deposit in the opioid antagonist 22 medication fund created in section 135.190A for the fiscal year 23 beginning July 1, 2023, and ending June 30, 2024, for direct 24 appropriation to the department of health and human services 25 for the fiscal year beginning July 1, 2023, and ending June 26 30, 2024, an amount sufficient to provide the total amount 27 specified under subsection 1 for the purposes designated under 28 this section. 29 4. Notwithstanding section 8.33, moneys appropriated in 30 this section that remain unencumbered or unobligated at the 31 close of the fiscal year shall not revert but shall remain 32 available for the purposes designated until expended. 33 Sec. ___. SUBSTANCE USE DISORDER RECOVERY HIGH SCHOOLS —— 34 OPIOID SETTLEMENT. 35 -2- SF 562.2173 (1) 90 as/ns 2/ 16
1. There is appropriated from the opioid settlement fund 1 created in section 12.51 to the department of health and human 2 services for the fiscal year beginning July 1, 2023, and ending 3 June 30, 2024, the following amount, or so much thereof as is 4 necessary, for the purpose designated: 5 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 50,000 6 2. The department of health and human services, in 7 collaboration with the department of education, shall study 8 and make recommendations regarding the establishment of one or 9 more public or private recovery high schools in Iowa designed 10 for the education of students in recovery from substance 11 use disorders or dependency or co-occurring disorders such 12 as anxiety, depression, or attention deficit hyperactivity 13 disorder. Such schools shall meet state requirements for 14 awarding a secondary school diploma and support students 15 engaged in a program of recovery. The department of health 16 and human services shall complete the study and submit its 17 recommendations to the governor and the general assembly by 18 November 1, 2023. The recommendations shall include provisions 19 for students to be eligible for education savings accounts 20 without regard to family financial capacity. 21 3. If sufficient funds are not available through the opioid 22 settlement fund created in section 12.51, there is appropriated 23 from the Iowa coronavirus fiscal recovery fund created in 24 section 8.57G for the fiscal year beginning July 1, 2023, and 25 ending June 30, 2024, to the department of health and human 26 services an amount sufficient to provide the total amount 27 specified under subsection 1 for the purposes designated under 28 this section. 29 4. Notwithstanding section 8.33, moneys appropriated in 30 this section that remain unencumbered or unobligated at the 31 close of the fiscal year shall not revert but shall remain 32 available for the purposes designated until expended. 33 Sec. ___. SUBSTANCE USE DISORDER —— PERSONS COMMITTED 34 TO CORRECTIONAL INSTITUTIONS AND COUNTY JAILS —— OPIOID 35 -3- SF 562.2173 (1) 90 as/ns 3/ 16
SETTLEMENT. 1 1. a. There is appropriated from the opioid settlement 2 fund created in section 12.51 to the department of health and 3 human services, annually, an amount sufficient to implement 4 this section. 5 b. The department of health and human services shall 6 transfer the amount appropriated under this section to the 7 department of corrections for use in subsidizing the costs of 8 providing medication-assisted treatment to persons committed to 9 department of corrections institutions or county jails being 10 treated for opioid use disorder to purchase state-of-the-art 11 urine sample cups for use in the drug monitoring programs and 12 to fund efforts to fight hepatitis C, a potentially devastating 13 but curable disease spread through intravenous needle use of 14 opioids and other drugs in prison populations. If a county 15 is receiving opioid settlement funds to otherwise cover the 16 costs of medication-assisted treatment, the county shall match 17 the funding provided under this section on a dollar-for-dollar 18 basis. 19 2. If sufficient funds are not available through the 20 opioid settlement fund created in section 12.51, there is 21 appropriated from the Iowa coronavirus fiscal recovery fund 22 created in section 8.57G to the department of health and human 23 services for transfer to the department of corrections for the 24 fiscal year beginning July 1, 2023, and ending June 30, 2024, 25 an amount sufficient for the purposes designated under this 26 section. 27 3. Notwithstanding section 8.33, moneys appropriated in 28 this section that remain unencumbered or unobligated at the 29 close of the fiscal year shall not revert but shall remain 30 available for the purposes designated until expended. 31 Sec. ___. VETERANS COURTS —— OPIOID SETTLEMENT. 32 1. There is appropriated from the opioid settlement fund 33 created in section 12.51 to the department of veterans affairs 34 for the fiscal year beginning July 1, 2023, and ending June 30, 35 -4- SF 562.2173 (1) 90 as/ns 4/ 16
2024, the following amount, or so much thereof as is necessary, 1 for the purpose designated: 2 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 3 2. a. The moneys appropriated under this section shall 4 be transferred to the judicial branch to establish a veterans 5 court with a full-time outreach coordinator in each judicial 6 district to provide court services to veterans and to integrate 7 court sanctions and incentives with substance use disorder 8 treatment, mental health treatment, and transitional services 9 for veterans in a judicially supervised setting. 10 b. It is the intent of the general assembly that the 11 jurisdiction of the veterans court may be exercised by any 12 district judge and by any district associate judge who is 13 designated by the chief judge of a judicial district as a judge 14 of the veterans court. The chief judge shall designate one 15 or more district judges and district associate judges to act 16 as judges of the veterans court for a judicial district. The 17 chief judge may designate a veterans court judge to preside in 18 more than one county. 19 3. If sufficient funds are not available through the opioid 20 settlement fund created in section 12.51, there is appropriated 21 from the Iowa coronavirus fiscal recovery fund created in 22 section 8.57G for the fiscal year beginning July 1, 2023, and 23 ending June 30, 2024, to the department of veterans affairs for 24 transfer to the judicial branch an amount sufficient to provide 25 the total amount specified under subsection 1 for the purposes 26 designated under this section. 27 4. Notwithstanding section 8.33, moneys appropriated in 28 this section that remain unencumbered or unobligated at the 29 close of the fiscal year shall not revert but shall remain 30 available for the purposes designated until expended. 31 Sec. ___. STATE EMPLOYEE BENEFITS —— SUBSTANCE USE DISORDER 32 BENEFITS —— USE OF OPIOIDS —— OPIOID SETTLEMENT. 33 1. a. There is appropriated from the opioid settlement fund 34 created in section 12.51 to the department of administrative 35 -5- SF 562.2173 (1) 90 as/ns 5/ 16
services for the fiscal year beginning July 1, 2023, and ending 1 June 30, 2024, the following amount, or so much thereof as is 2 necessary, for the purposes designated: 3 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 4 b. The department of administrative services, in cooperation 5 with any health insurance plans or health plan administrators 6 of benefits extended to state employees, shall utilize the 7 funds appropriated in this subsection to create a model 8 benefit plan designed to incentivize or otherwise promote the 9 effective, evidence-based prescription and use of opioids to 10 members receiving benefits through state plans, document the 11 current use of benefits for substance use disorders, identify 12 gaps or unnecessary restrictions in coverage, and expand 13 access to evidence-based treatments and therapies, including 14 nonpharmacological treatments. 15 3. If sufficient funds are not available through the opioid 16 settlement fund created in section 12.51, there is appropriated 17 from the Iowa coronavirus fiscal recovery fund created in 18 section 8.57G to the department of administrative services 19 for the fiscal year beginning July 1, 2023, and ending June 20 30, 2024, an amount sufficient to provide the total amount 21 specified under subsection 1 for the purposes designated under 22 this section. 23 4. Notwithstanding section 8.33, moneys appropriated in 24 this section that remain unencumbered or unobligated at the 25 close of the fiscal year shall not revert but shall remain 26 available for the purposes designated until expended. 27 Sec. ___. MEDICAID RECIPIENTS —— SUBSTANCE USE DISORDER 28 BENEFITS —— USE OF OPIOIDS —— OPIOID SETTLEMENT. 29 1. a. There is appropriated from the opioid settlement fund 30 created in section 12.51 to the department of health and human 31 services for the fiscal year beginning July 1, 2023, and ending 32 June 30, 2024, the following amount, or so much thereof as is 33 necessary, for the purposes designated: 34 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 35 -6- SF 562.2173 (1) 90 as/ns 6/ 16
b. The department of health and human services, in 1 cooperation with Medicaid managed care organizations, shall 2 utilize the funds appropriated under this section to design 3 benefit plans to incentivize or otherwise promote the 4 effective, evidence-based prescription and use of opioids to 5 Medicaid recipients, document the current use of benefits 6 for substance use disorders, identify gaps or unnecessary 7 restrictions in coverage, and expand access to evidence-based 8 treatment and therapies, including nonpharmacological 9 treatments. The department shall seek any Medicaid state plan 10 amendment or waiver necessary to administer this subsection. 11 2. If sufficient funds are not available through the opioid 12 settlement fund created in section 12.51, there is appropriated 13 from the Iowa coronavirus fiscal recovery fund created in 14 section 8.57G to the department of health and human services 15 for the fiscal year beginning July 1, 2023, and ending June 16 30, 2024, an amount sufficient to provide the total amount 17 specified under subsection 1 for the purposes designated under 18 this section. 19 3. Notwithstanding section 8.33, moneys appropriated in 20 this section that remain unencumbered or unobligated at the 21 close of the fiscal year shall not revert but shall remain 22 available for the purposes designated until expended. 23 Sec. ___. SUBSTANCE USE DISORDER AND OPIOID USE RESEARCH AND 24 EDUCATION —— OPIOID SETTLEMENT. 25 1. There is appropriated from the opioid settlement fund 26 created in section 12.51 to the following entities for the 27 fiscal year beginning July 1, 2023, and ending June 30, 2024, 28 the following amounts, or so much thereof as is necessary, for 29 the purposes designated: 30 a. To the department of health and human services: 31 (1) To contract with the Iowa health care collaborative to 32 do all of the following: 33 (a) To develop and pilot protocols for the treatment 34 of emergency room patients experiencing opioid or heroin 35 -7- SF 562.2173 (1) 90 as/ns 7/ 16
overdoses, including the provision of peer counseling and 1 advocacy: 2 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 3 (b) To reduce opioid exposure by educating doctors and 4 hospitals, especially in rural areas, to adopt the enhanced 5 recovery after surgery (ERAS) principles: 6 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 7 (2) For the psychiatric residency programs involved 8 with coordinated, collaborative care at newly established, 9 community-based behavioral health treatment facilities offering 10 residential substance use disorder treatment for twenty-nine 11 days or more: 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 13 (3) To pilot the establishment and operation of three 14 community-based syringe service programs developed to provide 15 substance use prevention and response including linkages 16 to substance use disorder treatment; vaccination, testing, 17 and access to care for infectious diseases; and access to, 18 education regarding the safe utilization of, and proper 19 disposal of, fentanyl test strips, sterile syringes, and 20 injection equipment: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 450,000 22 The pilot program supported with the funding appropriated 23 under this subparagraph is conditioned on the implementation 24 of written agreements with local law enforcement agencies 25 and county attorneys to refrain from charging or prosecuting 26 program sponsors or participants for violations of section 27 124.414. 28 b. If sufficient funds are not available through the opioid 15 settlement fund created in section 12.51, there is appropriated 16 from the Iowa coronavirus fiscal recovery fund created in 17 section 8.57G to the entities specified in subsection 1, 18 for the fiscal year beginning July 1, 2023, and ending June 19 30, 2024, a sufficient amount to provide the total amounts 20 specified to the entities specified under subsection 1 for the 21 purposes designated under this section. 22 3. Notwithstanding section 8.33, moneys appropriated in 23 this section that remain unencumbered or unobligated at the 24 close of the fiscal year shall not revert but shall remain 25 available for the purposes designated until the close of the 26 succeeding fiscal year. 27 Sec. ___. PUBLIC HEALTH STRUCTURE AND INFRASTRUCTURE AND 28 SUBSTANCE USE DISORDER PREVENTION AND TREATMENT —— OPIOID 29 SETTLEMENT. 30 1. There is appropriated from the opioid settlement fund 31 created in section 12.51 to the university of Iowa college of 32 public health for the fiscal year beginning July 1, 2023, and 33 ending June 30, 2024, the following amounts, or so much thereof 34 as is necessary, for the purposes designated: 35 -9- SF 562.2173 (1) 90 as/ns 9/ 16
a. To conduct a comprehensive review and evaluation of 1 the existing public health structure and infrastructure in 2 Iowa, and to make recommendations for policy and funding to 3 improve capacity of the state and local communities to address 4 substance use and related issues: 5 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 250,000 6 b. To provide paid internships for college of public 17 health students paired with local health departments to 18 support the development of local public health infrastructure, 19 conduct community health needs assessments, and assist in 20 the successful implementation of health improvement plans to 21 address substance use disorders and co-occurring brain health 22 and related conditions: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 24 2. If sufficient funds are not available through the 25 opioid settlement fund created in section 12.51 to satisfy the 26 appropriations under subsection 1, there is appropriated from 27 the Iowa coronavirus fiscal recovery fund created in section 28 8.57G to the university of Iowa college of public health 29 for the fiscal year beginning July 1, 2023, and ending June 30 30, 2024, a sufficient amount to provide the total amounts 31 specified under subsection 1 for the purposes designated under 32 this section. 33 3. SUBSTANCE USE DISORDER —— RECOVERY HOUSING —— 4 SUPPORTIVE SERVICES —— OPIOID SETTLEMENT. 5 1. a. There is appropriated from the opioid settlement fund 6 created in section 12.51 to the department of health and human 7 services for the fiscal year beginning July 1, 2023, and ending 8 June 30, 2024, the following amount, or so much thereof as is 9 necessary, for the purpose designated: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,000,000 11 b. Moneys appropriated under this section shall be used 12 by the department, in collaboration with the Iowa finance 13 authority and community-based organizations, to engage in work 14 to increase the availability of recovery housing throughout the 15 state. The moneys shall be distributed as grants to recovery 16 housing providers whose application for assistance is in 17 accordance with a county community health needs assessment and 18 health improvement plan. If a county is otherwise receiving 19 opioid settlement funds, the county shall match the grant 20 funding provided under this section on a dollar-for-dollar 21 basis. 22 2. If sufficient funds are not available through the 23 opioid settlement fund created in section 12.51 to satisfy the 24 appropriations under subsection 1, there is appropriated from 25 the Iowa coronavirus fiscal recovery fund created in section 26 8.57G to the department of health and human services for the 27 fiscal year beginning July 1, 2023, and ending June 30, 2024, a 28 sufficient amount to provide the total amount specified under 29 subsection 1 for the purposes designated under this section. 30 3. Notwithstanding section 8.33, moneys appropriated in 31 this section that remain unencumbered or unobligated at the 32 close of the fiscal year shall not revert but shall remain 33 available for the purposes designated until the close of the 34 succeeding fiscal year. 35 -11- SF 562.2173 (1) 90 as/ns 11/ 16
Sec. ___. COMPREHENSIVE STUDY AND REPORT OF SUBSTANCE USE 1 DISORDER TREATMENT COVERAGE, UTILIZATION, AND EXPENDITURES —— 2 OPIOID SETTLEMENT. 3 1. a. There is appropriated from the opioid settlement 4 fund created in section 12.51 to the department of insurance 5 and financial services for the fiscal year beginning July 1, 6 2023, and ending June 30, 2024, the following amount, or so 7 much thereof as is necessary, for the purposes designated: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 9 b. The department of insurance and financial services shall 10 utilize the funds appropriated under this subsection to perform 11 a comprehensive study and prepare a comprehensive report on 12 insurance coverage and payment policies for services related 13 to the treatment of substance use disorders by commercial 14 insurance companies and self-funded plans, as well as data 15 on current utilization and expenditures associated with such 16 benefit plans. The report shall be submitted to the general 17 assembly by January 1, 2024. 18 2. If sufficient funds are not available through the opioid 19 settlement fund created in section 12.51, there is appropriated 20 from the Iowa coronavirus fiscal recovery fund created in 21 section 8.57G to the department of insurance and financial 22 services for the fiscal year beginning July 1, 2023, and ending 23 June 30, 2024, an amount sufficient to provide the total amount 24 specified under subsection 1 for the purposes designated under 25 this section. 26 3. Notwithstanding section 8.33, moneys appropriated in 27 this section that remain unencumbered or unobligated at the 28 close of the fiscal year shall not revert but shall remain 29 available for the purposes designated until the close of the 30 succeeding fiscal year. 31 Sec. ___. TASK FORCE ON AN INTEGRATED SYSTEM FOR PREVENTION, 32 TREATMENT, RECOVERY, AND RESOURCES —— APPROPRIATIONS. 33 1. a. The director of health and human services 34 shall convene a task force to research and develop policy 35 -12- SF 562.2173 (1) 90 as/ns 12/ 16
recommendations to implement an integrated behavioral health 1 and substance use disorder system and services structure that 2 blends funding in the areas of prevention, treatment, recovery, 3 and resources. 4 b. The task force shall include the director of health 5 and human services, appropriate departmental personnel, two 6 representatives of each mental health and disability services 7 region appointed by the region, and three experts each 8 representing the fields of prevention, treatment, and recovery 9 selected by the department based on recommendations from the 10 mental health and disability services region chief executive 11 officers. 12 c. The task force shall submit a report to the governor 13 and the general assembly by June 30, 2024, including 14 recommendations that address all of the following: 15 (1) Prevention policy, including measures to ensure 16 consistent and sustained funding for prevention activities, 17 enhanced early intervention techniques, and a plan for 18 well-rounded prevention programs that address alcohol, 19 methamphetamine, opioid use, and co-occurring disorders. 20 (2) Treatment policy, built on the premise that 21 co-occurring issues are the norm rather than the exception, 22 and includes methods to deliver services through integrated 23 care models that regulate team-based care or close coordination 24 between providers, use of dual treatment planning methods, 25 standards for counselors to attain and practice with dual 26 certification, licensure solutions for dual programs and 27 practitioners, and effective treatment modalities for 28 short-term and long-term outcomes. 29 (3) Recovery policy, including practices to integrate 30 co-occurring approaches in mobile crisis response and other 31 crisis services, implementation of harm reduction practices, 32 integration of feasible medication strategies to support 33 mental health issues in alignment with substance use disorder 34 recovery, and incentive programs to support recovery efforts. 35 -13- SF 562.2173 (1) 90 as/ns 13/ 16
(4) Resource deployment policy including all of the 1 following: 2 (a) The combining and leveraging of state, regional, 3 and local partnerships to optimize opioid settlement funds 4 available to the state and counties. 5 (b) Allocation of federal substance abuse and mental health 6 services administration block grants for substance abuse 7 prevention and treatment and community mental health services. 8 (c) Other related federal government and private funding 9 opportunities. 10 (5) Provisions for peer support workers consistent with 11 the guidance of the federal substance abuse and mental health 12 services administration’s bringing recovery supports to scale 13 technical assistance center strategy. 14 (6) Opportunities through the alignment of the department 15 of health and human services to integrate the fragmented 16 behavioral health and substance use disorder services systems 17 into a system of comprehensive, whole-person care, that 18 utilizes public funding more efficiently and increases the 19 return on investment through enhanced community health for all 20 Iowans. 21 2. There is appropriated from the opioid settlement fund 22 created in section 12.51 to the department of health and 23 human services, for task force support for the fiscal year 24 beginning July 1, 2023, and ending June 30, 2024, the following 25 amount, or so much thereof as is necessary, for the purposes 26 designated: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 150,000 28 The task force shall approve any contract for external 29 assistance to the task force. 30 3. a. For dollar-for-dollar matching grants to mental health 2 and disability services regions to be used for long-term 3 residential treatment and recovery services for persons 4 diagnosed with one or more disorders including a substance use 5 disorder in accordance with the recommendations of the task 6 force convened under this section. 7 c. Notwithstanding section 8.33, moneys appropriated in 8 this subsection that remain unencumbered or unobligated at the 9 close of the fiscal year shall not revert but shall remain 10 available for the purposes designated until expended. 11 Sec. ___. IOWA FINANCE AUTHORITY —— TRANSITIONAL HOUSING 12 FOR ELIGIBLE SERVICE MEMBERS. There is appropriated from the 13 opioid settlement fund established in section 12.51 to the 14 Iowa finance authority for the fiscal year beginning July 1, 15 2023, and ending June 30, 2024, the following amount, or so 16 much thereof as is necessary, to be used for the purposes 17 designated: 18 To provide grants, low-interest loans, and loan guarantees 19 to veteran-led nonprofit organizations: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,300,000 21 1. Amounts appropriated pursuant to this section shall be 22 distributed to veteran-led nonprofit organizations provided 23 that the organization meets all of the following conditions: 24 a. The funds will be used to purchase land, construct 25 housing, or furnish housing for the purpose of providing 26 transitional housing to homeless veterans. 27 b. The veterans receiving transitional housing benefits 28 pursuant to paragraph “a” are suffering from or are at risk of 29 opioid or other substance abuse disorder, post-traumatic stress 30 disorder, or another mental illness or life disruption as the 31 Iowa finance authority, in consultation with the department 32 of health and human services and the department of veterans 33 affairs, deems appropriate. 34 c.
