Section 452A.41, subsection 3, as enacted by 16 2019 Iowa Acts, chapter 151, section 24, is amended to read as 17 follows: 18 3. The department shall adopt rules governing the 19 dispensing of electric fuel by licensed dealers and users. The 20 director may require by rule that reports and returns be filed 21 by electronic transmission. The department may require by rule 22 that all charging stations located at dealer and user locations 23 through which electric fuel can be dispensed be tested for 24 accuracy. 25 Sec. ___. Section 452A.41, as enacted by 2019 Iowa Acts, 26 chapter 151, section 24, is amended by adding the following new 27 subsection: 28 NEW SUBSECTION . 3A. a. The department of agriculture 29 and land stewardship shall provide for a biennial inspection 30 of each charging station through which electric fuel can be 31 dispensed, if the charging station is owned by a licensed 32 electric fuel dealer or licensed electric fuel user. dispensed. For that purpose, the department of agriculture and 1 land stewardship may enter upon the premises where the charging 2 station is located or upon the premises where equipment 3 directly related to the accuracy or correctness of the charging 4 station is located. The department of agriculture and land 5 stewardship shall determine the accuracy and correctness of the 6 charging station by using standards adopted by the national 7 conference on weights and measures and published in the 8 national institute of standards and technology, handbook 44, 9 referred to as “specifications, tolerances, and other technical 10 requirements for weighing and measuring devices”. 11 b. The department of agriculture and land stewardship 12 shall deliver a notice to the department of revenue of any 13 inspected, noncompliant charging station owned by a licensed 14 electric fuel dealer or licensed electric fuel user, stating 15 that the charging station did not comply with the department of 16 agriculture and land stewardship’s inspection requirements. 17 c. The department of agriculture and land stewardship 18 may adopt rules pursuant to chapter 17A to administer the 19 department of agriculture and land stewardship’s duties under 20 this subsection. > 21 5.
