HOUSING RENEWAL PILOT PROGRAM. 21 1. For purposes of this section, “nonprofit Iowa affiliate” 22 means a nonprofit Iowa affiliate of a nonprofit international 23 organization whose primary activity is the promotion of the 24 construction, remodeling, or rehabilitation of one-family or 25 two-family dwellings for use by low-income families. 26 2. a. A housing renewal program fund is created in the 27 state treasury under the control of the Iowa finance authority. 28 The fund shall consist of moneys appropriated to or deposited 29 in the fund. Moneys in the fund are appropriated to the Iowa 30 finance authority to establish and administer a housing renewal 31 pilot program. 32 b. For the fiscal year beginning July 1, 2022, and ending 33 June 30, 2023, there is appropriated from the general fund of 34 the state to the Iowa finance authority five hundred thousand 35 -1- HF 725.2161 (1) 90 ko/ns 1/ 5 #1. #2. #3. #4. #5. #6. #7.
dollars for deposit in the housing renewal program fund. 1 c. Notwithstanding section 8.33, moneys in the fund 2 that remain unencumbered or unobligated at the close of the 3 fiscal year shall not revert but shall remain available for 4 expenditure for the purposes designated until the close of the 5 succeeding fiscal year. 6 c. d. Notwithstanding section 12C.7, subsection 2 , 7 interest or earnings on moneys in the housing renewal program 8 fund shall be credited to the fund. Payment of interest, 9 recaptures of grant financial assistance awards, and other 10 repayments under the housing renewal pilot program shall be 11 deposited in the fund. 12 3. a. The Iowa finance authority shall provide moneys 13 from the housing renewal program fund to a nonprofit Iowa 14 affiliate that shall use the moneys to award grants financial 15 assistance under the housing renewal pilot program to eligible 16 participants. 17 b. Eligible participants under paragraph “a” shall use 18 a grant financial assistance awarded under the housing 19 renewal pilot program only for purposes of the acquisition, 20 rehabilitation, and resale of ownership units; the acquisition 21 and demolition of blighted structures; and the redevelopment 22 of ownership units. 23 4. Twenty-five percent of moneys appropriated to the 24 housing renewal program fund shall be allocated to rural 25 communities financial assistance awards for eligible 26 participants located in the eighty-eight least populated 27 counties in the state. 28 5. a. The nonprofit Iowa affiliate may partner with a city, 29 a county, a consortium of local governments, or an organization 30 exempt from taxation pursuant to section 501(c)(3) of the 31 Internal Revenue Code ; however, the shall select the eligible 32 participants to be awarded financial assistance. Eligible 33 participants include cities, counties, consortiums of local 34 governments, or organizations exempt from taxation pursuant to 35 -2- HF 725.2161 (1) 90 ko/ns 2/ 5
section 501(c)(3) of the Internal Revenue Code. The nonprofit 1 Iowa affiliate shall determine the geographic location of all 2 projects for which a grant financial assistance is awarded. 3 b. The nonprofit Iowa affiliate shall not award a grantee 4 an eligible participant more than one hundred thousand dollars 5 per ownership unit. A grantee The nonprofit Iowa affiliate 6 may use up to five percent of a grant the moneys appropriated 7 in subsection 2, paragraph “b”, for administration expenses 8 related to the grantee’s project housing renewal pilot program . 9 c. (1) A grantee An eligible participant shall have a 10 maximum of thirty-six months from the date a contract is 11 executed between the nonprofit Iowa affiliate and the grantee 12 eligible participant for the grantee’s eligible participant to 13 complete the eligible participant’s project. A grantee An eligible participant shall sell each 30 completed ownership unit to a homebuyer whose income is under 31 the one hundred twenty percent area median income and who must 32 occupy the ownership unit as the homebuyer’s primary residence. 33 The deed to the ownership unit must contain a restrictive 34 resale requirement that prohibits the homebuyer or a subsequent 35 -3- HF 725.2161 (1) 90 ko/ns 3/ 5
owner from selling the ownership unit to a person with an 1 income above the one hundred twenty percent area median income 2 for five calendar years from the date the grantee eligible 3 participant sold the ownership unit to the first homebuyer 4 whose income is under the one hundred twenty percent area 5 median income. 6 6. A grantee may use income generated from the sale of 7 an ownership unit The net profit received by an eligible 8 participant from the sale of a completed ownership unit to a 9 homebuyer under subsection 5, paragraph “d”, shall be remitted 10 to the nonprofit Iowa affiliate. The nonprofit Iowa affiliate 11 shall use the net profit received only for the purpose of 12 additional eligible expenses awarding financial assistance to 13 eligible participants under the housing renewal pilot program. 14 7. The Iowa finance authority shall not use more than five 15 percent of moneys allocated appropriated to the housing renewal 16 program fund for administration and oversight of the housing 17 renewal pilot program. 18 8. The Iowa finance authority shall adopt rules pursuant to 19 chapter 17A to administer this division. 20 9. 8. The Iowa finance authority, in coordination with the 21 nonprofit Iowa affiliate, shall submit a report to the general 22 assembly on or before December 31, 2023 2024 , describing the 23 community, economic, and financial impact of the housing 24 renewal pilot program. 25 9. This section is repealed July 1, 2025. 26 DIVISION ___ 27 REGIONAL INDUSTRY SECTOR PARTNERSHIPS —— RULES 28 Sec. ___. Section 260H.7B, Code 2023, as amended by 2023 29 Iowa Acts, Senate File 514, section 2195, is amended by adding 30 the following new subsection: 31 NEW SUBSECTION . 3.
