Section 710A.1, subsection 3, paragraphs a and b, 4 Code 2023, are amended to read as follows: 5 a. Causing or implicitly or explicitly threatening to cause 6 serious physical injury to any person. 7 b. Physically restraining or implicitly or explicitly 8 threatening to physically restrain another person. 9 Sec. ___. Section 710A.1, subsection 4, paragraph a, Code 10 2023, is amended by adding the following new subparagraph: 11 NEW SUBPARAGRAPH . (3) Removal of organs through the use of 12 coercion or intimidation. 13 Sec. ___. Section 710A.1, subsection 5, Code 2023, is 14 amended to read as follows: 15 5. “Involuntary servitude” means a condition of servitude 16 induced by means of any scheme, plan, or pattern intended to 17 cause a person to believe that if the person did not enter 18 into or continue in such condition, that person or another 19 person would suffer serious harm or physical restraint or the 20 threatened abuse of legal process. 21 Sec. ___. Section 710A.2, subsections 2, 3, 4, 5, 6, 7, and 22 8, Code 2023, are amended to read as follows: 23 2. A person who knowingly engages in human trafficking 24 by causing or implicitly or explicitly threatening to cause 25 serious physical injury to another person is guilty of a class 26 “C” felony, except that if the victim is under the age of 27 eighteen, the person is guilty of a class “B” felony. 28 3. A person who knowingly engages in human trafficking by 29 physically restraining or implicitly or explicitly threatening 30 to physically restrain another person is guilty of a class 31 “D” “C” felony, except that if the victim is under the age of 32 eighteen, the person is guilty of a class “C” “B” felony. 33 4. is guilty of a class “D” “C” felony, except that if the victim 1 is under the age of eighteen, the person is guilty of a class 2 “C” “B” felony. 3 5. A person who knowingly engages in human trafficking by 4 abusing or threatening to abuse the law or legal process is 5 guilty of a class “D” “C” felony, except that if the victim is 6 under the age of eighteen, the person is guilty of a class “C” 7 “B” felony. 8 6. A person who knowingly engages in human trafficking by 9 knowingly destroying, concealing, removing, confiscating, or 10 possessing any actual or purported government identification of 11 another person is guilty of a class “D” “C” felony, except if 12 that other person is under the age of eighteen, the person is 13 guilty of a class “C” “B” felony. 14 7. A person who benefits financially or by receiving 15 anything of value from knowing participation in human 16 trafficking is guilty of a class “D” “C” felony, except that if 17 the victim is under the age of eighteen, the person is guilty 18 of a class “C” “B” felony. 19 8. A person who knowingly engages in human trafficking 20 by knowingly providing or facilitating the provision of a 21 forged, altered, or fraudulent license purportedly issued 22 pursuant to chapter 152C or 157 , or a forged, altered, or 23 fraudulent government identification to another person, to 24 force, coerce, entice, assist, facilitate, or permit the other 25 person to perform labor or services is guilty of an aggravated 26 misdemeanor a class “C” felony , except if that other person is 27 under the age of eighteen, the person is guilty of a class “D” 28 “B” felony. 29 Sec. ___. Section 710A.2, Code 2023, is amended by adding 30 the following new subsection: 31 NEW SUBSECTION . 12. Consent of the victim is not a defense 32 to a violation of this section. > 33 2.
