Section 92.1, Code 2023, is amended to read as 4 follows: 5 92.1 Street occupations —— migratory Migratory labor. 6 1. No person under ten years of age shall be employed or 7 permitted to work with or without compensation at any time 8 within this state in street occupations of peddling, shoe 9 polishing, the distribution or sale of newspapers, magazines, 10 periodicals or circulars, nor in any other occupations in any 11 street or public place. The labor commissioner shall, when 12 ordered by a judge of the juvenile court, issue a work permit 13 as provided in this chapter to a person under ten years of age. 14 2. No person under twelve years of age shall be employed 15 or permitted to work with or without compensation at any time 16 within this state in connection with migratory labor , except 17 that the labor commissioner may upon sufficient showing by a 18 judge of the juvenile court, issue a work permit as provided in 19 this chapter to a person under twelve years of age . 20 Sec. ___. Section 92.2, Code 2023, is amended to read as 21 follows: 22 92.2 Over ten eleven and under sixteen years of age. 23 1. A person over ten eleven and under sixteen years of age 24 cannot be employed, with or without compensation, in street 25 occupations or migratory labor as provided in section 92.1 , 26 unless the person holds a work permit issued pursuant to this 27 chapter . 28 a. 2. Notwithstanding section 92.7 , a person with a permit 29 to engage in migratory labor shall only work between 5:00 a.m. 30 and 7:30 p.m. from Labor Day through June 1, and between 5:00 31 a.m. and 9:00 p.m. for the remainder of the year. 32 b. Notwithstanding section 92.7 , a person with a permit 33 to engage in street occupations shall only work between 4:00 34 a.m. and 7:30 p.m. when local public schools are in session and 35 -1- SF 542.1970 (3) 90 je/rn 1/ 3 #1.
between 4:00 a.m. and 8:30 p.m. for the remainder of the year. 1 2. The requirements of section 92.10 shall not apply to 2 a person, firm, or corporation employing a person engaged in 3 street occupations pursuant to this section . > 4 2. If the student will be working in an apprenticeship, 10 the apprenticeship is registered with the United States 11 department of labor, office of apprenticeship, and the student 12 will be employed in accordance with the standards established 13 by that department. > 14 4. Page 9, after line 29 by inserting: 15 < Sec. ___. Section 92.10, subsection 1, Code 2023, is 16 amended to read as follows: 17 1. Except as provided in section 92.2 , a A person under 18 sixteen years of age shall not be employed or permitted to 19 work with or without compensation unless the person, firm, or 20 corporation employing such person receives and keeps on file 21 accessible to any officer charged with the enforcement of this 22 chapter , a work permit issued as provided in this chapter , and 23 keeps a complete list of the names and ages of all such persons 24 under sixteen years of age employed. > 25 5. By striking page 10, line 35, through page 11, line 1, 26 and inserting < chapter, to determine occupations for which work 27 permits are required, and to issue general and special orders 28 prohibiting > 29 6. Page 13, by striking lines 20 and 21 and inserting: 30 < Sec. ___. REPEAL. Section 92.9, Code 2023, is > 31 7.
