Page 1, by striking lines 9 through 19 and inserting: 4 < b. If the commissioner of insurance determines that all or 5 part of a policy or a policy form violates paragraph “a” , the 6 commissioner shall provide notice to the carrier. The notice 7 shall do all of the following: 8 (1) Specify any provisions of the policy or the policy form 9 that do not comply with this subsection, or that do not comply 10 with the rules adopted by the division pursuant to chapter 17A 11 to implement and administer this subsection. 12 (2) Provide the specific reasons for the commissioner’s 13 disapproval of the policy or the policy form. 14 c. A carrier shall have twenty days after receipt of a 15 notice under paragraph “b” to request a hearing to contest 16 the commissioner’s notice. The hearing shall be conducted 17 pursuant to chapter 17A. If the hearing results in a decision 18 that affirms the commissioner’s notice, the decision shall 19 be provided to the carrier in writing and shall specify the 20 reasons for the commissioner’s decision. After receipt of the 21 commissioner’s decision, it shall be unlawful for the carrier 22 to issue a policy that contains the provisions specified in 23 the decision, or to continue to enforce any policy provisions 24 specified in the decision. 25 d. If within twenty days of receipt of a notice under 26 paragraph “b” a carrier fails to request a hearing to contest 27 the commissioner’s notice, it shall be unlawful for the carrier 28 to issue a policy that contains the provisions specified in 29 the notice, or to continue to enforce any policy provisions 30 specified in the notice. > 31 3.
