a. From the moneys deposited in the school ready children 1 grants account for the fiscal year beginning July 1, 2022, and 2 ending June 30, 2023, not more than $265,950 is allocated for 3 the early childhood Iowa office and other technical assistance 4 activities. Moneys allocated under this lettered paragraph 5 may be used by the early childhood Iowa state board for the 6 purpose of skills development and support for ongoing training 7 of staff. However, except as otherwise provided in this 8 subsection, moneys shall not be used for additional staff or 9 for the reimbursement of staff. 10 b. Of the amount appropriated in this subsection for 11 deposit in the school ready children grants account of the 12 early childhood Iowa fund, $2,318,018 shall be used for efforts 13 to improve the quality of early care, health, and education 14 programs. Moneys allocated pursuant to this lettered paragraph 15 may be used for additional staff and for the reimbursement 16 of staff. The early childhood Iowa state board may reserve 17 a portion of the allocation, not to exceed $88,650, for the 18 technical assistance expenses of the early childhood Iowa 19 state office, including the reimbursement of staff, and 20 shall distribute the remainder to early childhood Iowa areas 21 for local quality improvement efforts through a methodology 22 identified by the early childhood Iowa state board to make the 23 most productive use of the funding, which may include use of 24 the distribution formula, grants, or other means. 25 c. Of the amount appropriated in this subsection for 26 deposit in the school ready children grants account of 27 the early childhood Iowa fund, $825,030 shall be used for 28 support of professional development and training activities 29 for persons working in early care, health, and education by 30 the early childhood Iowa state board in collaboration with 31 the professional development component groups maintained by 32 the early childhood Iowa stakeholders alliance pursuant to 33 section 256I.12, subsection 7, paragraph “b”, and the early 34 childhood Iowa area boards. professional development and training activities agreed upon by 1 the parties participating in the collaboration as approved by 2 the early childhood Iowa state board. 3 d. Of the amount appropriated in this subsection for deposit 4 in the school ready children grants account of the early 5 childhood Iowa fund, $200,000 shall be used to invest in this 6 state’s early childhood database system that integrates state 7 administrative data to provide results that inform and improve 8 the early childhood system of programs and services in this 9 state. 10 9. BIRTH TO AGE THREE SERVICES 11 a. For expansion of the federal Individuals with 12 Disabilities Education Improvement Act of 2004, Pub. L. The department may charge school districts and accredited 18 nonpublic schools a fee for the system not to exceed the actual 19 costs to purchase a statewide license for the early warning 20 assessment minus the moneys received by the department under 21 this subsection. The fee shall be determined by dividing the 22 actual remaining costs to purchase the statewide license for 23 the school year by the number of pupils assessed under the 24 system in the current fiscal year. School districts may use 25 moneys received pursuant to section 257.10, subsection 11, and 26 moneys received for purposes of implementing section 279.68, 27 subsection 2, to pay the early warning assessment system fee. 28 21. IOWA READING RESEARCH CENTER 29 a. For purposes of the Iowa reading research center in 30 order to implement, in collaboration with the area education 31 agencies, the provisions of section 256.9, subsection 49, 32 paragraph “c”: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 600,000 34 b. than $250,000 shall be used for collaborations with the state 1 board of education relating to the approval of practitioner 2 preparation programs pursuant to section 256.7, subsection 3, 3 paragraph “c”, and with the board of educational examiners for 4 the establishment and continuing oversight of the advanced 5 dyslexia specialist endorsement pursuant to section 272.2, 6 subsection 23. For the fiscal year beginning July 1, 2022, and 7 ending June 30, 2023, the center shall submit a report to the 8 general assembly and the legislative services agency detailing 9 the expenditures of moneys used for purposes of this paragraph 10 “b”. 11 c. available for expenditure for the purposes specified in this 1 section for the following fiscal year. 2 DIVISION IV 3 APPROPRIATIONS —— STANDING LIMITED 4 Sec. 13. Section 261.25, subsections 1 and 2, Code 2022, are 5 amended to read as follows: 6 1. There is appropriated from the general fund of the state 7 to the commission for each fiscal year the sum of forty-eight 8 million eight hundred ninety-six thousand fifty fifty million 9 one hundred eighteen thousand four hundred fifty-one dollars 10 for tuition grants to qualified students who are enrolled in 11 accredited private institutions. 12 2. There is appropriated from the general fund of the state 13 to the commission for each fiscal year the sum of four five 14 hundred fifty-six thousand two hundred twenty thousand dollars 15 for tuition grants for qualified students who are enrolled 16 in eligible institutions. Of the moneys appropriated under 17 this subsection , not more than one hundred thousand dollars 18 annually shall be used for tuition grants to qualified students 19 who are attending an eligible institution under section 261.9, 20 subsection 3 , paragraph “b” . 21 DIVISION V 22 STATE PROGRAM ALLOCATION 23 Sec. 14. Section 284.13, subsection 1, paragraphs a, b, c, 24 e, f, and g, Code 2022, are amended to read as follows: 25 a. For the fiscal year beginning July 1, 2021 2022 , and 26 ending June 30, 2022 2023 , to the department, the amount of 27 five hundred eight thousand two hundred fifty dollars for the 28 issuance of national board certification awards in accordance 29 with section 256.44 . Of the amount allocated under this 30 paragraph, not less than eighty-five thousand dollars shall 31 be used to administer the ambassador to education position in 32 accordance with section 256.45 . 33 b. For the fiscal year beginning July 1, 2021 2022 , and 34 ending June 30, 2022 2023 , up to seven hundred twenty-eight 35 -25- HF 2575.4528 (2) 89 jda/tm 25/ 31
thousand two hundred sixteen dollars to the department for 1 purposes of implementing the professional development program 2 requirements of section 284.6 , assistance in developing model 3 evidence for teacher quality committees established pursuant to 4 section 284.4, subsection 1 , paragraph “b” , and the evaluator 5 training program in section 284.10 . A portion of the funds 6 allocated to the department for purposes of this paragraph may 7 be used by the department for administrative purposes and for 8 not more than four full-time equivalent positions. 9 c. For the fiscal year beginning July 1, 2021 2022 , 10 and ending June 30, 2022 2023 , an amount up to one million 11 seventy-seven thousand eight hundred ten dollars to the 12 department for the establishment of teacher development 13 academies in accordance with section 284.6, subsection 10 . A 14 portion of the funds allocated to the department for purposes 15 of this paragraph may be used for administrative purposes. 16 e. For the fiscal year beginning July 1, 2021 2022 , and 17 ending June 30, 2022 2023 , to the department an amount up to 18 twenty-five thousand dollars for purposes of the fine arts 19 beginning teacher mentoring program established under section 20 256.34 . 21 f. For the fiscal year beginning July 1, 2021 2022 , and 22 ending June 30, 2022 2023 , to the department an amount up 23 to six hundred twenty-six thousand one hundred ninety-one 24 dollars shall be used by the department for a delivery system, 25 in collaboration with area education agencies, to assist in 26 implementing the career paths and leadership roles considered 27 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 28 not limited to planning grants to school districts and area 29 education agencies, technical assistance for the department, 30 technical assistance for districts and area education agencies, 31 training and staff development, and the contracting of external 32 expertise and services. In using moneys allocated for purposes 33 of this paragraph, the department shall give priority to school 34 districts with certified enrollments of fewer than six hundred 35 -26- HF 2575.4528 (2) 89 jda/tm 26/ 31
students. A portion of the moneys allocated annually to the 1 department for purposes of this paragraph may be used by the 2 department for administrative purposes and for not more than 3 five full-time equivalent positions. 4 g. For the fiscal year beginning July 1, 2022 2023 , and 5 for each subsequent fiscal year, to the department, ten 6 million dollars for purposes of implementing the supplemental 7 assistance for high-need schools provisions of section 284.11 . 8 Annually, of the moneys allocated to the department for 9 purposes of this paragraph, up to one hundred thousand dollars 10 may be used by the department for administrative purposes and 11 for not more than one full-time equivalent position. 12 DIVISION VI 13 PROGRAMS FOR AT-RISK CHILDREN 14 Sec. 15. Section 279.51, Code 2022, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 3A. Notwithstanding section 8.33, moneys 17 appropriated in this section that remain unencumbered or 18 unobligated at the close of the fiscal year shall not revert 19 but shall remain available for expenditure for the purposes 20 designated. 21 Sec. 16. EFFECTIVE DATE. This division of this Act, being 22 deemed of immediate importance, takes effect upon enactment. 23 DIVISION VII 24 IOWA GEOLOGICAL SURVEY 25 Sec. 17. Section 456.5A, subsection 2, Code 2022, is amended 26 to read as follows: 27 2. Not later than January 10, 2022, and not later than 28 January 10 of each subsequent five-year period, the state 29 geologist shall publish a new long-range budget plan for 30 the next planning period. The long-range budget plan 31 shall describe how moneys appropriated, expected to the 32 be appropriated, or otherwise available or expected to be 33 available to the Iowa geological survey for each fiscal year 34 of that planning period are to be expended in a manner that 35 -27- HF 2575.4528 (2) 89 jda/tm 27/ 31
best allows the Iowa geological survey to exercise its powers 1 and carry out its duties or functions. The long-range budget 2 plan shall include any performance goals and measures required 3 by law or established by the state geologist. The state 4 geologist shall annually evaluate the Iowa geological survey’s 5 progress in attaining those performance goals and shall revise 6 the long-term budget plan as the state geologist determines 7 necessary or desirable. 8 DIVISION VIII 9 THERAPEUTIC CLASSROOM INCENTIVE GRANT PROGRAM —— APPLICATIONS 10 Sec. 18. Section 256.25, subsection 3, Code 2022, is amended 11 to read as follows: 12 3. The department shall develop a grant application 13 and selection and evaluation criteria. Selection criteria 14 shall include a method for prioritizing grant applications 15 submitted by school districts located in mental health and 16 disability services regions providing children’s behavioral 17 health services in accordance with chapter 331, subchapter 18 III, part 6 , with those proposing to serve the most students 19 given highest priority . First priority shall be given to 20 applications submitted by school districts that submitted 21 an application pursuant to this section for the previous 22 fiscal year. Second priority shall be given to applications 23 submitted by school districts that, pursuant to subsection 24 2, are collaborating and partnering with one or more school 25 districts, area education agencies, accredited nonpublic 26 schools, nonprofit agencies, or institutions that provide 27 mental health services for children. Third priority shall be 28 given to applications submitted by school districts located 29 in mental health and disability services regions providing 30 behavioral health services for children in accordance with 31 chapter 331, subchapter III, part 6. Grant awards shall be 32 distributed as equitably as possible among small, medium, and 33 large school districts. For purposes of this subsection , a 34 small school district is a district with an actual enrollment 35 -28- HF 2575.4528 (2) 89 jda/tm 28/ 31
of fewer than six hundred pupils; a medium school district is a 1 district with an actual enrollment that is at least six hundred 2 pupils, but less than two thousand five hundred pupils; and a 3 large school district is a district with an actual enrollment 4 of two thousand five hundred or more pupils. 5 Sec. 19. APPLICABILITY. This division of this Act applies 6 to grant applications submitted pursuant to section 256.25 on 7 or after July 1, 2022. 8 DIVISION IX 9 CHARTER SCHOOL FUNDING 10 Sec. 20. Section 256E.8, subsection 2, paragraphs a, b, and 11 c, Code 2022, are amended to read as follows: 12 a. The school district of residence shall pay to the 13 charter school in which the student is enrolled in the manner 14 required under section 282.18 , and pursuant to the timeline in 15 section 282.20, subsection 3 , shall receive under paragraph 16 “c” an amount equal to the sum of the state cost per pupil 17 for the previous school year plus the teacher leadership 18 supplement state cost per pupil for the previous fiscal year 19 as provided in section 257.9 plus any moneys received by the 20 school district of residence for the student as a result of the 21 non-English speaking weighting under section 280.4, subsection 22 3 , for the previous school year multiplied by the state cost 23 per pupil for the previous year. If a student is an eligible 24 pupil under section 261E.6 , the charter school shall pay the 25 tuition reimbursement amount to an eligible postsecondary 26 institution as provided in section 261E.7 . 27 b. For a student requiring special education, the school 28 district of residence shall pay to the charter school , pursuant 29 to the timeline in section 282.20, subsection 3, the actual 30 costs incurred in providing the appropriate special education. 31 c. For each student enrolled in the charter school who 32 was not included in the actual enrollment of the district of 33 residence under section 257.6, subsection 1 , in the previous 34 school year, the The amount otherwise required to be paid to 35 -29- HF 2575.4528 (2) 89 jda/tm 29/ 31
the charter school under paragraph “a” or “b” shall instead be 1 paid by the department to the charter school for during the 2 student’s initial year of enrollment school year for which the 3 student is enrolled in the charter school. The amount paid 4 to the charter school under this paragraph shall result in an 5 equal reduction to the school district of residence’s state aid 6 payment amount under chapter 257 for the school budget year 7 following the school year for which the payment to the charter 8 school is made, so long as the student was counted in the 9 district of residence’s actual enrollment in the school year 10 for which the student attended the charter school. 11 Sec. 21. Section 256E.8, subsection 4, Code 2022, is amended 12 to read as follows: 13 4. If necessary, and pursuant to rules adopted by the state 14 board, funding amounts required under this section for the 15 first school year of a new charter school shall be based on 16 enrollment estimates for the charter school included in the 17 charter school contract. The department shall adopt rules to 18 establish a process for determining estimated enrollments for 19 charter school funding purposes in school years after the first 20 school year of a charter school. Initial amounts Amounts paid 21 using estimated enrollments shall be reconciled during the 22 subsequent payment payments based on actual enrollment of the 23 charter school during the first each school year. 24 Sec. 22. EMERGENCY RULES. The department of education may 25 adopt emergency rules under section 17A.4, subsection 3, and 26 section 17A.5, subsection 2, paragraph “b”, to implement the 27 provisions of this division of this Act and the rules shall 28 be effective immediately upon filing unless a later date is 29 specified in the rules. Any rules adopted in accordance with 30 this section shall also be published as a notice of intended 31 action as provided in section 17A.4. 32 Sec. 23. EFFECTIVE DATE.
