of high-priority watersheds identified by the water resources 1 coordinating council. 2 (b) The moneys appropriated in this lettered paragraph 3 shall be used to support demonstration projects in watersheds 4 generally, including regional watersheds, as designated by the 5 division and high-priority watersheds identified by the water 6 resources coordinating council. 7 (3) In supporting projects in watersheds and subwatersheds 8 as provided in subparagraph (2), all of the following shall 9 apply: 10 (a) The demonstration projects shall utilize water quality 11 practices as described in the latest revision of the document 12 entitled “Iowa Nutrient Reduction Strategy” initially presented 13 in November 2012 by the department of agriculture and land 14 stewardship, the department of natural resources, and Iowa 15 state university of science and technology. 16 (b) The division shall implement demonstration projects 17 as provided in subparagraph division (a) by providing 18 for participation by persons who hold a legal interest in 19 agricultural land used in farming. To every extent practical, 20 the division shall provide for collaborative participation by 21 such persons who hold a legal interest in agricultural land 22 located within the same subwatershed. 23 (c) The division shall implement demonstration projects on 24 a cost-share basis as determined by the division. Except for 25 edge-of-field practices, the state’s share of the amount shall 26 not exceed 50 percent of the estimated cost of establishing the 27 practice as determined by the division or 50 percent of the 28 actual cost of establishing the practice, whichever is less. 29 (d) The demonstration projects shall be used to educate 30 other persons about the feasibility and value of establishing 31 similar water quality practices. The division shall promote 32 field day events for purposes of allowing interested persons to 33 establish water quality practices on their agricultural land. 34 (e) The division shall conduct water quality evaluations 35 -2- HF 2579.4518 (2) 89 ec/tm 2/ 26
within supported subwatersheds. Within a reasonable period 1 after accumulating information from such evaluations, the 2 division shall create an aggregated database of water quality 3 practices. Any information identifying a person holding a 4 legal interest in agricultural land or specific agricultural 5 land shall be a confidential record. 6 (4) The moneys appropriated in this lettered paragraph 7 shall be used to support education and outreach in a manner 8 that encourages persons who hold a legal interest in 9 agricultural land used for farming to implement water quality 10 practices, including the establishment of such practices in 11 watersheds generally, and not limited to subwatersheds or 12 high-priority watersheds. 13 (5) The moneys appropriated in this lettered paragraph 14 may be used to contract with persons to coordinate the 15 implementation of efforts provided in this paragraph. 16 (6) The moneys appropriated in this lettered paragraph 17 may be used by the department to support urban soil and water 18 conservation efforts, which may include but are not limited 19 to management practices related to bioretention, landscaping, 20 the use of permeable or pervious pavement, and soil quality 21 restoration. The moneys shall be allocated on a cost-share 22 basis as provided in chapter 161A . 23 (7) Notwithstanding any other provision of law to the 24 contrary, the department may use moneys appropriated in 25 this lettered paragraph to carry out the provisions of this 26 paragraph on a cost-share basis in combination with other 27 moneys available to the department from a state or federal 28 source. 29 (8) Not more than 10 percent of the moneys appropriated in 30 this lettered paragraph may be used for costs of administration 31 and implementation of the water quality initiative administered 32 by the soil conservation division. 33 b. EFFECTIVE DATE. This division of this Act, being 29 deemed of immediate importance, takes effect upon enactment. 30 DIVISION IV 31 MISCELLANEOUS PROVISIONS 32 Sec. 13. Section 8.57C, subsection 3, paragraph a, 33 subparagraph (3), Code 2022, is amended to read as follows: 34 (3) For the fiscal year beginning July 1, 2022 2023 , and for 35 -17- HF 2579.4518 (2) 89 ec/tm 17/ 26
each subsequent fiscal year thereafter, the sum of seventeen 1 million five hundred thousand dollars. 2 Sec. 14. Section 8.57C, subsection 3, Code 2022, is amended 3 by adding the following new paragraph: 4 NEW PARAGRAPH . j. There is appropriated from the rebuild 5 Iowa infrastructure fund for the fiscal year beginning July 1, 6 2022, and ending June 30, 2023, the sum of twenty million five 7 hundred thousand dollars to the technology reinvestment fund, 8 notwithstanding section 8.57, subsection 5, paragraph “c” . 9 Sec. 15. Section 15.261, Code 2022, is amended to read as 10 follows: 11 15.261 Vacant state buildings demolition fund. 12 1. A vacant state buildings demolition fund is created in 13 the state treasury under the control of the authority. The 14 fund shall consist of all moneys appropriated to the fund. 15 2. Moneys in the vacant state buildings demolition fund 16 are appropriated to the authority for purposes of funding a 17 grant program for the demolition of vacant buildings owned by 18 the state or by a county that has purchased real property from 19 the federal government which are no longer used for a state or 20 federal purpose. Grant program criteria shall provide that 21 no more than fifty percent of the cost of a project for the 22 demolition of vacant buildings shall be funded from a grant 23 under the program. The authority shall give preference to 24 applicants that have not previously been awarded money from 25 this fund. 26 3. Notwithstanding section 12C.7, subsection 2 , interest 27 or earnings on moneys deposited in the vacant state buildings 28 demolition fund shall be credited to the vacant state buildings 29 demolition fund. Notwithstanding section 8.33 , moneys credited 30 to the vacant state buildings demolition fund shall not revert 31 at the close of a fiscal year. 32 Sec. 16. Section 15.262, Code 2022, is amended to read as 33 follows: 34 15.262 Vacant state buildings rehabilitation fund. 35 -18- HF 2579.4518 (2) 89 ec/tm 18/ 26
1. A vacant state buildings rehabilitation fund is created 1 in the state treasury under the control of the authority. The 2 fund shall consist of all moneys appropriated to the fund. 3 2. Moneys in the vacant state buildings rehabilitation fund 4 are appropriated to the authority for purposes of funding a 5 loan program for the rehabilitation or redevelopment of vacant 6 buildings owned by the state or by a county that has purchased 7 real property from the federal government which are no longer 8 used for a state or federal purpose. The authority shall give 9 preference to applicants that have not previously been awarded 10 money from this fund. 11 3. Notwithstanding section 12C.7, subsection 2 , interest 12 or earnings on moneys deposited in the vacant state buildings 13 rehabilitation fund shall be credited to the vacant state 14 buildings rehabilitation fund. Notwithstanding section 8.33 , 15 moneys credited to the vacant state buildings rehabilitation 16 fund shall not revert at the close of a fiscal year. 17 Sec. 17. Section 159A.16, subsection 3, Code 2022, is 18 amended to read as follows: 19 3. Moneys in the renewable fuel infrastructure fund are 20 appropriated to the department exclusively to support and 21 market the renewable fuel infrastructure programs as provided 22 in sections 159A.14 and 159A.15 , and as allocated in financial 23 incentives by the renewable fuel infrastructure board created 24 in section 159A.13 . Up to fifty 25 a. For each fiscal year, not more than one million 26 two hundred fifty thousand dollars shall be allocated to 27 support the renewable fuel infrastructure program for retail 28 motor fuel sites as provided in section 159A.14 to finance 29 the installation, replacement, or conversion of biodiesel 30 infrastructure as provided in that section. 31 b. For each fiscal year, not more than one hundred thousand 32 dollars shall be allocated each fiscal year to the department 33 to support the administration of the programs. The 34 c. For each fiscal year, the department may use up to 35 -19- HF 2579.4518 (2) 89 ec/tm 19/ 26
three quarters of one and one-half percent of the program 1 funds to market the programs. Otherwise the moneys shall not 2 be transferred, used, obligated, appropriated, or otherwise 3 encumbered except to allocate as financial incentives under the 4 programs. 5 Sec. 18. Section 602.11101, subsection 1, paragraph e, 6 subparagraph (2), Code 2022, is amended to read as follows: 7 (2) Until July 1, 1986, the county shall remain responsible 8 for the compensation of and operating costs for court 9 employees not presently designated for state financing and 10 for miscellaneous costs of the judicial branch related to 11 furnishings, supplies, and equipment purchased, leased, or 12 maintained for the use of judicial officers, referees, and 13 their staff. Effective July 1, 1986, the state shall assume 14 the responsibility for the compensation of and operating costs 15 for court employees presently designated for state financing 16 and for miscellaneous costs of the judicial branch related to 17 furnishings, supplies, and equipment purchased, leased, or 18 maintained for the use of judicial officers, referees, and 19 their staff. However, the county shall at all times remain 20 responsible for the provision of suitable courtrooms, offices, 21 and other physical facilities pursuant to section 602.1303, 22 subsection 1 , including paint, wall covering, and fixtures in 23 the facilities. In addition, however, effective July 1, 2023, 24 if a county expends moneys for the renovation or construction 25 of suitable courtrooms, offices, and other physical facilities 26 pursuant to section 602.1303, that requires the purchase of 27 furnishings, supplies, and equipment for the use of judicial 28 officers, referees, and their staff as a result of that 29 renovation or construction, the state shall be responsible for 30 only seventy-five percent of the cost of the purchase. 31 Sec. 19. DES MOINES AREA REGIONAL TRANSIT AUTHORITY 32 ALTERNATIVE FUNDING ADVISORY COMMITTEE —— REPORT. 33 1. The department of transportation shall establish a Des 34 Moines area regional transit authority alternative funding 35 -20- HF 2579.4518 (2) 89 ec/tm 20/ 26
advisory committee to study the most effective and efficient 1 methods to increase funding for the Des Moines area regional 2 transit authority that are alternative to an increase in 3 property taxes. 4 2. The committee shall consist of five voting members and 5 four ex officio, nonvoting members. 6 a. The voting members of the committee shall be composed of 7 all of the following: 8 (1) The director of the department of transportation or a 9 designee. 10 (2) The director of the department of revenue or a designee. 11 (3) A Polk county supervisor appointed by the governor. 12 (4) A member of a city council or mayor of a city in Polk 13 county in which the Des Moines area regional transit authority 14 operates, appointed by the governor. 15 (5) A representative of the Des Moines area regional transit 16 authority appointed by the Des Moines area regional transit 17 authority. 18 b. The ex officio, nonvoting members of the committee shall 19 be two state representatives, one appointed by the speaker of 20 the house of representatives and one by the minority leader 21 of the house of representatives, and two state senators, one 22 appointed by the majority leader of the senate and one by the 23 minority leader of the senate. 24 3. Staffing services shall be provided by the department of 25 transportation in coordination with the department of revenue. 26 4. The committee shall submit a report containing its 27 findings and recommendations to the general assembly on or 28 before December 15, 2022. 29 5. This section is repealed January 1, 2023. 30 Sec. 20. EFFECTIVE DATE. The following, being deemed of 31 immediate importance, take effect upon enactment: 32 The sections of this division of this Act amending sections 33 15.261 and 15.262. 34 Sec. 21. retroactively to June 1, 2020: 1 The sections of this division of this Act amending sections 2 15.261 and 15.262. 3 DIVISION V 4 SPORTS TOURISM PROGRAM 5 Sec. 22. Section 15F.401, subsection 1, paragraph a, Code 6 2022, is amended to read as follows: 7 a. The authority shall establish, and, at the direction 8 of the board, shall administer a sports tourism marketing and 9 infrastructure program to provide financial assistance for 10 projects that promote sporting events or for infrastructure 11 projects supporting sporting events for organizations of 12 accredited colleges and universities, professional sporting 13 events, and other sporting events in the state. 14 Sec. 23. Section 15F.401, subsection 2, paragraph a, Code 15 2022, is amended to read as follows: 16 a. (1) A city or county in the state or a public entity, 17 including a convention and visitors bureau or a district, may 18 apply to the authority for financial assistance from the sports 19 tourism marketing program fund created in section 15F.403 for 20 a project that actively and directly promotes sporting events 21 for accredited colleges and universities, professional sporting 22 events, and other sporting events in the area served by the 23 city, county, or public entity. 24 (2) A city or county in the state or a public entity, 25 including a convention and visitors bureau or a district, 26 may apply to the authority for financial assistance from the 27 sports tourism infrastructure program fund created in section 28 15F.404 for an infrastructure project that actively and 29 directly supports sporting events for accredited colleges and 30 universities, professional sporting events, and other sporting 31 events in the area served by the city, county, or public 32 entity. 33 Sec. 24. Section 15F.401, subsections 5 and 6, Code 2022, 34 are amended to read as follows: 35 -22- HF 2579.4518 (2) 89 ec/tm 22/ 26
5. The board shall make final funding decisions on 1 each application and may approve, deny, defer, or modify 2 applications for financial assistance under the sports tourism 3 marketing and infrastructure program, in its discretion, in 4 order to fund as many projects with the moneys available as 5 possible. The board and the authority may negotiate with 6 applicants regarding the details of projects and the amount and 7 terms of any award. The total amount of financial assistance 8 provided to an applicant from the sports tourism marketing 9 program fund created in section 15F.403 in any one fiscal year 10 shall not exceed five hundred thousand dollars. In making 11 final funding decisions pursuant to this subsection , the board 12 and the authority are exempt from chapter 17A . 13 6. a. A city, county, or public entity may use financial 14 assistance received under the program from the sports tourism 15 marketing fund created in section 15F.403 for marketing and 16 promotions. Whether an activity or individual cost item is 17 directly related to the promotion of the sporting event shall 18 be within the discretion of the authority. 19 b. All applications to the authority for financial 20 assistance from the sports tourism marketing fund created in 21 section 15F.403 shall be made at least ninety days prior to an 22 event’s scheduled date. 23 c. A city, county, or public entity shall not use financial 24 assistance received under the program from the sports tourism 25 marketing fund created in section 15F.403 or the sports tourism 26 infrastructure fund created in section 15F.404 as reimbursement 27 for completed projects. 28 Sec. 25. Section 15F.402, subsections 1 and 2, Code 2022, 29 are amended to read as follows: 30 1. Applications for assistance under the sports tourism 31 marketing and infrastructure program established in section 32 15F.401 shall be submitted to the authority. For those 33 applications that meet the eligibility criteria, the authority 34 shall forward the applications to the board and provide a staff 35 -23- HF 2579.4518 (2) 89 ec/tm 23/ 26
review analysis and evaluation to the sports tourism program 1 review committee referred to in subsection 2 and to the board. 2 2. A review committee composed of five members of the 3 board shall review sports tourism marketing and infrastructure 4 program applications forwarded to the board and make 5 recommendations regarding the applications to the authority. 6 The review committee shall consist of members of the board, 7 with one member from each congressional district under section 8 15F.102, subsection 2 , paragraph “a” , and one member from the 9 state at large under section 15F.102, subsection 2 , paragraph 10 “b” . 11 Sec. 26. Section 15F.403, subsection 1, paragraph a, Code 12 2022, is amended to read as follows: 13 a. The authority shall establish a fund pursuant to 14 section 15.106A, subsection 1 , paragraph “o” , for purposes of 15 financing sports tourism marketing projects as described in 16 this subchapter . The fund established for purposes of this 17 section may be administered as a revolving fund and may consist 18 of any moneys appropriated by the general assembly for purposes 19 of this section . 20 Sec. 27. Section 15F.403, subsection 2, paragraph a, Code 21 2022, is amended to read as follows: 22 a. Moneys in the fund are appropriated to the authority for 23 purposes of providing financial assistance to cities, counties, 24 and public entities under the sports tourism marketing program 25 established and administered pursuant to this subchapter . 26 Sec. 28. NEW SECTION . 15F.404 Sports tourism infrastructure 27 program fund. 28 1. a. The authority shall establish a fund pursuant to 29 section 15.106A, subsection 1, paragraph “o” , for purposes of 30 financing sports tourism infrastructure projects as described 31 in this subchapter. The fund established for purposes of this 32 section may be administered as a revolving fund and may consist 33 of any moneys appropriated by the general assembly for purposes 34 of this section. 35 -24- HF 2579.4518 (2) 89 ec/tm 24/ 26
b. Notwithstanding section 8.33, moneys in a fund 1 established for purposes of this section at the end of each 2 fiscal year shall not revert to any other fund but shall remain 3 in the fund for expenditure for subsequent fiscal years. 4 c. Notwithstanding section 12C.7, subsection 2, interest or 5 earnings on moneys in the fund shall be credited to the fund. 6 2. a. Moneys in the fund are appropriated to the 7 authority for purposes of providing financial assistance 8 to cities, counties, and public entities under the sports 9 tourism marketing and infrastructure program established and 10 administered pursuant to this subchapter. 11 b. The board in its discretion shall allocate the available 12 moneys in the fund among the programs described in paragraph “a” 13 in the amounts determined by the board. 14 c. The authority may use not more than five percent of the 15 moneys in the fund at the beginning of each fiscal year for 16 purposes of administrative costs, technical assistance, and 17 other program support. 18 Sec. 29. SPORTS TOURISM MARKETING PROGRAM —— SPORTS 19 WAGERING RECEIPTS FUND.
