NEW SECTION . 335.2A Sale of consumer fireworks 4 —— limitation. 5 A county shall not adopt or enforce any ordinance under 6 this chapter to regulate, restrict, or prohibit the location 7 of permanent buildings or temporary structures used for the 8 sale of consumer fireworks pursuant to section 100.19, in any 9 location zoned for commercial or industrial purposes. 10 Sec. ___. Section 414.1, subsection 1, Code 2022, is amended 11 by adding the following new paragraph: 12 NEW PARAGRAPH . f. A city shall not adopt or enforce any 13 regulation or restriction under this chapter to regulate, 14 restrict, or prohibit the location of permanent buildings or 15 temporary structures used for the sale of consumer fireworks 16 pursuant to section 100.19, in any location zoned for 17 commercial or industrial purposes. > 18 2. Page 1, line 20, by striking < section 570A.1 > and 19 inserting < section 570A.1, except when such requirement 20 prevents the identification of an eligible and willing 21 appointee for the planning and zoning commission or board of 22 adjustment for at least six months from the effective date of 23 the extension of zoning jurisdiction. The failure to identify 24 an eligible and willing appointee who owns land that is 25 actively used for an agricultural purpose shall be determined 26 independently for the planning and zoning commission and the 27 board of adjustment > 28 3.
