Senate File 2131 S-5085 Amend the amendment, S-5080, to Senate File 2131, as 1 follows: 2 1. Page 2, line 35, by striking < thirty-nine twenty-six > and 3 inserting < thirty-nine > 4 2. Page 6, after line 4 by inserting: 5 < Sec. ___. Section 96.5, subsection 3, paragraph b, Code 6 2022, is amended by adding the following new subparagraphs: 7 NEW SUBPARAGRAPH . (4) (a) If the individual has a 8 reasonable expectation that the individual will be returning 9 to employment, as defined by the department by rule, and 10 is attached to a regular job or industry or is a member in 11 good standing of a union therein eligible for referral for 12 employment. 13 (b) To be considered attached to a regular job or industry, 14 an individual must be on a short-term seasonal temporary layoff 15 as defined by the department by rule. 16 NEW SUBPARAGRAPH . (5) If all of the following circumstances 17 apply: 18 (a) The individual is unemployed due to the individual’s 19 employer temporarily ceasing operations or going out of 20 business at the factory, establishment, or other premises at 21 which the individual was last employed. 22 (b) The reason for the employer going out of business was a 23 result of unforeseen circumstances, including but not limited 24 to cybersecurity attacks. 25 (c) The individual has a reasonable expectation that the 26 individual will be returning to employment with the employer 27 that temporarily ceased operations or went out of business. > 28 3.
