NEW SECTION . 8.57G Iowa coronavirus fiscal 5 recovery fund. 6 1. An Iowa coronavirus fiscal recovery fund is created in 7 the state treasury under the authority of the office of the 8 governor. The fund shall be separate from the general fund of 9 the state and the balance in the fund shall not be considered 10 part of the balance of the general fund of the state. The 11 fund shall consist of moneys received by the state from the 12 coronavirus state fiscal recovery fund pursuant to the American 13 Rescue Plan Act of 2021, Pub. L. No. 117-2, and any other 14 moneys appropriated to or deposited in the fund. 15 2. Moneys in the fund are appropriated to the office of 16 the governor to be used, expended, granted, or transferred as 17 determined by the governor for any of the following purposes: 18 a. To respond to the public health emergency with respect to 19 COVID-19 or its negative economic impacts, including assistance 20 to households, small businesses, and nonprofits, or aid to 21 impacted industries such as tourism, travel, and hospitality. 22 b. To respond to workers performing essential work during 23 the COVID–19 public health emergency by providing premium pay 24 to eligible workers of the state that are performing such 25 essential work, or by providing grants to eligible employers 26 that have eligible workers who perform essential work. 27 c. For the provision of government services to the extent 28 of the reduction in state revenue due to the COVID–19 public 29 health emergency relative to revenues collected in the fiscal 30 year beginning July 1, 2018. 31 d. To make necessary investments in water, sewer, or 32 broadband infrastructure. 33 3. Except as provided in section 8.58, the fund shall be 34 considered a special account for the purposes of section 8.53 35 -1- SF 614.2407 (2) 89 amending this SF 614 to CONFORM to HF 895 ns/tm 1/ 4 #1.

in determining the cash position of the general fund of the 1 state for the payment of state obligations. Notwithstanding 2 section 8.33, moneys in the fund that remain unencumbered or 3 unobligated at the close of a fiscal year shall not revert 4 but shall remain available for expenditure for the purposes 5 designated. Notwithstanding section 12C.7, subsection 2, 6 interest or earnings on moneys in the fund shall be credited 7 to the fund. 8 4. This section is repealed July 1, 2025. 9 Sec. ___. NEW SECTION . 8.57H Iowa coronavirus capital 10 projects fund. 11 1. An Iowa coronavirus capital projects fund is created in 12 the state treasury under the authority of the office of the 13 governor. The fund shall be separate from the general fund of 14 the state and the balance in the fund shall not be considered 15 part of the balance of the general fund of the state. The 16 fund shall consist of moneys received by the state from the 17 coronavirus capital projects fund pursuant to the American 18 Rescue Plan Act of 2021, Pub. L. No. 117-2, and any other 19 moneys appropriated to or deposited in the fund. 20 2. Moneys in the fund are appropriated to the office of 21 the governor to be used, expended, granted, or transferred 22 as determined by the governor to carry out critical capital 23 projects directly enabling work, education, and health 24 monitoring, including remote options, in response to the public 25 health emergency with respect to COVID–19. 26 3. Except as provided in section 8.58, the fund shall be 27 considered a special account for the purposes of section 8.53 28 in determining the cash position of the general fund of the 29 state for the payment of state obligations. Notwithstanding 30 section 8.33, moneys in the fund that remain unencumbered or 31 unobligated at the close of a fiscal year shall not revert 32 but shall remain available for expenditure for the purposes 33 designated. to the fund. 1 4. This section is repealed July 1, 2025. 2 Sec. ___. Section 8.58, Code 2021, is amended to read as 3 follows: 4 8.58 Exemption from automatic application. 5 1. To the extent that moneys appropriated under section 6 8.57 do not result in moneys being credited to the general fund 7 under section 8.55, subsection 2 , moneys appropriated under 8 section 8.57 and moneys contained in the cash reserve fund, 9 rebuild Iowa infrastructure fund, environment first fund, Iowa 10 economic emergency fund, taxpayer relief fund, and state bond 11 repayment fund , Iowa coronavirus fiscal recovery fund, and 12 Iowa coronavirus capital projects fund shall not be considered 13 in the application of any formula, index, or other statutory 14 triggering mechanism which would affect appropriations, 15 payments, or taxation rates, contrary provisions of the Code 16 notwithstanding. 17 2. To the extent that moneys appropriated under section 18 8.57 do not result in moneys being credited to the general fund 19 under section 8.55, subsection 2 , moneys appropriated under 20 section 8.57 and moneys contained in the cash reserve fund, 21 rebuild Iowa infrastructure fund, environment first fund, Iowa 22 economic emergency fund, taxpayer relief fund, and state bond 23 repayment fund , Iowa coronavirus fiscal recovery fund, and Iowa 24 coronavirus capital projects fund shall not be considered by an 25 arbitrator or in negotiations under chapter 20 . 26 Sec. ___. FEDERAL CORONAVIRUS RELIEF MONEYS —— 27 REPORTING. Whenever data is required to be transmitted by the 28 department of management to the office of inspector general 29 of the United States department of the treasury pursuant 30 to reporting requirements associated with the receipt of 31 coronavirus relief fund moneys issued under the Coronavirus 32 Aid, Relief, and Economic Security Act, Pub. L. No. 116—136, 33 as amended by the Consolidated Appropriations Act, 2021, Pub. 34 L. No. 116-260, or coronavirus state fiscal recovery fund 35 -3- SF 614.2407 (2) 89 amending this SF 614 to CONFORM to HF 895 ns/tm 3/ 4

moneys or coronavirus capital projects fund moneys issued under 1 the American Rescue Plan Act of 2021, Pub. L. No. 117-2, the 2 department of management shall also transmit the data to the 3 legislative services agency. 4 Sec. ___. REPEAL. The section of this division of this Act 5 amending section 8.58 is repealed July 1, 2025. 6 Sec. ___. EFFECTIVE DATE. This division of this Act, being 7 deemed of immediate importance, takes effect upon enactment. > 8 2.
