Notwithstanding section 261.132, subsection 5, there is 21 transferred from the future ready Iowa skilled workforce grant 22 fund created pursuant to section 261.132, subsection 5, to the 23 future ready Iowa skilled workforce last-dollar scholarship 24 fund created pursuant to section 261.131, subsection 5, any 25 moneys remaining unencumbered and unobligated on the effective 26 date of this Act. 27 2. Moneys allocated under this lettered paragraph 16 may be used by the early childhood Iowa state board for the 17 purpose of skills development and support for ongoing training 18 of staff. However, except as otherwise provided in this 19 subsection, moneys shall not be used for additional staff or 20 for the reimbursement of staff. 21 b. Of the amount appropriated in this subsection for 22 deposit in the school ready children grants account of the 23 early childhood Iowa fund, $2,318,018 shall be used for efforts 24 to improve the quality of early care, health, and education 25 programs. Moneys allocated pursuant to this paragraph may be 26 used for additional staff and for the reimbursement of staff. 27 The early childhood Iowa state board may reserve a portion 28 of the allocation, not to exceed $88,650, for the technical 29 assistance expenses of the early childhood Iowa state office, 30 including the reimbursement of staff, and shall distribute 31 the remainder to early childhood Iowa areas for local quality 32 improvement efforts through a methodology identified by the 33 early childhood Iowa state board to make the most productive 34 use of the funding, which may include use of the distribution 35 -6- HF 868.2550 (1) 89 kh/tm 6/ 43
formula, grants, or other means. 1 c. Of the amount appropriated in this subsection for 2 deposit in the school ready children grants account of 3 the early childhood Iowa fund, $825,030 shall be used for 4 support of professional development and training activities 5 for persons working in early care, health, and education by 6 the early childhood Iowa state board in collaboration with 7 the professional development component groups maintained by 8 the early childhood Iowa stakeholders alliance pursuant to 9 section 256I.12, subsection 7, paragraph “b”, and the early 10 childhood Iowa area boards. Expenditures shall be limited to 11 professional development and training activities agreed upon by 12 the parties participating in the collaboration as approved by 13 the early childhood Iowa state board. 14 9. BIRTH TO AGE THREE SERVICES 15 a. For expansion of the federal Individuals with 16 Disabilities Education Improvement Act of 2004, Pub. L. The department may charge school districts and accredited 19 nonpublic schools a fee for the system not to exceed the actual 20 costs to purchase a statewide license for the early warning 21 assessment minus the moneys received by the department under 22 this subsection. The fee shall be determined by dividing the 23 actual remaining costs to purchase the statewide license for 24 the school year by the number of pupils assessed under the 25 system in the current fiscal year. School districts may use 26 moneys received pursuant to section 257.10, subsection 11, and 27 moneys received for purposes of implementing section 279.68, 28 subsection 2, to pay the early warning assessment system fee. 29 21. IOWA READING RESEARCH CENTER 30 a. an existing statewide not-for-profit health care organization 1 that currently provides grief and loss services to children. 2 For the fiscal year beginning July 1, 2021, and ending June 30, 3 2022, the health care organization receiving moneys pursuant to 4 this paragraph shall prepare a report, in collaboration with 5 the department of education, detailing the expenditures of 6 moneys used for the purposes of this program and its outcomes, 7 which shall be submitted to the general assembly by September 8 30, 2022. 9 c. Section 257.11, subsection 5, paragraph a, 28 subparagraph (1), Code 2021, is amended to read as follows: 29 (1) In order to provide additional funding to increase 30 student opportunities and redirect more resources to student 31 programming for school districts that share operational 32 functions, a district that shares with a political subdivision 33 one or more operational functions of a curriculum director, 34 master social worker, independent social worker, mental 35 -22- HF 868.2550 (1) 89 kh/tm 22/ 43
health professional who holds a statement of recognition 1 issued by the board of education examiners, or school 2 counselor, or one or more operational functions in the areas 3 of superintendent management, business management, human 4 resources, transportation, or operation and maintenance for at 5 least twenty percent of the school year shall be assigned a 6 supplementary weighting for each shared operational function. 7 A school district that shares an operational function in 8 the area of superintendent management shall be assigned a 9 supplementary weighting of eight pupils for the function. A 10 school district that shares an operational function in the area 11 of business management, human resources, transportation, or 12 operation and maintenance shall be assigned a supplementary 13 weighting of five pupils for the function. A school district 14 that shares the operational functions of a curriculum 15 director , ; a master social worker or an independent social 16 worker licensed under chapters 147 and 154C , ; a mental health 17 professional who holds a statement of recognition issued by 18 the board of education examiners; or a school counselor shall 19 be assigned a supplementary weighting of three pupils for 20 the function. The additional weighting shall be assigned 21 for each discrete operational function shared. However, a 22 school district may receive the additional weighting under this 23 subsection for sharing the services of an individual with a 24 political subdivision even if the type of operational function 25 performed by the individual for the school district and the 26 type of operational function performed by the individual 27 for the political subdivision are not the same operational 28 function, so long as both operational functions are eligible 29 for weighting under this subsection . In such case, the school 30 district shall be assigned the additional weighting for the 31 type of operational function that the individual performs for 32 the school district, and the school district shall not receive 33 additional weighting for any other function performed by the 34 individual. The operational function sharing arrangement does 35 -23- HF 868.2550 (1) 89 kh/tm 23/ 43
not need to be a newly implemented sharing arrangement to 1 receive supplementary weighting under this subsection . 2 Sec. 16. Section 261.25, subsections 1 and 2, Code 2021, are 3 amended to read as follows: 4 1. There is appropriated from the general fund of the state 5 to the commission for each fiscal year the sum of forty-seven 6 forty-eight million seven eight hundred three ninety-six 7 thousand four hundred sixty-three fifty dollars for tuition 8 grants to qualified students who are enrolled in accredited 9 private institutions. 10 2. There is appropriated from the general fund of the state 11 to the commission for each fiscal year the sum of four hundred 12 twenty-six fifty-six thousand two hundred twenty dollars for 13 tuition grants for qualified students who are enrolled in 14 eligible institutions. Of the moneys appropriated under this 15 subsection , not more than eighty one hundred thousand dollars 16 annually shall be used for tuition grants to qualified students 17 who are attending an eligible institution under section 261.9, 18 subsection 3 , paragraph “b” . 19 Sec. 17. Section 261.87, subsection 1, paragraph d, 20 subparagraphs (1), (2), (3), and (4), Code 2021, are amended 21 to read as follows: 22 (1) Is the child or stepchild of a peace officer, as 23 defined in section 97A.1 , who was killed in the line of duty 24 as determined by the board of trustees of the Iowa department 25 of public safety peace officers’ retirement, accident, and 26 disability system in accordance with section 97A.6, subsection 27 16 . 28 (2) Is the child or stepchild of a police officer or a fire 29 fighter, as each is defined in section 411.1 , who was killed in 30 the line of duty as determined by the statewide fire and police 31 retirement system in accordance with section 411.6, subsection 32 15 . 33 (3) Is the child or stepchild of a sheriff or deputy sheriff 34 as each is defined in section 97B.49C , who was killed in 35 -24- HF 868.2550 (1) 89 kh/tm 24/ 43
the line of duty as determined by the Iowa public employees’ 1 retirement system in accordance with section 97B.52, subsection 2 2 . 3 (4) Is the child or stepchild of a fire fighter or police 4 officer included under section 97B.49B , who was killed in 5 the line of duty as determined by the Iowa public employees’ 6 retirement system in accordance with section 97B.52, subsection 7 2 . 8 Sec. 18. Section 261.87, subsection 1, paragraph d, Code 9 2021, is amended by adding the following new subparagraph: 10 NEW SUBPARAGRAPH . (5) Is the child or stepchild of an 11 employee of the Iowa department of corrections, or of a 12 judicial district department of correctional services, who was 13 killed in the line of duty. 14 Sec. 19. Section 261.87, subsection 1, Code 2021, is amended 15 by adding the following new paragraph: 16 NEW PARAGRAPH . i. “Stepchild” means the same as defined in 17 section 450.l. 18 Sec. 20. Section 261.132, Code 2021, is amended by adding 19 the following new subsection: 20 NEW SUBSECTION . 6. New awards prohibited. For the fiscal 21 year beginning July 1, 2021, and each succeeding fiscal year, 22 the commission shall not award a future ready Iowa skilled 23 workforce grant to any new applicant, but may award a future 24 ready Iowa skilled workforce grant to an applicant who received 25 a grant awarded under the program in the fiscal year beginning 26 July 1, 2020, and who continues to meet the eligibility 27 requirements of this section. 28 Sec. 21. Section 284.13, subsection 1, paragraphs a, b, c, 29 e, f, and g, Code 2021, are amended to read as follows: 30 a. For the fiscal year beginning July 1, 2019 2021 , and 31 ending June 30, 2020 2022 , to the department, the amount of 32 five hundred eight thousand two hundred fifty dollars for the 33 issuance of national board certification awards in accordance 34 with section 256.44 . Of the amount allocated under this 35 -25- HF 868.2550 (1) 89 kh/tm 25/ 43
paragraph, not less than eighty-five thousand dollars shall 1 be used to administer the ambassador to education position in 2 accordance with section 256.45 . 3 b. For the fiscal year beginning July 1, 2019 2021 , and 4 ending June 30, 2020 2022 , up to seven hundred twenty-eight 5 thousand two hundred sixteen dollars to the department for 6 purposes of implementing the professional development program 7 requirements of section 284.6 , assistance in developing model 8 evidence for teacher quality committees established pursuant to 9 section 284.4, subsection 1 , paragraph “b” , and the evaluator 10 training program in section 284.10 . A portion of the funds 11 allocated to the department for purposes of this paragraph may 12 be used by the department for administrative purposes and for 13 not more than four full-time equivalent positions. 14 c. For the fiscal year beginning July 1, 2019 2021 , 15 and ending June 30, 2020 2022 , an amount up to one million 16 seventy-seven thousand eight hundred ten dollars to the 17 department for the establishment of teacher development 18 academies in accordance with section 284.6, subsection 10 . A 19 portion of the funds allocated to the department for purposes 20 of this paragraph may be used for administrative purposes. 21 e. For the fiscal year beginning July 1, 2019 2021 , and 22 ending June 30, 2020 2022 , to the department an amount up to 23 twenty-five thousand dollars for purposes of the fine arts 24 beginning teacher mentoring program established under section 25 256.34 . 26 f. For the fiscal year beginning July 1, 2019 2021 , and 27 ending June 30, 2020 2022 , to the department an amount up 28 to six hundred twenty-six thousand one hundred ninety-one 29 dollars shall be used by the department for a delivery system, 30 in collaboration with area education agencies, to assist in 31 implementing the career paths and leadership roles considered 32 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 33 not limited to planning grants to school districts and area 34 education agencies, technical assistance for the department, 35 -26- HF 868.2550 (1) 89 kh/tm 26/ 43
technical assistance for districts and area education agencies, 1 training and staff development, and the contracting of external 2 expertise and services. In using moneys allocated for purposes 3 of this paragraph, the department shall give priority to school 4 districts with certified enrollments of fewer than six hundred 5 students. A portion of the moneys allocated annually to the 6 department for purposes of this paragraph may be used by the 7 department for administrative purposes and for not more than 8 five full-time equivalent positions. 9 g. For the fiscal year beginning July 1, 2020 2022 , and 10 for each subsequent fiscal year, to the department, ten 11 million dollars for purposes of implementing the supplemental 12 assistance for high-need schools provisions of section 284.11 . 13 Annually, of the moneys allocated to the department for 14 purposes of this paragraph, up to one hundred thousand dollars 15 may be used by the department for administrative purposes and 16 for not more than one full-time equivalent position. 17 Sec. 22. TASK FORCE ON GROWING A DIVERSE PREK-12 TEACHER 18 BASE IN IOWA. 19 1. The director of the department of education, in 20 consultation with Iowa jobs for America’s graduates, shall 21 convene a task force on growing a diverse prekindergarten 22 through grade twelve teacher base in Iowa. 23 2. The director of the department of education or the 24 director’s designee shall serve as the chairperson of the task 25 force. The department of education shall provide staffing 26 services for the task force. 27 3. The task force shall, at a minimum, consist of the 28 following members: 29 a. Representatives from public and private institutions of 30 higher education engaged in practitioner preparation. 31 b. Representatives from state agencies engaged in 32 practitioner preparation and licensure. 33 c. Representatives from area education agencies and 34 school districts, including but not limited to teachers, 35 -27- HF 868.2550 (1) 89 kh/tm 27/ 43
administrators, and counselors, particularly those involved in 1 competency-based education. 2 d. Representatives from apprenticeship programs and 3 workforce development organizations. 4 e. Representatives from organizations that provide direct 5 student support leading to graduation and career pathways or 6 that provide remedial academic and career support outside the 7 traditional classroom or school day. 8 f. Representatives from community-based organizations that 9 have demonstrated expertise and effectiveness in the field of 10 workforce development. 11 g. Persons representing current teachers, administrators, 12 and school board members. 13 4. The task force shall do all of the following: 14 a. Develop a framework that expands opportunities for 15 a more diverse teacher workforce and establishes a unique 16 teacher career pathway for participants to achieve a bachelor’s 17 degree and teacher licensure while engaged meaningfully in the 18 education system. 19 b. Demonstrate how the proposed pathway maintains a 20 high-quality standard of learning and teacher preparation for 21 all participants. 22 c. Recommend methods to attract, engage, and retain a high 23 number of participants to make up a diverse teacher workforce 24 that reflects the growing diverse population of students across 25 Iowa, both rural and urban. 26 d. Recommend a pilot or experimental opportunity for a 27 finite group of participants during the 2022-2023 school year 28 that may be developed within an organization such as Iowa jobs 29 for America’s graduates. 30 5. The task force shall submit a report regarding 31 its findings and recommendations, including any proposed 32 legislative or administrative rule changes, to the governor, 33 the general assembly, and the state board of education by 34 December 15, 2021. 35 -28- HF 868.2550 (1) 89 kh/tm 28/ 43
Sec. 23. INTERIM STUDY COMMITTEE —— REGENTS UNIVERSITIES. 1 1. The legislative council is requested to establish an 2 interim study committee to examine the administrative costs, 3 staffing levels, and allocation of staff at the institutions of 4 higher learning governed by the state board of regents, as well 5 as the graduation and student retention rates for each academic 6 program at each such institution of higher learning. 7 2. The interim study committee shall submit a report, 8 including findings and recommendations, to the general assembly 9 by December 15, 2021, for the 2022 legislative session. 10 Sec. 24. EFFECTIVE DATES. The following, being deemed of 11 immediate importance, take effect upon enactment: 12 1. The section of this division of this Act transferring 13 moneys to the future ready Iowa skilled workforce last-dollar 14 scholarship fund established pursuant to section 261.131. 15 2. The section of this division of this Act amending 2019 16 Iowa Acts, chapter 135, section 5, subsection 27, as amended by 17 2020 Iowa Acts, chapter 1121, section 76, subsection 27. 18 Sec. 25. RETROACTIVE APPLICABILITY. The following apply 19 retroactively to July 1, 2020: 20 1. The section of this division of this Act enacting section 21 261.87, subsection 1, paragraph “d”, subparagraph (5). 22 2. The section of this division of this Act enacting section 23 261.87, subsection 1, paragraph “i”. 24 3. The section of this division of this Act transferring 25 moneys to the future ready Iowa skilled workforce last-dollar 26 scholarship fund established pursuant to section 261.131. 27 DIVISION II 28 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2021-2022 29 Sec. 26. There is appropriated from the Iowa skilled worker 30 and job creation fund created in section 8.75 to the following 31 departments, agencies, and institutions for the fiscal year 32 beginning July 1, 2021, and ending June 30, 2022, the following 33 amounts, or so much thereof as is necessary, to be used for the 34 purposes designated: 35 -29- HF 868.2550 (1) 89 kh/tm 29/ 43

The department shall establish an 28 application process and criteria to award grants pursuant to 29 this subparagraph to community colleges. The criteria shall be 30 based on need for instruction in English as a second language 31 in the region served by each community college as determined by 32 factors including data from the latest federal decennial census 33 and outreach efforts to determine regional needs. 34 (4) From the moneys appropriated in this lettered paragraph 35 -30- HF 868.2550 (1) 89 kh/tm 30/ 43
“b”, $210,000 shall be transferred to the department of human 1 services for purposes of administering a program to provide 2 access to international resources to Iowans and new Iowans 3 to provide economic and leadership development resulting in 4 Iowa being a more inclusive and welcoming place to live, work, 5 and raise a family. The program shall provide supplemental 6 support services for international refugees to improve 7 learning, English literacy, life skills, cultural competencies, 8 and integration in a county with a population over 350,000 9 as determined by the 2010 federal decennial census. The 10 department of human services shall utilize a request for 11 proposals process to identify the entity best qualified to 12 implement the program. 13 c. Notwithstanding section 8.33, moneys appropriated 14 in this section of this division of this Act that remain 15 unencumbered or unobligated at the close of the fiscal year 16 shall not revert but shall remain available for expenditure 17 for the purposes designated until the close of the succeeding 18 fiscal year. 19 DIVISION III 20 ACCOUNTABILITY AND ADMINISTRATIVE MEASURES —— FEES 21 Sec. 27. Section 256.9, Code 2021, is amended by adding the 22 following new subsections: 23 NEW SUBSECTION . 63. Develop and make available on the 24 department’s internet site general guidance for parents, 25 guardians, and community members who have concerns about school 26 districts or their governing boards. 27 NEW SUBSECTION . 64. Develop and distribute to school 28 districts standards of practice for equity coordinators 29 employed by school districts. To provide consistency in 30 training statewide, the director shall also develop and 31 distribute to school districts a training program on free 32 speech under the first amendment which shall be used by school 33 districts to provide training pursuant to section 279.75. 34 Sec. 28. Section 256.11, subsections 10 and 11, Code 2021, 35 -32- HF 868.2550 (1) 89 kh/tm 32/ 43
are amended by striking the subsections and inserting in lieu 1 thereof the following: 2 10. The state board shall establish, and the department 3 shall use, for the school year commencing July 1, 2021, and 4 each succeeding school year, an accreditation, monitoring, 5 and enforcement process for school districts and nonpublic 6 schools seeking accreditation pursuant to this subsection and 7 subsections 11 and 12. The process established shall include 8 all of the following requirements: 9 a. Phase I monitoring. 10 (1) Phase I monitoring shall consist of annual monitoring by 11 the department of all accredited schools and school districts 12 for compliance with state and federal school laws, regulations, 13 and rules adopted by the state board under chapter 17A, 14 including but not limited to the following: 15 (a) Accreditation standards adopted by the state board as 16 provided in this section. 17 (b) Fiscal compliance. 18 (c) Federal education laws including but not limited to the 19 federal Elementary and Secondary Education Act of 1965, and the 20 federal Individuals with Disabilities Education Act, 20 U.S.C. 21 §1400 et seq., as amended. 22 (d) The federal Civil Rights Act of 1964 and chapter 216. 23 (e) All other requirements of this title applicable to 24 accredited schools and school districts. 25 (2) Phase I monitoring may include but shall not be limited 26 to the following: 27 (a) One or more desk audits requiring submission of 28 information to the department in a manner and on forms 29 prescribed by the department. 30 (b) One or more remote or on-site visits to schools or 31 school districts to address accreditation issues identified in 32 a desk audit. Such a visit may be conducted by an individual 33 departmental consultant or may be a comprehensive site visit 34 by a team of departmental consultants and other subject-matter 35 -33- HF 868.2550 (1) 89 kh/tm 33/ 43
professionals. 1 (c) A review of district finances by department staff or a 2 neutral third party. 3 (d) A review of local school board policies and procedures 4 by department staff or a neutral third party. 5 (3) The department shall provide a public report annually of 6 findings of noncompliance and required corrective actions for 7 each accredited school and school district. The purpose of the 8 phase I process is to bring schools and school districts into 9 minimum compliance with federal and state laws, regulations, 10 and rules and no citation or corrective action may be designed 11 to require more than minimum compliance. 12 (4) The department shall provide a written report 13 annually to the state board of any monitoring review resulting 14 in multiple or substantial findings of noncompliance or 15 noncompliance findings that remain uncorrected for more 16 than thirty days past the deadline set by the department for 17 correction. 18 (5) The department shall eliminate duplicative reporting 19 on the part of schools and school districts for phase I 20 monitoring, and is prohibited from collecting information not 21 specifically permitted by federal or state law, regulation, or 22 rule. 23 (6) Enforcement actions under phase I monitoring are 24 limited to actions permitted pursuant to paragraph “c” , 25 subparagraphs (2) and (3). Violations of federal legal 26 requirements shall follow the procedures and limitations of the 27 governing statute. 28 b. Phase II monitoring. 29 (1) Phase II monitoring shall take place when any of the 30 following conditions are present: 31 (a) When either the annual monitoring or the biennial 32 on-site visit of phase I indicates that an accredited school or 33 school district is deficient and fails to be in compliance with 34 accreditation standards. 35 -34- HF 868.2550 (1) 89 kh/tm 34/ 43
(b) In response to a petition filed with the director 1 requesting such an accreditation committee visitation that is 2 signed by eligible electors residing in the school district 3 equal in number to at least twenty percent of the registered 4 voters of the school district. 5 (c) In response to a petition filed with the director 6 requesting such an accreditation committee visitation that is 7 signed by twenty percent or more of the parents or guardians 8 who have children enrolled in the school or school district. 9 (d) At the direction of the state board. 10 (e) The school budget review committee submits to the 11 department a recommendation for a fiscal review pursuant to 12 section 257.31, subsection 18. 13 (2) Phase II monitoring shall consist of a full desk audit 14 of all monitoring requirements and an on-site visit to the 15 school or school district for the purpose of determining the 16 extent of noncompliance, the reason for lack of correction, if 17 applicable, and a recommendation for corrective action to the 18 director and the state board. 19 (3) Phase II monitoring requires the use of an accreditation 20 committee appointed by the director. The accreditation 21 committee shall be made up primarily of department staff but 22 may request the assistance of third-party specialists at the 23 discretion of the director. An accreditation committee visit 24 to a nonpublic school requires membership on the committee 25 from nonpublic school instructional or administrative staff or 26 board members. A member of a committee shall not have a direct 27 interest in the school district or nonpublic school being 28 visited. 29 (4) After visiting the school district or nonpublic 30 school, the accreditation committee shall, within thirty 31 days, determine whether the accreditation standards have been 32 met and shall make a report to the director, together with a 33 recommendation on what enforcement actions, if any, should be 34 recommended to the state board. 35 -35- HF 868.2550 (1) 89 kh/tm 35/ 43
c. Enforcement. 1 (1) The department shall enforce the laws, regulations, 2 and rules applicable to school districts and nonpublic schools 3 consistent with the process outlined in this subsection. The 4 department shall coordinate its enforcement of chapter 216 with 5 the Iowa state civil rights commission to reduce duplication 6 of efforts. 7 (2) If, after having an opportunity to correct, if 8 permitted, a school district is found to be in noncompliance 9 with federal education laws including but not limited to the 10 federal Elementary and Secondary Education Act of 1965, the 11 federal Individuals with Disabilities Education Act, 20 U.S.C. 12 §1400 et seq., as amended, the federal Civil Rights Act of 13 1964, chapter 216, section 279.73 if enacted by House File 744, 14 or section 279.74 if enacted by House File 802, the director 15 may recommend, and the state board may do, one of the following 16 within thirty days of the finding of noncompliance: 17 (a) Impose conditions on funding provided to a school 18 district, including directing the use of school district funds 19 and designating the school district a high-risk grantee under 20 2 C.F.R. §200.207. 21 (b) Withhold payment of state or federal funds to a 22 school district, in whole or in part, until noncompliance 23 is corrected. Initial withholding of state funds is at the 24 discretion of the director for a period of sixty calendar days, 25 after which it is subject to approval of the state board every 26 sixty calendar days. Withholding of federal funds is subject 27 to the governing federal statute or regulation. 28 (3) The director may use any of the following permitted 29 enforcement mechanisms and shall exercise discretion to ensure 30 that enforcement actions are proportionate to school district 31 or nonpublic school noncompliance: 32 (a) Advise the school district or nonpublic school on the 33 availability of appropriate technical assistance. 34 (b) Require the school district or nonpublic school to 35 -36- HF 868.2550 (1) 89 kh/tm 36/ 43
complete a corrective action plan or plan for improvement by 1 a reasonable deadline. 2 (c) Recommend a phase II visit to the school district or 3 nonpublic school to the state board. 4 (d) Refer conduct of school district or nonpublic school 5 staff or school board members, or school authorities, to the 6 office of the attorney general for investigation. 7 (e) Refer financial concerns to the auditor of state for 8 investigation. 9 (f) Recommend removal of accreditation of the school 10 district or school to the state board. 11 (g) Take any other enforcement mechanism available to the 12 director. 13 (4) The department shall focus enforcement activities on 14 all of the following: 15 (a) Improving educational results for children, families, 16 and students. 17 (b) Ensuring that public agencies and their governing 18 boards meet requirements of state and federal laws. 19 11. a. If the recommendation pursuant to subsection 10 20 is that a school district or nonpublic school not remain 21 accredited, the accreditation committee shall provide the 22 school district or nonpublic school with a report that includes 23 a list of all of the deficiencies, a plan prescribing the 24 actions that must be taken to correct the deficiencies, and 25 a deadline date for completion of the prescribed actions. 26 The accreditation committee shall advise the school district 27 or nonpublic school of available resources and technical 28 assistance to improve areas of weakness. The school district 29 or nonpublic school shall be provided with the opportunity 30 to respond to the accreditation committee’s report. The 31 director shall review the accreditation committee’s report 32 and the response of the school district or nonpublic school 33 and shall provide a report to the state board along with 34 copies of the accreditation committee’s report, the response 35 -37- HF 868.2550 (1) 89 kh/tm 37/ 43
to the accreditation committee’s report, and other pertinent 1 information. At the request of the school district or 2 nonpublic school, the school district or nonpublic school may 3 appear before the state board and address the state board 4 directly regarding any part of the plan specified in the 5 report. The state board may modify the plan. During the 6 period of time specified in the plan for its implementation by 7 a school district or nonpublic school, the school district or 8 school shall remain accredited. 9 b. The accreditation committee shall revisit the school 10 district or nonpublic school and shall determine whether the 11 deficiencies in the standards have been corrected. 12 c. The accreditation team shall make a report and 13 recommendation to the director and the state board. The 14 committee recommendation shall specify whether the school 15 district or nonpublic school shall remain accredited. For a 16 school district, the committee report and recommendation shall 17 also specify under what conditions the district may remain 18 accredited. The conditions may include but are not limited to 19 providing temporary oversight authority, operational authority, 20 or both oversight and operational authority to the director and 21 the state board for some or all aspects of the school district 22 in order to bring the school district into compliance with 23 minimum standards. 24 d. The state board shall review the report and 25 recommendation, may request additional information, and shall 26 determine whether the deficiencies have been corrected. 27 e. If the deficiencies have not been corrected, and the 28 conditional accreditation alternatives contained in the report 29 are not mutually acceptable to the state board and the local 30 board, the state board shall deaccredit the school district and 31 merge the territory of the school district with one or more 32 contiguous school districts at the end of the school year. The 33 state board may place a district under receivership for the 34 remainder of the school year. The receivership shall be under 35 -38- HF 868.2550 (1) 89 kh/tm 38/ 43
the direct supervision and authority of the area education 1 agency in which the district is located. The decision of 2 whether to deaccredit the school district or to place the 3 district under receivership shall be based upon a determination 4 by the state board of the best interests of the students, 5 parents, residents of the community, teachers, administrators, 6 and school district board members and upon the recommendations 7 of the accreditation committee and the director. 8 f. In the case of a nonpublic school, if the deficiencies 9 have not been corrected, the state board may deaccredit the 10 nonpublic school. The deaccreditation shall take effect on the 11 date established by the resolution of the state board, which 12 shall be no later than the end of the school year in which the 13 nonpublic school is deaccredited. 14 Sec. 29. Section 272.2, Code 2021, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 24. Establish, collect, and refund 17 fees from an administrator for the administrative costs 18 of processing complaints and conducting hearings if the 19 administrator is the respondent in a complaint for violation of 20 the code of professional conduct and ethics, developed pursuant 21 to subsection 1, for which final board action results in a 22 sanction against the administrator. 23 Sec. 30. Section 272.10, Code 2021, is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 5. The fees established by the board 26 for the administrative costs of processing complaints and 27 conducting hearings pursuant to section 272.2, subsection 24, 28 may include a fee for personal service by a sheriff, a fee for 29 legal notice when placed in a newspaper, transcription service 30 or court reporter fee, and other fees assessed as costs by 31 the board. The fees collected annually in accordance with 32 this subsection shall be retained by and are appropriated to 33 the board for the purposes related to the board’s duties. 34 Notwithstanding section 8.33, fees retained by and appropriated 35 -39- HF 868.2550 (1) 89 kh/tm 39/ 43
to the board pursuant to this subsection that remain 1 unencumbered or unobligated at the close of the fiscal year 2 shall not revert but shall remain available for expenditure for 3 the activities of the board as provided in this chapter until 4 the close of the succeeding fiscal year. 5 Sec. 31. NEW SECTION . 279.8B Petition —— school board 6 meeting agenda. 7 1. Upon petition signed by eligible electors of a school 8 district equal in number to at least ten percent of the persons 9 who voted in the last preceding election of school officials 10 under section 277.1, or five hundred eligible electors, 11 whichever is less, the board of directors of the school 12 district shall place the proposal specified in the petition 13 on the agenda of the next regular meeting of the school board 14 or on the agenda of a school board meeting held within thirty 15 days of receipt of the petition filed in accordance with this 16 subsection. If the proposal relates to curriculum, the school 17 district may halt use of the subject instructional materials 18 until the school board holds the board meeting at which the 19 proposal is presented and discussed. The meeting notice shall 20 include a brief description of the proposal. 21 2. The board of directors of the school district shall 22 provide sufficient time to receive public comment on the 23 proposal. The board shall allow each interested member of the 24 public to speak at the meeting regarding the proposal, but may 25 impose a time limit on the amount of time a member of the public 26 is allowed to speak if the time limit is the same for each 27 speaker and necessary due to the amount of people wishing to 28 speak. 29 Sec. 32. Section 279.66, Code 2021, is amended to read as 30 follows: 31 279.66 Discipline and personal conduct standards. 32 1. The board of directors of a school district shall review 33 and modify existing policies related to student discipline 34 and student conduct that are designed to promote responsible 35 -40- HF 868.2550 (1) 89 kh/tm 40/ 43
behavior on school property and at school functions in 1 order that the policy shall govern the conduct of students, 2 teachers and other school personnel, and visitors; provide 3 opportunities for students to exercise self-discipline 4 and practice cooperative classroom behavior; and encourage 5 students and practitioners to model fairness, equity, and 6 respect. The policy shall specify the responsibilities of 7 students, parents and guardians, and practitioners in creating 8 an atmosphere where all individuals feel a sense of respect, 9 safety, and belonging, and shall set forth the consequences for 10 unacceptable behavior. The policy shall be published in the 11 student handbook. 12 2. The board of directors of a school district shall 13 include or reference in the student handbook guidance published 14 pursuant to section 256.9, subsection 63, by the department of 15 education for parents, guardians, and community members who 16 have concerns about school districts or their governing boards. 17 Sec. 33. NEW SECTION . 279.75 Training for equity 18 coordinators. 19 The board of directors of a school district shall provide 20 training on free speech under the first amendment to the 21 Constitution of the United States developed and distributed 22 pursuant to section 256.9, subsection 64, annually to any 23 equity coordinator employed by the school district. 24 DIVISION IV 25 PRESCHOOL FUNDING 26 Sec. 34. PRESCHOOL MODIFIED SUPPLEMENTAL AMOUNT —— SCHOOL 27 BUDGET REVIEW COMMITTEE. 28 1. Notwithstanding section 256C.4, subsection 1, paragraph 29 “f”, and any provision of section 257.31 to the contrary, if 30 fifty percent of a school district’s actual enrollment of 31 eligible students in preschool programming provided by the 32 school district within the meaning of section 256C.5 on October 33 1, 2021, is greater than the preschool budget enrollment 34 determined under section 256C.5 for the budget year beginning 35 -41- HF 868.2550 (1) 89 kh/tm 41/ 43
July 1, 2021, the school district may apply to the school 1 budget review committee for a modified supplemental amount for 2 the budget year beginning July 1, 2021. An approved modified 3 supplemental amount under this section shall not exceed an 4 amount equal to the product of the regular program state 5 cost per pupil for the budget year beginning July 1, 2021, 6 multiplied by the difference of fifty percent of a school 7 district’s actual enrollment of eligible students in preschool 8 programming provided by the school district on October 1, 2021, 9 minus the preschool budget enrollment determined under section 10 256C.5 for the budget year beginning July 1, 2021. 11 2. The school budget review committee shall review a school 12 district’s unexpended preschool fund balance for the budget 13 year ending June 30, 2021, when deciding whether to grant a 14 modified supplemental amount request under this section. For 15 a school district with an unexpended preschool fund balance 16 that is equal to or less than twenty-five percent of the school 17 district’s preschool foundation aid under section 256C.5 18 for the budget year beginning July 1, 2020, the modified 19 supplemental amount shall be granted. For a school district 20 with an unexpended preschool fund balance that is greater 21 than twenty-five percent of the school district’s preschool 22 foundation aid under section 256C.5 for the budget year 23 beginning July 1, 2020, the modified supplemental amount may 24 be granted. 25 3. A modified supplemental amount granted under this 26 section must be used for the purposes of chapter 256C, 27 including amounts passed through to a community-based provider. 28 4. Amounts received as the result of a modified supplemental 29 amount granted under this section shall not be eligible for 30 transfer to a school district’s flexibility account under 31 section 298A.2, subsection 2, and, notwithstanding section 32 256C.4, subsection 1, paragraph “e”, a school district that 33 is granted a modified supplemental amount under this section 34 shall not be eligible to transfer any preschool foundation 35 -42- HF 868.2550 (1) 89 kh/tm 42/ 43
aid that remains unexpended and unobligated at the end of the 1 fiscal year beginning July 1, 2021, to the school district’s 2 flexibility account under section 298A.2, subsection 2. 3 5. Modified supplemental amounts granted under this section 4 shall be subject to available funding and be funded solely 5 through aid awarded by the school budget review committee from 6 funds made available to the school budget review committee for 7 purposes of this section. If amounts made available to the 8 school budget review committee for purposes of this section are 9 insufficient to fund all modified supplemental amounts granted 10 under this section, the amount of each modified supplement 11 amount shall be prorated. 12 Sec. 35. EFFECTIVE DATE. This division of this Act, being 13 deemed of immediate importance, takes effect upon enactment. 14 DIVISION V 15 CALCULATION OF SCHOOL HOURS 16 Sec. 36. OFFICIAL’S FUNERAL SERVICES. Notwithstanding 17 section 279.10, and section 256.7, subsection 19, for each 18 school district and accredited nonpublic school, each hour of a 19 school day that students attended the public funeral services 20 of a member of the Iowa state patrol on Friday, April 16, 2021, 21 shall be considered as attending an hour of instruction during 22 that school day. 23 Sec. 37. EFFECTIVE DATE. This division of this Act, being 24 deemed of immediate importance, takes effect upon enactment. 25 Sec. 38. RETROACTIVE APPLICABILITY.
