Notwithstanding section 261.132, subsection 5, there is 20 transferred from the future ready Iowa skilled workforce grant 21 fund created pursuant to section 261.132, subsection 5, to the 22 future ready Iowa skilled workforce last-dollar scholarship 23 fund created pursuant to section 261.131, subsection 5, any 24 moneys remaining unencumbered and unobligated on the effective 25 date of this Act. 26 2. From the moneys deposited in the school ready children 11 grants account for the fiscal year beginning July 1, 2021, and 12 ending June 30, 2022, not more than $265,950 is allocated for 13 the early childhood Iowa office and other technical assistance 14 activities. Moneys allocated under this lettered paragraph 15 may be used by the early childhood Iowa state board for the 16 purpose of skills development and support for ongoing training 17 of staff. However, except as otherwise provided in this 18 subsection, moneys shall not be used for additional staff or 19 for the reimbursement of staff. 20 b. Of the amount appropriated in this subsection for 21 deposit in the school ready children grants account of the 22 early childhood Iowa fund, $2,318,018 shall be used for efforts 23 to improve the quality of early care, health, and education 24 programs. Moneys allocated pursuant to this paragraph may be 25 used for additional staff and for the reimbursement of staff. 26 The early childhood Iowa state board may reserve a portion 27 of the allocation, not to exceed $88,650, for the technical 28 assistance expenses of the early childhood Iowa state office, 29 including the reimbursement of staff, and shall distribute 30 the remainder to early childhood Iowa areas for local quality 31 improvement efforts through a methodology identified by the 32 early childhood Iowa state board to make the most productive 33 use of the funding, which may include use of the distribution 34 formula, grants, or other means. 35 -6- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 6/ 38
c. Of the amount appropriated in this subsection for 1 deposit in the school ready children grants account of 2 the early childhood Iowa fund, $825,030 shall be used for 3 support of professional development and training activities 4 for persons working in early care, health, and education by 5 the early childhood Iowa state board in collaboration with 6 the professional development component groups maintained by 7 the early childhood Iowa stakeholders alliance pursuant to 8 section 256I.12, subsection 7, paragraph “b”, and the early 9 childhood Iowa area boards. Expenditures shall be limited to 10 professional development and training activities agreed upon by 11 the parties participating in the collaboration. 12 9. BIRTH TO AGE THREE SERVICES 13 a. For expansion of the federal Individuals with 14 Disabilities Education Improvement Act of 2004, Pub. L. The department may charge school districts and accredited 17 nonpublic schools a fee for the system not to exceed the actual 18 costs to purchase a statewide license for the early warning 19 assessment minus the moneys received by the department under 20 this subsection. The fee shall be determined by dividing the 21 actual remaining costs to purchase the statewide license for 22 the school year by the number of pupils assessed under the 23 system in the current fiscal year. School districts may use 24 moneys received pursuant to section 257.10, subsection 11, and 25 moneys received for purposes of implementing section 279.68, 26 subsection 2, to pay the early warning assessment system fee. 27 21. IOWA READING RESEARCH CENTER 28 a. For purposes of the Iowa reading research center in 29 order to implement, in collaboration with the area education 30 agencies, the provisions of section 256.9, subsection 49, 31 paragraph “c”: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,550,176 33 b. Section 261.87, subsection 1, paragraph d, 6 subparagraphs (1), (2), (3), and (4), Code 2021, are amended 7 to read as follows: 8 (1) Is the child or stepchild of a peace officer, as 9 defined in section 97A.1 , who was killed in the line of duty 10 as determined by the board of trustees of the Iowa department 11 of public safety peace officers’ retirement, accident, and 12 disability system in accordance with section 97A.6, subsection 13 16 . 14 (2) Is the child or stepchild of a police officer or a fire 15 fighter, as each is defined in section 411.1 , who was killed in 16 the line of duty as determined by the statewide fire and police 17 retirement system in accordance with section 411.6, subsection 18 15 . 19 (3) Is the child or stepchild of a sheriff or deputy sheriff 20 as each is defined in section 97B.49C , who was killed in 21 the line of duty as determined by the Iowa public employees’ 22 retirement system in accordance with section 97B.52, subsection 23 2 . 24 (4) Is the child or stepchild of a fire fighter or police 25 officer included under section 97B.49B , who was killed in 26 the line of duty as determined by the Iowa public employees’ 27 retirement system in accordance with section 97B.52, subsection 28 2 . 29 Sec. 15. Section 261.87, subsection 1, paragraph d, Code 30 2021, is amended by adding the following new subparagraph: 31 NEW SUBPARAGRAPH . (5) Is the child or stepchild of an 32 employee of the Iowa department of corrections, or of a 33 judicial district department of correctional services, who was 34 killed in the line of duty. 35 -22- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 22/ 38
Sec. 16. Section 261.87, subsection 1, Code 2021, is amended 1 by adding the following new paragraph: 2 NEW PARAGRAPH . i. “Stepchild” means the same as defined in 3 section 450.l. 4 Sec. 17. Section 261.132, Code 2021, is amended by adding 5 the following new subsection: 6 NEW SUBSECTION . 6. New awards prohibited. For the fiscal 7 year beginning July 1, 2021, and each succeeding fiscal year, 8 the commission shall not award a future ready Iowa skilled 9 workforce grant to any new applicant, but may award a future 10 ready Iowa skilled workforce grant to an applicant who received 11 a grant awarded under the program in the fiscal year beginning 12 July 1, 2020, and who continues to meet the eligibility 13 requirements of this section. 14 Sec. 18. Section 284.13, subsection 1, paragraphs a, b, c, 15 e, f, and g, Code 2021, are amended to read as follows: 16 a. For the fiscal year beginning July 1, 2019 2021 , and 17 ending June 30, 2020 2022 , to the department, the amount of 18 five hundred eight thousand two hundred fifty dollars for the 19 issuance of national board certification awards in accordance 20 with section 256.44 . Of the amount allocated under this 21 paragraph, not less than eighty-five thousand dollars shall 22 be used to administer the ambassador to education position in 23 accordance with section 256.45 . 24 b. For the fiscal year beginning July 1, 2019 2021 , and 25 ending June 30, 2020 2022 , up to seven hundred twenty-eight 26 thousand two hundred sixteen dollars to the department for 27 purposes of implementing the professional development program 28 requirements of section 284.6 , assistance in developing model 29 evidence for teacher quality committees established pursuant to 30 section 284.4, subsection 1 , paragraph “b” , and the evaluator 31 training program in section 284.10 . A portion of the funds 32 allocated to the department for purposes of this paragraph may 33 be used by the department for administrative purposes and for 34 not more than four full-time equivalent positions. 35 -23- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 23/ 38
c. For the fiscal year beginning July 1, 2019 2021 , 1 and ending June 30, 2020 2022 , an amount up to one million 2 seventy-seven thousand eight hundred ten dollars to the 3 department for the establishment of teacher development 4 academies in accordance with section 284.6, subsection 10 . A 5 portion of the funds allocated to the department for purposes 6 of this paragraph may be used for administrative purposes. 7 e. For the fiscal year beginning July 1, 2019 2021 , and 8 ending June 30, 2020 2022 , to the department an amount up to 9 twenty-five thousand dollars for purposes of the fine arts 10 beginning teacher mentoring program established under section 11 256.34 . 12 f. For the fiscal year beginning July 1, 2019 2021 , and 13 ending June 30, 2020 2022 , to the department an amount up 14 to six hundred twenty-six thousand one hundred ninety-one 15 dollars shall be used by the department for a delivery system, 16 in collaboration with area education agencies, to assist in 17 implementing the career paths and leadership roles considered 18 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 19 not limited to planning grants to school districts and area 20 education agencies, technical assistance for the department, 21 technical assistance for districts and area education agencies, 22 training and staff development, and the contracting of external 23 expertise and services. In using moneys allocated for purposes 24 of this paragraph, the department shall give priority to school 25 districts with certified enrollments of fewer than six hundred 26 students. A portion of the moneys allocated annually to the 27 department for purposes of this paragraph may be used by the 28 department for administrative purposes and for not more than 29 five full-time equivalent positions. 30 g. For the fiscal year beginning July 1, 2020 2022 , and 31 for each subsequent fiscal year, to the department, ten 32 million dollars for purposes of implementing the supplemental 33 assistance for high-need schools provisions of section 284.11 . 34 Annually, of the moneys allocated to the department for 35 -24- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 24/ 38
purposes of this paragraph, up to one hundred thousand dollars 1 may be used by the department for administrative purposes and 2 for not more than one full-time equivalent position. 3 Sec. 19. INTERIM STUDY COMMITTEE —— REGENTS UNIVERSITIES. 4 1. The legislative council is requested to establish an 5 interim study committee to examine the administrative costs, 6 staffing levels, and allocation of staff at the institutions of 7 higher learning governed by the state board of regents, as well 8 as the graduation and student retention rates for each academic 9 program at each such institution of higher learning. 10 2. The interim study committee shall submit a report, 11 including findings and recommendations, to the general assembly 12 by December 15, 2021, for the 2022 legislative session. 13 Sec. 20. EFFECTIVE DATES. The following, being deemed of 14 immediate importance, take effect upon enactment: 15 1. The section of this division of this Act transferring 16 moneys to the future ready Iowa skilled workforce last-dollar 17 scholarship fund established pursuant to section 261.131. 18 2. The section of this division of this Act amending 2019 19 Iowa Acts, chapter 135, section 5, subsection 27, as amended by 20 2020 Iowa Acts, chapter 1121, section 76, subsection 27. 21 Sec. 21. RETROACTIVE APPLICABILITY. The following apply 22 retroactively to July 1, 2020: 23 1. The section of this division of this Act enacting section 24 261.87, subsection 1, paragraph “d”, subparagraph (5). 25 2. The section of this division of this Act enacting section 26 261.87, subsection 1, paragraph “i” . 27 3. The section of this division of this Act transferring 28 moneys to the future ready Iowa skilled workforce last-dollar 29 scholarship fund established pursuant to section 261.131. 30 DIVISION II 31 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2021-2022 32 Sec. 22. There is appropriated from the Iowa skilled worker 33 and job creation fund created in section 8.75 to the following 34 departments, agencies, and institutions for the fiscal year 35 -25- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 25/ 38

For distribution to community colleges for the purposes 16 of implementing adult education and literacy programs pursuant 17 to section 260C.50: 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,500,000 19 (1) From the moneys appropriated in this lettered paragraph 20 “b”, $3,883,000 shall be allocated pursuant to the formula 21 established in section 260C.18C. 22 (2) From the moneys appropriated in this lettered paragraph 23 “b”, not more than $150,000 shall be used by the department 24 for implementation of adult education and literacy programs 25 pursuant to section 260C.50. 26 (3) From the moneys appropriated in this lettered paragraph 27 “b”, not more than $1,257,000 shall be distributed as grants 28 to community colleges for the purpose of adult basic education 29 programs for students requiring instruction in English 30 as a second language. The department shall establish an 31 application process and criteria to award grants pursuant to 32 this subparagraph to community colleges. The criteria shall be 33 based on need for instruction in English as a second language 34 in the region served by each community college as determined by 35 -26- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 26/ 38
factors including data from the latest federal decennial census 1 and outreach efforts to determine regional needs. 2 (4) From the moneys appropriated in this lettered paragraph 3 “b”, $210,000 shall be transferred to the department of human 4 services for purposes of administering a program to provide 5 access to international resources to Iowans and new Iowans 6 to provide economic and leadership development resulting in 7 Iowa being a more inclusive and welcoming place to live, work, 8 and raise a family. The program shall provide supplemental 9 support services for international refugees to improve 10 learning, English literacy, life skills, cultural competencies, 11 and integration in a county with a population over 350,000 12 as determined by the 2010 federal decennial census. The 13 department of human services shall utilize a request for 14 proposals process to identify the entity best qualified to 15 implement the program. 16 c. For capital projects at community colleges that meet the 17 definition of the term “vertical infrastructure” in section 18 8.57, subsection 5, paragraph “c”: 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 6,000,000 20 Moneys appropriated in this lettered paragraph shall be 21 disbursed pursuant to section 260G.6, subsection 3. Projects 22 that qualify for moneys appropriated in this lettered paragraph 23 shall include at least one of the following: 24 (1) Accelerated career education program capital projects. 25 (2) Major renovations and major repair needs, including 26 health, life, and fire safety needs, including compliance with 27 the federal Americans With Disabilities Act. 28 d. For deposit in the pathways for academic career and 29 employment fund established pursuant to section 260H.2: 30 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,000,000 31 From the moneys appropriated in this lettered paragraph “d”, 32 not more than $200,000 shall be allocated by the department 33 for implementation of regional industry sector partnerships 34 pursuant to section 260H.7B and for not more than one full-time 35 -27- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 27/ 38
equivalent position. 1 e. For support costs associated with administering a 11 workforce preparation outcome reporting system for the purpose 12 of collecting and reporting data relating to the educational 13 and employment outcomes of workforce preparation programs 14 receiving moneys pursuant to this subsection: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 16 3. Notwithstanding section 8.33, moneys appropriated 17 in this section of this division of this Act that remain 18 unencumbered or unobligated at the close of the fiscal year 19 shall not revert but shall remain available for expenditure 20 for the purposes designated until the close of the succeeding 21 fiscal year. 22 DIVISION III 23 ACCOUNTABILITY AND ADMINISTRATIVE MEASURES —— FEES 24 Sec. 23. Section 256.9, Code 2021, is amended by adding the 25 following new subsection: 26 NEW SUBSECTION . 63. Develop and make available on the 27 department’s internet site general guidance for parents, 28 guardians, and community members who have concerns about school 29 districts or their governing boards. 30 Sec. 24. Section 256.11, subsections 10 and 11, Code 2021, 31 are amended by striking the subsections and inserting in lieu 32 thereof the following: 33 10. The state board shall establish, and the department 34 shall use, for the school year commencing July 1, 2021, and 35 -28- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 28/ 38
each succeeding school year, an accreditation, monitoring, 1 and enforcement process for school districts and nonpublic 2 schools seeking accreditation pursuant to this subsection and 3 subsections 11 and 12. The process established shall include 4 all of the following requirements: 5 a. Phase I monitoring. 6 (1) Phase I monitoring shall consist of annual monitoring by 7 the department of all accredited schools and school districts 8 for compliance with state and federal school laws, regulations, 9 and rules adopted by the state board under chapter 17A, 10 including but not limited to the following: 11 (a) Accreditation standards adopted by the state board as 12 provided in this section. 13 (b) Fiscal compliance. 14 (c) Federal education laws including but not limited to the 15 federal Elementary and Secondary Education Act of 1965, and the 16 federal Individuals with Disabilities Education Act, 20 U.S.C. 17 §1400 et seq., as amended. 18 (d) The federal Civil Rights Act of 1964 and chapter 216. 19 (e) All other requirements of this title applicable to 20 accredited schools and school districts. 21 (2) Phase I monitoring may include but shall not be limited 22 to the following: 23 (a) One or more desk audits requiring submission of 24 information to the department in a manner and on forms 25 prescribed by the department. 26 (b) One or more remote or on-site visits to schools or 27 school districts to address accreditation issues identified in 28 a desk audit. Such a visit may be conducted by an individual 29 departmental consultant or may be a comprehensive site visit 30 by a team of departmental consultants and other subject-matter 31 professionals. 32 (c) A review of district finances by department staff or a 33 neutral third party. 34 (d) A review of local school board policies and procedures 35 -29- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 29/ 38
by department staff or a neutral third party. 1 (3) The department shall provide a public report annually of 2 findings of noncompliance and required corrective actions for 3 each accredited school and school district. The purpose of the 4 phase I process is to bring schools and school districts into 5 minimum compliance with federal and state laws, regulations, 6 and rules and no citation or corrective action may be designed 7 to require more than minimum compliance. 8 (4) The department shall provide a written report 9 annually to the state board of any monitoring review resulting 10 in multiple or substantial findings of noncompliance or 11 noncompliance findings that remain uncorrected for more 12 than thirty days past the deadline set by the department for 13 correction. 14 (5) The department shall eliminate duplicative reporting 15 on the part of schools and school districts for phase I 16 monitoring, and is prohibited from collecting information not 17 specifically permitted by federal or state law, regulation, or 18 rule. 19 (6) Enforcement actions under phase I monitoring are 20 limited to actions permitted pursuant to paragraph “c” , 21 subparagraphs (2) and (3). Violations of federal legal 22 requirements shall follow the procedures and limitations of the 23 governing statute. 24 b. Phase II monitoring. 25 (1) Phase II monitoring shall take place when any of the 26 following conditions are present: 27 (a) When either the annual monitoring or the biennial 28 on-site visit of phase I indicates that an accredited school or 29 school district is deficient and fails to be in compliance with 30 accreditation standards. 31 (b) In response to a petition filed with the director 32 requesting such an accreditation committee visitation that is 33 signed by eligible electors residing in the school district 34 equal in number to at least twenty percent of the registered 35 -30- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 30/ 38
voters of the school district. 1 (c) In response to a petition filed with the director 2 requesting such an accreditation committee visitation that is 3 signed by twenty percent or more of the parents or guardians 4 who have children enrolled in the school or school district. 5 (d) At the direction of the state board. 6 (e) The school budget review committee submits to the 7 department a recommendation for a fiscal review pursuant to 8 section 257.31, subsection 18. 9 (2) Phase II monitoring shall consist of a full desk audit 10 of all monitoring requirements and an on-site visit to the 11 school or school district for the purpose of determining the 12 extent of noncompliance, the reason for lack of correction, if 13 applicable, and a recommendation for corrective action to the 14 director and the state board. 15 (3) Phase II monitoring requires the use of an accreditation 16 committee appointed by the director. The accreditation 17 committee shall be made up primarily of department staff but 18 may request the assistance of third-party specialists at the 19 discretion of the director. An accreditation committee visit 20 to a nonpublic school requires membership on the committee 21 from nonpublic school instructional or administrative staff or 22 board members. A member of a committee shall not have a direct 23 interest in the school district or nonpublic school being 24 visited. 25 (4) After visiting the school district or nonpublic 26 school, the accreditation committee shall, within thirty 27 days, determine whether the accreditation standards have been 28 met and shall make a report to the director, together with a 29 recommendation on what enforcement actions, if any, should be 30 recommended to the state board. 31 c. Enforcement. 32 (1) The department shall enforce the laws, regulations, 33 and rules applicable to school districts and nonpublic schools 34 consistent with the process outlined in this subsection. department shall coordinate its enforcement of chapter 216 with 1 the Iowa state civil rights commission to reduce duplication 2 of efforts. 3 (2) If, after having an opportunity to correct, if 4 permitted, a school district is found to be in noncompliance 5 with federal education laws including but not limited to the 6 federal Elementary and Secondary Education Act of 1965, the 7 federal Individuals with Disabilities Education Act, 20 U.S.C. 8 §1400 et seq., as amended, the federal Civil Rights Act of 9 1964, chapter 216, section 279.73 if enacted by House File 744, 10 or section 279.74 if enacted by House File 802, the director 11 shall recommend that the state board shall do one of the 12 following within thirty days of the finding of noncompliance: 13 (a) Impose conditions on funding provided to a school 14 district, including directing the use of school district funds 15 and designating the school district a high-risk grantee under 16 2 C.F.R. §200.207. 17 (b) Withhold payment of state or federal funds to a 18 school district, in whole or in part, until noncompliance 19 is corrected. Initial withholding of state funds is at the 20 discretion of the director for a period of sixty calendar days, 21 after which it is subject to approval of the state board every 22 sixty calendar days. Withholding of federal funds is subject 23 to the governing federal statute or regulation. 24 (3) The director may use any of the following permitted 25 enforcement mechanisms and shall exercise discretion to ensure 26 that enforcement actions are proportionate to school district 27 or nonpublic school noncompliance: 28 (a) Advise the school district or nonpublic school on the 29 availability of appropriate technical assistance. 30 (b) Require the school district or nonpublic school to 31 complete a corrective action plan or plan for improvement by 32 a reasonable deadline. 33 (c) Recommend a phase II visit to the school district or 34 nonpublic school to the state board. 35 -32- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 32/ 38
(d) Refer conduct of school district or nonpublic school 1 staff or school board members, or school authorities, to the 2 office of the attorney general for investigation. 3 (e) Refer financial concerns to the auditor of state for 4 investigation. 5 (f) Recommend removal of accreditation of the school 6 district or school to the state board. 7 (g) Take any other enforcement mechanism available to the 8 director. 9 (4) The department shall focus enforcement activities on 10 all of the following: 11 (a) Improving educational results for children, families, 12 and students. 13 (b) Ensuring that public agencies and their governing 14 boards meet requirements of state and federal laws. 15 11. a. If the recommendation pursuant to subsection 10 16 is that a school district or nonpublic school not remain 17 accredited, the accreditation committee shall provide the 18 school district or nonpublic school with a report that includes 19 a list of all of the deficiencies, a plan prescribing the 20 actions that must be taken to correct the deficiencies, and 21 a deadline date for completion of the prescribed actions. 22 The accreditation committee shall advise the school district 23 or nonpublic school of available resources and technical 24 assistance to improve areas of weakness. The school district 25 or nonpublic school shall be provided with the opportunity 26 to respond to the accreditation committee’s report. The 27 director shall review the accreditation committee’s report 28 and the response of the school district or nonpublic school 29 and shall provide a report to the state board along with 30 copies of the accreditation committee’s report, the response 31 to the accreditation committee’s report, and other pertinent 32 information. At the request of the school district or 33 nonpublic school, the school district or nonpublic school may 34 appear before the state board and address the state board 35 -33- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 33/ 38
directly regarding any part of the plan specified in the 1 report. The state board may modify the plan. During the 2 period of time specified in the plan for its implementation by 3 a school district or nonpublic school, the school district or 4 school shall remain accredited. 5 b. The accreditation committee shall revisit the school 6 district or nonpublic school and shall determine whether the 7 deficiencies in the standards have been corrected. 8 c. The accreditation team shall make a report and 9 recommendation to the director and the state board. The 10 committee recommendation shall specify whether the school 11 district or nonpublic school shall remain accredited. For a 12 school district, the committee report and recommendation shall 13 also specify under what conditions the district may remain 14 accredited. The conditions may include but are not limited to 15 providing temporary oversight authority, operational authority, 16 or both oversight and operational authority to the director and 17 the state board for some or all aspects of the school district 18 in order to bring the school district into compliance with 19 minimum standards. 20 d. The state board shall review the report and 21 recommendation, may request additional information, and shall 22 determine whether the deficiencies have been corrected. 23 e. If the deficiencies have not been corrected, and the 24 conditional accreditation alternatives contained in the report 25 are not mutually acceptable to the state board and the local 26 board, the state board shall deaccredit the school district and 27 merge the territory of the school district with one or more 28 contiguous school districts at the end of the school year. The 29 state board may place a district under receivership for the 30 remainder of the school year. The receivership shall be under 31 the direct supervision and authority of the area education 32 agency in which the district is located. The decision of 33 whether to deaccredit the school district or to place the 34 district under receivership shall be based upon a determination 35 -34- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 34/ 38
by the state board of the best interests of the students, 1 parents, residents of the community, teachers, administrators, 2 and school district board members and upon the recommendations 3 of the accreditation committee and the director. 4 f. In the case of a nonpublic school, if the deficiencies 5 have not been corrected, the state board may deaccredit the 6 nonpublic school. The deaccreditation shall take effect on the 7 date established by the resolution of the state board, which 8 shall be no later than the end of the school year in which the 9 nonpublic school is deaccredited. 10 Sec. 25. Section 272.2, Code 2021, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 24. Establish, collect, and refund 13 fees from an administrator for the administrative costs 14 of processing complaints and conducting hearings if the 15 administrator is the respondent in a complaint for violation of 16 the code of professional conduct and ethics, developed pursuant 17 to subsection 1, for which final board action results in a 18 sanction against the administrator. 19 Sec. 26. Section 272.10, Code 2021, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 5. The fees established by the board 22 for the administrative costs of processing complaints and 23 conducting hearings pursuant to section 272.2, subsection 24, 24 may include a fee for personal service by a sheriff, a fee for 25 legal notice when placed in a newspaper, transcription service 26 or court reporter fee, and other fees assessed as costs by 27 the board. The fees collected annually in accordance with 28 this subsection shall be retained by and are appropriated to 29 the board for the purposes related to the board’s duties. 30 Notwithstanding section 8.33, fees retained by and appropriated 31 to the board pursuant to this subsection that remain 32 unencumbered or unobligated at the close of the fiscal year 33 shall not revert but shall remain available for expenditure for 34 the activities of the board as provided in this chapter until 35 -35- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 35/ 38
the close of the succeeding fiscal year. 1 Sec. 27. NEW SECTION . 279.8B Petition for public hearing. 2 1. Upon petition signed by eligible electors of a school 3 district equal in number to at least five percent of the 4 persons who voted in the last preceding election of school 5 officials under section 277.1, the board of directors of the 6 school district shall hold a public hearing on the proposal 7 specified in the petition. If the proposal relates to 8 curriculum, the school district may halt use of the subject 9 instructional materials until the school board holds the public 10 hearing and makes a decision regarding the proposal. 11 2. The board of directors of the school district shall 12 hold the public hearing within thirty days of receipt of the 13 petition filed in accordance with subsection 1. Notice of the 14 time and place of the public hearing shall be posted for public 15 viewing on the school district’s internet site for at least the 16 five days immediately preceding the public hearing. Notice 17 shall include a brief description of the proposal. 18 Sec. 28. Section 279.66, Code 2021, is amended to read as 19 follows: 20 279.66 Discipline and personal conduct standards. 21 1. The board of directors of a school district shall review 22 and modify existing policies related to student discipline 23 and student conduct that are designed to promote responsible 24 behavior on school property and at school functions in 25 order that the policy shall govern the conduct of students, 26 teachers and other school personnel, and visitors; provide 27 opportunities for students to exercise self-discipline 28 and practice cooperative classroom behavior; and encourage 29 students and practitioners to model fairness, equity, and 30 respect. The policy shall specify the responsibilities of 31 students, parents and guardians, and practitioners in creating 32 an atmosphere where all individuals feel a sense of respect, 33 safety, and belonging, and shall set forth the consequences for 34 unacceptable behavior. The policy shall be published in the 35 -36- SF 596.2409 (1) 89 amending this SF 596 to CONFORM to HF 868 kh/tm 36/ 38
student handbook. 1 2. The board of directors of a school district shall 2 include or reference in the student handbook guidance published 3 pursuant to section 256.9, subsection 63, by the department of 4 education for parents, guardians, and community members who 5 have concerns about school districts or their governing boards. 6 Sec. 29. NEW SECTION . 279.75 Training for equity 7 coordinators. 8 The board of directors of a school district shall provide 9 training on free speech under the first amendment to the 10 Constitution of the United States to any equity coordinator 11 employed by the school district. 12 Sec. 30. CODE EDITOR DIRECTIVE. The Code editor shall 13 correct and eliminate any references in this division of this 14 Act to Code section 279.73 or 279.74, as appropriate, if either 15 or both Code sections are not enacted by House File 744 or 16 House File 802, by the Eighty-ninth General Assembly, 2021 17 Regular Session, or any extraordinary session. 18 Sec. 31. TRANSITION PROVISION —— ACCREDITATION. School 19 districts and accredited nonpublic schools that are currently 20 accredited on the effective date of this division of this Act 21 shall remain accredited until the state board of education 22 adopts rules, and the department of education implements such 23 rules, to administer the accreditation process established 24 in accordance with section 256.11, subsections 10 and 11, as 25 amended by this division of this Act. > 26 2.
