Section 96.4, subsection 3, Code 2021, is amended 19 to read as follows: 20 3. a. The individual is able to work, is available for 21 work, and is earnestly and actively seeking work. This 22 subsection is waived if the individual is deemed partially 23 unemployed, while employed at the individual’s regular job, 24 as defined in section 96.1A, subsection 37 , paragraph “b” , 25 subparagraph (1), or temporarily unemployed as defined in 26 section 96.1A, subsection 37 , paragraph “c” . The work search 27 requirements of this subsection and the disqualification 28 requirement for failure to apply for, or to accept suitable 29 work of section 96.5, subsection 3 , are waived if the 30 individual is not disqualified for benefits under section 96.5, 31 subsection 1 , paragraph “h” . 32 b. for a claim for benefits if an individual has a reasonable 1 expectation that the individual will be returning to employment 2 and is attached to a regular job or industry or a member in 3 good standing of a union therein eligible for referral for 4 employment. To be considered attached to a regular job or 5 industry, an individual must be on a short-term temporary 6 layoff. If work is not available at the conclusion of the 7 layoff period due to short-term circumstances beyond the 8 employer’s control, the employer may request an extension 9 of the waiver or alteration for up to two weeks from the 10 department. For purposes of this paragraph, “short-term 11 temporary layoff” means a layoff period of sixteen weeks or 12 less due to seasonal weather conditions that impact the ability 13 to perform work related to highway construction, repair, or 14 maintenance with a specific return-to-work date verified by the 15 employer. 16 Sec. ___. EFFECTIVE DATE. 17 The section of this division of this Act amending section 18 96.4, subsection 3, being deemed of immediate importance, takes 19 effect upon enactment. 20 Sec. ___. APPLICABILITY. 21 The section of this division of this Act amending section 22 96.4, subsection 3, applies to any new claim of unemployment 23 benefits beginning on or after the first Sunday after the 24 effective date of that section. 25 DIVISION ___ 26 BOARD OF REVIEW —— MEMBER REMOVAL 27 Sec. ___. Section 441.32, Code 2021, is amended to read as 28 follows: 29 441.32 Terms —— vacancies. 30 1. The terms of the members of the board of review are 31 for six years each except for the emergency members whose 32 terms shall be set by the conference board for a period not to 33 exceed two years. Members of this board may be removed by the 34 conference board but only after a public hearing upon specified 35 -2- HF 871.2499 (3) 89 ko/tm 2/ 4
charges, if a hearing is requested by the member. A subsequent 1 appointment, and an appointment to fill a vacancy, shall be 2 made in the same way as the original selection. The board may 3 subpoena witnesses and administer oaths. 4 2. a. In addition to removal under subsection 1, the 5 director of revenue may remove a member of the board of review 6 if any of the following apply: 7 (1) The member violates any law or administrative rule 8 applicable to the member’s duties on the board of review. 9 (2) The member fails to comply with an order of the director 10 of revenue or an order of any court. 11 b. Prior to issuing an order removing a member of the board 12 of review, the director of revenue shall provide the member 13 with written notice of the director’s intent to remove the 14 member from the board of review. 15 c. If the member of the board of review receiving the notice 16 of intent for removal files a written request for a hearing 17 with the director within thirty days after receipt of the 18 written notice specified in paragraph “b”, the director shall 19 hold a hearing prior to the issuance of an order removing the 20 member from the board of review. The director may subpoena 21 witnesses and administer oaths in connection with the hearing. 22 d. If the director of revenue removes a member of the 23 board of review pursuant to this subsection, an appointment 24 to fill the vacancy shall be made in the same manner as the 25 original appointment. An order removing a member of the board 26 is subject to judicial review in accordance with chapter 17A. 27 e. The director of revenue shall adopt rules pursuant to 28 chapter 17A to administer this subsection. 29 DIVISION ___ 30 BEER AND LIQUOR CONTROL FUND —— TOURISM 31 Sec. ___. Section 123.17, Code 2021, is amended by adding 32 the following new subsection: 33 NEW SUBSECTION . 6A. a. After any transfers provided for in 34 subsections 3, 5, and 6, and before any other transfer to the 35 -3- HF 871.2499 (3) 89 ko/tm 3/ 4
general fund, the department of commerce shall transfer to the 1 economic development authority from the beer and liquor control 2 fund one million dollars annually for a statewide tourism 3 marketing campaign. 4 b. As part of the statewide tourism marketing campaign 5 pursuant to paragraph “a” , the economic development authority 6 shall issue a single request for proposals to select an entity 7 located in this state for a statewide effort to leverage public 8 and private partnerships to market and promote the state as a 9 travel destination. > 10 9.
