GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 21 1. For the fiscal year beginning July 1, 2021, the goals 22 for the economic development authority shall be to expand and 23 stimulate the state economy, increase the wealth of Iowans, and 24 increase the population of the state. 25 2. To achieve the goals in subsection 1, the economic 26 development authority shall do all of the following for the 27 fiscal year beginning July 1, 2021: 28 a. Concentrate its efforts on programs and activities that 29 result in commercially viable products and services. 30 b. Adopt practices and services consistent with free 31 market, private sector philosophies. 32 c. Ensure economic growth and development throughout the 33 state. 34 d. improve the economic development climate along with the 1 economic well-being and quality of life for Iowans. 2 e. Coordinate with other state agencies to ensure that they 3 are attentive to the needs of an entrepreneurial culture. 4 f. Establish a strong and aggressive marketing image to 5 showcase Iowa’s workforce, existing industry, and potential. 6 A priority shall be placed on recruiting new businesses, 7 business expansion, and retaining existing Iowa businesses. 8 Emphasis shall be placed on entrepreneurial development through 9 helping entrepreneurs secure capital, and developing networks 10 and a business climate conducive to entrepreneurs and small 11 businesses. 12 g. Encourage the development of communities and quality of 13 life to foster economic growth. 14 h. Prepare communities for future growth and development 15 through development, expansion, and modernization of 16 infrastructure. 17 i. Develop public-private partnerships with Iowa businesses 18 in the tourism industry, Iowa tour groups, Iowa tourism 19 organizations, and political subdivisions in this state to 20 assist in the development of advertising efforts. 21 j. Develop, to the fullest extent possible, cooperative 22 efforts for advertising with contributions from other sources. 23 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 24 1. APPROPRIATION 25 a. division, a business development division, a community 1 development division, a small business development division, 2 and other divisions the authority may organize. 3 (2) The full-time equivalent positions authorized under 4 this section are funded, in whole or in part, by the moneys 5 appropriated under this subsection or by other moneys received 6 by the authority, including certain federal moneys. 7 (3) For business development operations and programs, 8 international trade, export assistance, workforce recruitment, 9 and the partner state program. 10 (4) For transfer to a fund created pursuant to section 11 15.313 for purposes of financing strategic infrastructure 12 projects. 13 (5) For community economic development programs, tourism 14 operations, community assistance, plans for Iowa green corps 15 and summer youth programs, the main street and rural main 16 street programs, the school-to-career program, the community 17 development block grant, and housing and shelter-related 18 programs. 19 (6) For achieving the goals and accountability, and 20 fulfilling the requirements and duties required under this Act. 21 c. Notwithstanding section 8.33, moneys appropriated in 22 this subsection that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available for expenditure for the purposes designated in this 25 subsection until the close of the succeeding fiscal year. 26 2. FINANCIAL ASSISTANCE RESTRICTIONS 27 a. A business creating jobs through moneys appropriated in 28 subsection 1 shall be subject to contract provisions requiring 29 new and retained jobs to be filled by individuals who are 30 citizens of the United States who reside within the United 31 States, or any person authorized to work in the United States 32 pursuant to federal law, including legal resident aliens 33 residing in the United States. 34 b. Any vendor who receives moneys appropriated in 35 -4- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 4/ 29
subsection 1 shall adhere to such contract provisions and 1 provide periodic assurances as the state shall require that the 2 jobs are filled solely by citizens of the United States who 3 reside within the United States, or any person authorized to 4 work in the United States, pursuant to federal law, including 5 legal resident aliens residing in the United States. 6 c. A business that receives financial assistance from 7 the authority from moneys appropriated in subsection 1 shall 8 only employ individuals legally authorized to work in this 9 state. In addition to all other applicable penalties provided 10 by current law, all or a portion of the assistance received 11 by a business which is found to knowingly employ individuals 12 not legally authorized to work in this state is subject to 13 recapture by the authority. 14 3. USES OF APPROPRIATIONS 15 a. From the moneys appropriated in subsection 1, the 16 authority may provide financial assistance in the form of a 17 grant to a community economic development entity for conducting 18 a local workforce recruitment effort designed to recruit former 19 citizens of the state and former students at colleges and 20 universities in the state to meet the needs of local employers. 21 b. From the moneys appropriated in subsection 1, the 22 authority may provide financial assistance to early stage 23 industry companies being established by women entrepreneurs. 24 c. From the moneys appropriated in subsection 1, the 25 authority may provide financial assistance in the form of 26 grants, loans, or forgivable loans for advanced research and 27 commercialization projects involving value-added agriculture, 28 advanced technology, or biotechnology. 29 d. The authority shall not use any moneys appropriated in 30 subsection 1 for purposes of providing financial assistance for 31 the Iowa green streets pilot project or for any other program 32 or project that involves the installation of geothermal systems 33 for melting snow and ice from streets or sidewalks. 34 4. Notwithstanding the standing appropriations 19 in the following designated sections for the fiscal year 20 beginning July 1, 2021, and ending June 30, 2022, the amounts 21 appropriated from the general fund of the state pursuant to 22 these sections for the following purposes shall not exceed the 23 following amounts: 24 1. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 32 DEVELOPMENT AUTHORITY. The economic development authority and 33 the department of revenue shall submit a joint annual report 34 to the general assembly no later than November 1, 2021, that 35 -9- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 9/ 29
details the amount of every direct loan, forgivable loan, 1 tax credit, tax exemption, tax refund, grant, or any other 2 financial assistance awarded to a person during the prior 3 fiscal year by the authority under an economic development 4 program administered by the authority. The report shall 5 identify the county where the project associated with each such 6 award is located. 7 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 8 moneys collected by the insurance division in excess of the 9 anticipated gross revenues under section 505.7, subsection 10 3 , during the fiscal year beginning July 1, 2021, $100,000 11 shall be transferred to the economic development authority for 12 insurance economic development and international insurance 13 economic development. 14 Sec. 7. IOWA FINANCE AUTHORITY. 15 1. There is appropriated from the general fund of the state 16 to the Iowa finance authority for the fiscal year beginning 17 July 1, 2021, and ending June 30, 2022, the following amount, 18 or so much thereof as is necessary, to be used to provide 19 reimbursement for rent expenses to eligible persons under 20 the home and community-based services rent subsidy program 21 established in section 16.55: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 23 2. b. The division of workers’ compensation shall charge a 1 $100 filing fee for workers’ compensation cases. The filing 2 fee shall be paid by the petitioner of a claim. However, 3 the fee can be taxed as a cost and paid by the losing party, 4 except in cases where it would impose an undue hardship or be 5 unjust under the circumstances. The moneys generated by the 6 filing fee allowed under this paragraph are appropriated to the 7 department of workforce development to be used for purposes of 8 administering the division of workers’ compensation. 9 3. Notwithstanding 6 section 96.9, subsection 4 , paragraph “a”, moneys credited to 7 the state by the secretary of the treasury of the United 8 States pursuant to section 903 of the Social Security 9 Act are appropriated to the department of workforce 10 development and shall be used by the department for the 11 administration of the unemployment compensation program only. 12 This appropriation shall not apply to any fiscal year 13 beginning after December 31, 2021. 14 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND. 15 1. There is appropriated from the Iowa skilled worker and 16 job creation fund created in section 8.75 to the following 17 departments, agencies, and institutions for the fiscal year 18 beginning July 1, 2021, and ending June 30, 2022, the following 19 amounts, or so much thereof as is necessary, to be used for the 20 purposes designated: 21 a. The match required of 22 small businesses as defined in section 15.102, subsection 10, 23 for directed contract research or for nondirected research 24 shall be $1 for each $3 of state funds. The match required 25 for other businesses for directed contract research or 26 for nondirected research shall be $1 for each $1 of state 27 funds. DIVISION III 1 FIBEROPTIC NETWORK CONDUIT INSTALLATION AND CERTIFICATION 2 PROGRAM 3 Sec. 22. Section 8B.25, subsection 2, Code 2021, is amended 4 to read as follows: 5 2. The office shall lead and coordinate a program to provide 6 for the installation of fiberoptic network conduit where such 7 conduit does not exist. The chief information officer shall 8 consult and coordinate with applicable agencies and entities , 9 including public utilities as defined in section 476.1, the 10 state department of transportation, the economic development 11 authority, county boards of supervisors, municipal governing 12 bodies, the farm-to-market review board, county conservation 13 boards, and the boards, commissions, or agencies in control 14 of state parks, as determined appropriate to ensure that the 15 opportunity is provided to lay or install fiberoptic network 16 conduit wherever a state-funded construction project involves 17 trenching, boring, a bridge, a roadway, or opening of the 18 ground, or alongside any state-owned infrastructure. 19 Sec. 23. NEW SECTION . 15E.167 Broadband forward and 20 telecommuter forward —— certifications. 21 1. As used in this section, unless the context requires 22 otherwise: 23 a. “Broadband” means the same as defined in section 8B.1. 24 b. “Broadband infrastructure” means the same as defined in 25 section 8B.1. 26 c. “Communications service provider” means a service 27 provider that provides broadband service. 28 d. “Political subdivision” means a city, county, or 29 township. 30 2. The authority shall establish the following 31 certification programs: 32 a. Broadband forward certification, with the objective of 33 encouraging political subdivisions to further develop broadband 34 infrastructure and access to broadband. 35 -22- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 22/ 29
b. Telecommuter forward certification, with the objective 1 of encouraging political subdivisions to further develop and 2 promote the availability of telecommuting. 3 3. To obtain broadband forward certification, a political 4 subdivision shall submit to the authority, on forms prescribed 5 by the authority by rule, an application indicating the 6 following: 7 a. The political subdivision’s support and commitment to 8 promote the availability of broadband. 9 b. Existing or proposed ordinances encouraging the 10 further development of broadband infrastructure and access to 11 broadband. 12 c. Efforts to secure local funding for the further 13 development of broadband infrastructure and access to 14 broadband. 15 d. A single point of contact for all matters related to 16 broadband and broadband infrastructure. 17 4. A single point of contact designated in an application 18 submitted pursuant to subsection 3 shall be responsible for all 19 of the following: 20 a. Coordination and partnership with the authority, 21 communications service providers, realtors, economic 22 development professionals, employers, employees, and other 23 broadband stakeholders. 24 b. Collaboration with the authority, communication service 25 providers, and employers to identify, develop, and market 26 broadband packages available in the political subdivision. 27 c. Familiarity with broadband mapping tools and other 28 state-level resources. 29 d. Maintaining regular communication with the authority. 30 e. Providing to the political subdivision regular reports 31 regarding the availability of broadband in the political 32 subdivision. 33 5. A political subdivision that the authority has certified 34 as a broadband forward community under subsection 3 shall not 35 -23- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 23/ 29
do any of the following: 1 a. Require an applicant to designate a final contractor to 2 complete a broadband infrastructure project. 3 b. Impose a fee to review an application or issue a permit 4 for a broadband infrastructure application in excess of one 5 hundred dollars. 6 c. Impose a moratorium of any kind on the approval 7 of applications and issuance of permits for broadband 8 infrastructure projects or on construction related to broadband 9 infrastructure. 10 d. Discriminate among communications service providers, 11 or public utilities with respect to any action described in 12 this section or otherwise related to broadband infrastructure, 13 including granting access to public rights-of-way, 14 infrastructure and poles, river and bridge crossings, or any 15 other physical assets owned or controlled by the political 16 subdivision. 17 e. As a condition for approving an application or issuing a 18 permit for a broadband infrastructure project or for any other 19 purpose, require the applicant to do any of the following: 20 (1) Provide any service or make available any part of the 21 broadband infrastructure to the political subdivision. 22 (2) Except for the fee allowed under paragraph “b” of this 23 subsection, make any payment to or on behalf of the political 24 subdivision. 25 6. To obtain telecommuter forward certification, a 26 political subdivision shall submit to the authority, on forms 27 prescribed by the authority by rule, an application indicating 28 the following: 29 a. The political subdivision’s support and commitment to 30 promote the availability of telecommuting options. 31 b. Existing or proposed ordinances encouraging the further 32 development of telecommuting options. 33 c. d. A single point of contact for coordinating telecommuting 1 opportunities and options: 2 7. Coordination and partnership with the authority, 6 communications service providers, realtors, economic 7 development professionals, employers, employees, and other 8 telecommuting stakeholders. 9 b. Collaboration with the authority, communication service 10 providers, and employers to identify, develop, and market 11 telecommuter-capable broadband packages available in the 12 political subdivision. 13 c. Promotion of telecommuter-friendly workspaces, such 14 as business incubators with telecommuting spaces, if such a 15 workspace has been established in the political subdivision at 16 the time the political subdivision submits the application. 17 d. Familiarity with broadband mapping tools and other 18 state-level resources. 19 e. Maintaining regular communication with the authority. 20 f. Providing to the political subdivision regular reports 21 regarding the availability of telecommuting options in the 22 political subdivision. 23 8. The authority shall develop criteria for evaluating an 24 application for both forms of certification and the awarding 25 of certificates. The criteria shall take into account, at 26 a minimum, the applicant’s individual circumstances and the 27 economic goals of the applicant. The authority shall consult 28 with local government entities and local economic development 29 officials when evaluating an application. 30 9. The authority shall adopt rules pursuant to chapter 17A 31 for the implementation of this section. 32 DIVISION IV 33 WORKFORCE DEVELOPMENT FUND ACCOUNT 34 Sec. 24. Section 15.342A, subsections 1 and 3, Code 2021, 35 -25- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 25/ 29
are amended to read as follows: 1 1. A workforce development fund account is established in 2 the office of the treasurer of state under the control of the 3 authority. The account shall receive funds pursuant to section 4 422.16A up to a maximum of six million dollars per year . 5 3. For the fiscal year beginning July 1, 2014, and for each 6 fiscal year thereafter, there is annually appropriated from the 7 workforce development fund account to the job training fund 8 created in section 260F.6 three four million seven hundred 9 fifty thousand dollars for the purposes of chapter 260F . 10 Sec. 25. Section 422.16A, Code 2021, is amended to read as 11 follows: 12 422.16A Job training withholding —— certification and 13 transfer. 14 Upon the completion by a business of its repayment 15 obligation for a training project funded under chapter 260E , 16 including a job training project funded under section 15A.8 17 or repaid in whole or in part by the supplemental new jobs 18 credit from withholding under section 15A.7 or section 15E.197, 19 Code 2014, the sponsoring community college shall report to 20 the economic development authority the amount of withholding 21 paid by the business to the community college during the 22 final twelve months of withholding payments. The economic 23 development authority shall notify the department of revenue 24 of that amount. The department shall credit to the workforce 25 development fund account established in section 15.342A 26 twenty-five percent of that amount each quarter for a period 27 of ten years. If the amount of withholding from the business 28 or employer is insufficient, the department shall prorate the 29 quarterly amount credited to the workforce development fund 30 account. The maximum amount from all employers which shall be 31 transferred to the workforce development fund account in any 32 year is six seven million seven hundred fifty thousand dollars. 33 DIVISION V 34 ENERGY INFRASTRUCTURE REVOLVING LOAN PROGRAM 35 -26- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 26/ 29
Sec. 26. Section 476.10A, subsection 2, Code 2021, is 1 amended to read as follows: 2 2. Notwithstanding section 8.33 , any unexpended moneys 3 remitted to the treasurer of state under this section shall be 4 retained for the purposes designated. Notwithstanding section 5 12C.7, subsection 2 , interest or earnings on investments or 6 time deposits of the moneys remitted under this section shall 7 be retained and used for the purposes designated, pursuant to 8 section 476.46 . 9 Sec. 27. Section 476.46, subsection 2, paragraph e, 10 subparagraph (3), Code 2021, is amended to read as follows: 11 (3) Interest on the fund shall be deposited in the fund. 12 A portion of the interest on the fund, not to exceed fifty 13 percent of the total interest accrued, shall be used for 14 promotion and administration of the fund. 15 Sec. 28. Section 476.46, Code 2021, is amended by adding the 16 following new subsections: 17 NEW SUBSECTION . 3. The Iowa energy center shall not 18 initiate any new loans under this section after June 30, 2021. 19 NEW SUBSECTION . 4. Loan payments received under this 20 section on or after July 1, 2021, and any other moneys in the 21 fund on or after July 1, 2021, shall be deposited in the energy 22 infrastructure revolving loan fund created in section 476.46A. 23 Sec. 29. NEW SECTION . 476.46A Energy infrastructure 24 revolving loan program. 25 1. a. An energy infrastructure revolving loan fund is 26 created in the office of the treasurer of state and shall be 27 administered by the Iowa energy center established in section 28 15.120. 29 b. The fund may be administered as a revolving fund and may 30 consist of any moneys appropriated by the general assembly for 31 purposes of this section and any other moneys that are lawfully 32 directed to the fund. 33 c. Moneys in the fund shall be used to provide financial 34 assistance for the development and construction of energy 35 -27- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 27/ 29
infrastructure, including projects that support electric or gas 1 generation transmission, storage, or distribution; electric 2 grid modernization; energy-sector workforce development; 3 emergency preparedness for rural and underserved areas; the 4 expansion of biomass, biogas, and renewable natural gas; 5 innovative technologies; and the development of infrastructure 6 for alternative fuel vehicles. 7 d. Notwithstanding section 8.33, moneys appropriated in this 8 section that remain unencumbered or unobligated at the close of 9 the fiscal year shall not revert but shall remain available for 10 expenditure for the purposes designated until the close of the 11 succeeding fiscal year. 12 e. Notwithstanding section 12C.7, subsection 2, interest 13 or earnings on moneys in the fund shall be credited to the 14 fund. A percentage of the total interest credited to the fund, 15 not to exceed fifty percent, shall be used for promotion of 16 the energy infrastructure revolving loan program and for the 17 administration of the fund. 18 2. a. The Iowa energy center shall establish and administer 19 an energy infrastructure revolving loan program to encourage 20 the development of energy infrastructure within the state. 21 b. An individual, business, rural electric cooperative, or 22 municipal utility located and operating in this state shall be 23 eligible for financial assistance under the program. With the 24 approval of the Iowa energy center governing board established 25 under section 15.120, subsection 2, the economic development 26 authority shall determine the amount and the terms of all 27 financial assistance awarded to an individual, business, rural 28 electric cooperative, or municipal utility under the program. 29 All agreements and administrative authority sha11 be vested in 30 the Iowa energy center governing board. 31 c. The economic development authority may use not more than 32 five percent of the moneys in the fund at the beginning of each 33 fiscal year for purposes of administrative costs, marketing, 34 technical assistance, and other program support. 35 -28- SF 595.2408 (2) 89 (amending this SF 595 to CONFORM to HF 871) ko/tm 28/ 29
3. For the purposes of this section: 1 a. “Energy infrastructure” means land, buildings, physical 2 plant and equipment, and services directly related to the 3 development of projects used for, or useful for, electricity or 4 gas generation, transmission, storage, or distribution. 5 b. “Financial assistance” means the same as defined in 6 section 15.102. 7 Sec. 30. ALTERNATE ENERGY REVOLVING LOAN FUND —— MONEYS 8 TRANSFERRED AND APPROPRIATED. Any unencumbered or unobligated 9 moneys remaining after June 30, 2021, in the alternate energy 10 revolving loan fund created pursuant to section 476.46, are 11 transferred and appropriated to the energy infrastructure 12 revolving loan fund created pursuant to section 476.46A, to be 13 used for purposes of the energy infrastructure revolving loan 14 program. 15 DIVISION VI 16 NATIONAL ELECTRICAL CODE 17 Sec. 31. 2020 EDITION OF THE NATIONAL ELECTRICAL 18 CODE. Amendments adopted by rule by the electrical examining 19 board pursuant to section 103.6, subsection 1, to the 2020 20 edition of the national electrical code issued and adopted by 21 the national fire protection association, which amendments 22 were effective as of May 1, 2021, shall not expire, and shall 23 remain in effect until, at minimum, the effective date of rules 24 adopted by the board adopting either of the following: 25 1. A subsequent edition of the national electrical code. 26 2. Subsequent amendments, issued and adopted by the 27 national fire protection association, to the 2020 edition of 28 the national electrical code. > 29 2.
