By striking page 1, line 1, through page 3, line 29, and 3 inserting: 4 < DIVISION I 5 CRIMES RELATING TO ASSISTED REPRODUCTION 6 Section 1. Section 147.55, Code 2021, is amended by adding 7 the following new subsection: 8 NEW SUBSECTION . 7A. Sexual abuse in the fourth degree in 9 violation of section 709.4A. 10 Sec. ___. Section 692A.102, subsection 1, paragraph c, Code 11 2021, is amended by adding the following new subparagraph: 12 NEW SUBPARAGRAPH . (012) Sexual abuse in the fourth degree 13 in violation of section 709.4A. 14 Sec. ___. NEW SECTION . 709.4A Sexual abuse in the fourth 15 degree. 16 1. A health care professional commits sexual abuse in the 17 fourth degree when the health care professional implants the 18 health care professional’s own human reproductive material 19 through assisted reproduction without the patient’s prior 20 knowledge and written consent. 21 2. Sexual abuse in the fourth degree is an aggravated 22 misdemeanor. 23 3. For the purposes of this section: 24 a. “Assisted reproduction” means a method of causing 25 pregnancy other than sexual intercourse involving medical or 26 scientific intervention. 27 b. “Gamete” means a sperm, an egg, or any part of a sperm 28 or an egg. 29 c. “Health care professional” means a person who is 30 licensed, certified, or otherwise authorized or permitted by 31 the law of this state to administer health care in the ordinary 32 course of business or in the practice of a profession. 33 d. “Human reproductive material” means a human gamete or a 34 human organism at any stage of development from fertilized ovum 35 -1- SF 529.2246.H (1) 89 md 1/ 2 #1.
