Section 331.301, Code 2021, is amended by adding 4 the following new subsection: 5 NEW SUBSECTION . 18. a. A county shall not adopt, enforce, 6 or otherwise administer an ordinance, motion, resolution, 7 or amendment, or use any other means, to restrict, impede, 8 regulate, or prohibit, intentionally or effectively, any of the 9 following: 10 (1) The provision of natural gas service by a public utility 11 as defined in section 476.1, a competitive natural gas provider 12 as defined in section 476.86, or a retail propane marketer or 13 retail propane dispenser as those terms are defined in section 14 101C.2 to a person, business, municipality, or other wholesale 15 or retail customer within or outside the county. 16 (2) The purchase of natural gas or propane from a 17 competitive natural gas provider as defined in section 476.86 18 or a retail propane marketer or retail propane dispenser as 19 those terms are defined in section 101C.2, or the receipt of 20 natural gas or propane service from a public utility as defined 21 in section 476.1, by any person, business, municipality, or 22 other wholesale or retail customer within or outside the 23 county. 24 b. Paragraph “a” does not apply to an ordinance, motion, 25 resolution, or amendment that regulates a retail propane 26 marketer or retail propane dispenser, as those terms are 27 defined in section 101C.2, adopted before the effective date 28 of this Act. 29 Sec. 2. Section 364.3, Code 2021, is amended by adding the 30 following new subsection: 31 NEW SUBSECTION . 13. a. following: 1 (1) The provision of natural gas service by a public utility 2 as defined in section 476.1, a competitive natural gas provider 3 as defined in section 476.86, or a retail propane marketer or 4 retail propane dispenser as those terms are defined in section 5 101C.2 to a person, business, municipality, or other wholesale 6 or retail customer within or outside the incorporated area of 7 the city. 8 (2) The purchase of natural gas or propane from a 9 competitive natural gas provider as defined in section 476.86 10 or a retail propane marketer or retail propane dispenser as 11 those terms are defined in section 101C.2, or the receipt of 12 natural gas or propane service from a public utility as defined 13 in section 476.1, by any person, business, municipality, or 14 other wholesale or retail customer within or outside the 15 incorporated area of the city. 16 b.
