a.
If
a
nonpublic
school
accepts
payment
for

qualified
educational
expenses
from
a
pupil’s
account
in
the

student
first
scholarship
fund,
the
nonpublic
school
shall
not
6
discriminate
in
the
school’s
student
admissions
policies
or
7
practices
on
the
basis
of
intellectual
or
athletic
ability,
8
measures
of
achievement
or
aptitude,
or
status
as
a
person
9
with
a
disability,
and
shall
not
deny
admission
to
any
pupil
10
participating
in
the
student
first
scholarship
program
if
the
11
pupil
applying
for
admission
is
of
an
appropriate
age
for
the
12
grade
level
offered
by
the
nonpublic
school.

b.
If
a
nonpublic
school
accepts
payment
for
qualified
14
educational
expenses
from
a
pupil’s
account
in
the
student
15
first
scholarship
fund,
the
nonpublic
school
shall
provide
all

necessary
and
appropriate
instruction
and
services
for
the

pupil
including
but
not
limited
to
special
education
as
defined
18
in
section
256B.2,
for
children
requiring
special
education
and
19
pupils
with
a
disability,
whether
or
not
the
pupil
has
been
20
identified
as
a
child
requiring
special
education
under
chapter
21
256B,
services
related
to
a
pupil’s
individualized
education
22
program
or
behavioral
intervention
plan,
and
instruction
for
23
students
identified
as
limited
English
proficient.
