of high-priority watersheds identified by the water resources 1 coordinating council. 2 (b) The moneys appropriated in this lettered paragraph 3 shall be used to support demonstration projects in watersheds 4 generally, including regional watersheds, as designated by the 5 division and high-priority watersheds identified by the water 6 resources coordinating council. 7 (3) In supporting projects in watersheds and subwatersheds 8 as provided in subparagraph (2), all of the following shall 9 apply: 10 (a) The demonstration projects shall utilize water quality 11 practices as described in the latest revision of the document 12 entitled “Iowa Nutrient Reduction Strategy” initially presented 13 in November 2012 by the department of agriculture and land 14 stewardship, the department of natural resources, and Iowa 15 state university of science and technology. 16 (b) The division shall implement demonstration projects 17 as provided in subparagraph division (a) by providing 18 for participation by persons who hold a legal interest in 19 agricultural land used in farming. To every extent practical, 20 the division shall provide for collaborative participation by 21 such persons who hold a legal interest in agricultural land 22 located within the same subwatershed. 23 (c) The division shall implement demonstration projects on 24 a cost-share basis as determined by the division. Except for 25 edge-of-field practices, the state’s share of the amount shall 26 not exceed 50 percent of the estimated cost of establishing the 27 practice as determined by the division or 50 percent of the 28 actual cost of establishing the practice, whichever is less. 29 (d) The demonstration projects shall be used to educate 30 other persons about the feasibility and value of establishing 31 similar water quality practices. The division shall promote 32 field day events for purposes of allowing interested persons to 33 establish water quality practices on their agricultural land. 34 (e) The division shall conduct water quality evaluations 35 -2- HF 2579.4589.S (2) 89 mb 2/ 26
within supported subwatersheds. Within a reasonable period 1 after accumulating information from such evaluations, the 2 division shall create an aggregated database of water quality 3 practices. Any information identifying a person holding a 4 legal interest in agricultural land or specific agricultural 5 land shall be a confidential record. 6 (4) The moneys appropriated in this lettered paragraph 7 shall be used to support education and outreach in a manner 8 that encourages persons who hold a legal interest in 9 agricultural land used for farming to implement water quality 10 practices, including the establishment of such practices in 11 watersheds generally, and not limited to subwatersheds or 12 high-priority watersheds. 13 (5) The moneys appropriated in this lettered paragraph 14 may be used to contract with persons to coordinate the 15 implementation of efforts provided in this paragraph. 16 (6) The moneys appropriated in this lettered paragraph 17 may be used by the department to support urban soil and water 18 conservation efforts, which may include but are not limited 19 to management practices related to bioretention, landscaping, 20 the use of permeable or pervious pavement, and soil quality 21 restoration. The moneys shall be allocated on a cost-share 22 basis as provided in chapter 161A . 23 (7) Notwithstanding any other provision of law to the 24 contrary, the department may use moneys appropriated in 25 this lettered paragraph to carry out the provisions of this 26 paragraph on a cost-share basis in combination with other 27 moneys available to the department from a state or federal 28 source. 29 (8) Not more than 10 percent of the moneys appropriated in 30 this lettered paragraph may be used for costs of administration 31 and implementation of the water quality initiative administered 32 by the soil conservation division. 33 b. Sec. 14. Section 8.57C, subsection 3, Code 2022, is amended 1 by adding the following new paragraph: 2 NEW PARAGRAPH . j. There is appropriated from the rebuild 3 Iowa infrastructure fund for the fiscal year beginning July 1, 4 2022, and ending June 30, 2023, the sum of twenty million five 5 hundred thousand dollars to the technology reinvestment fund, 6 notwithstanding section 8.57, subsection 5, paragraph “c” . 7 Sec. 15. Section 15.261, Code 2022, is amended to read as 8 follows: 9 15.261 Vacant state buildings demolition fund. 10 1. A vacant state buildings demolition fund is created in 11 the state treasury under the control of the authority. The 12 fund shall consist of all moneys appropriated to the fund. 13 2. Moneys in the vacant state buildings demolition fund 14 are appropriated to the authority for purposes of funding a 15 grant program for the demolition of vacant buildings owned by 16 the state or by a county that has purchased real property from 17 the federal government which are no longer used for a state or 18 federal purpose. Grant program criteria shall provide that 19 no more than fifty percent of the cost of a project for the 20 demolition of vacant buildings shall be funded from a grant 21 under the program. The authority shall give preference to 22 applicants that have not previously been awarded money from 23 this fund. 24 3. Notwithstanding section 12C.7, subsection 2 , interest 25 or earnings on moneys deposited in the vacant state buildings 26 demolition fund shall be credited to the vacant state buildings 27 demolition fund. Notwithstanding section 8.33 , moneys credited 28 to the vacant state buildings demolition fund shall not revert 29 at the close of a fiscal year. 30 Sec. 16. Section 15.262, Code 2022, is amended to read as 31 follows: 32 15.262 Vacant state buildings rehabilitation fund. 33 1. A vacant state buildings rehabilitation fund is created 34 in the state treasury under the control of the authority. The 35 -18- HF 2579.4589.S (2) 89 mb 18/ 26
fund shall consist of all moneys appropriated to the fund. 1 2. Moneys in the vacant state buildings rehabilitation fund 2 are appropriated to the authority for purposes of funding a 3 loan program for the rehabilitation or redevelopment of vacant 4 buildings owned by the state or by a county that has purchased 5 real property from the federal government which are no longer 6 used for a state or federal purpose. The authority shall give 7 preference to applicants that have not previously been awarded 8 money from this fund. 9 3. Notwithstanding section 12C.7, subsection 2 , interest 10 or earnings on moneys deposited in the vacant state buildings 11 rehabilitation fund shall be credited to the vacant state 12 buildings rehabilitation fund. Notwithstanding section 8.33 , 13 moneys credited to the vacant state buildings rehabilitation 14 fund shall not revert at the close of a fiscal year. 15 Sec. 17. Section 159A.16, subsection 3, Code 2022, is 16 amended to read as follows: 17 3. Moneys in the renewable fuel infrastructure fund are 18 appropriated to the department exclusively to support and 19 market the renewable fuel infrastructure programs as provided 20 in sections 159A.14 and 159A.15 , and as allocated in financial 21 incentives by the renewable fuel infrastructure board created 22 in section 159A.13 . Up to fifty 23 a. For each fiscal year, not more than one million 24 two hundred fifty thousand dollars shall be allocated to 25 support the renewable fuel infrastructure program for retail 26 motor fuel sites as provided in section 159A.14 to finance 27 the installation, replacement, or conversion of biodiesel 28 infrastructure as provided in that section. 29 b. For each fiscal year, not more than one hundred thousand 30 dollars shall be allocated each fiscal year to the department 31 to support the administration of the programs. The 32 c. For each fiscal year, the department may use up to 33 three quarters of one and one-half percent of the program 34 funds to market the programs. Otherwise the moneys shall not 35 -19- HF 2579.4589.S (2) 89 mb 19/ 26
be transferred, used, obligated, appropriated, or otherwise 1 encumbered except to allocate as financial incentives under the 2 programs. 3 Sec. 18. Section 602.11101, subsection 1, paragraph e, 4 subparagraph (2), Code 2022, is amended to read as follows: 5 (2) Until July 1, 1986, the county shall remain responsible 6 for the compensation of and operating costs for court 7 employees not presently designated for state financing and 8 for miscellaneous costs of the judicial branch related to 9 furnishings, supplies, and equipment purchased, leased, or 10 maintained for the use of judicial officers, referees, and 11 their staff. Effective July 1, 1986, the state shall assume 12 the responsibility for the compensation of and operating costs 13 for court employees presently designated for state financing 14 and for miscellaneous costs of the judicial branch related to 15 furnishings, supplies, and equipment purchased, leased, or 16 maintained for the use of judicial officers, referees, and 17 their staff. However, the county shall at all times remain 18 responsible for the provision of suitable courtrooms, offices, 19 and other physical facilities pursuant to section 602.1303, 20 subsection 1 , including paint, wall covering, and fixtures in 21 the facilities. In addition, however, effective July 1, 2023, 22 if a county expends moneys for the renovation or construction 23 of suitable courtrooms, offices, and other physical facilities 24 pursuant to section 602.1303, that requires the purchase of 25 furnishings, supplies, and equipment for the use of judicial 26 officers, referees, and their staff as a result of that 27 renovation or construction, the state shall be responsible for 28 only seventy-five percent of the cost of the purchase. 29 Sec. 19. DES MOINES AREA REGIONAL TRANSIT AUTHORITY 30 ALTERNATIVE FUNDING ADVISORY COMMITTEE —— REPORT. 31 1. The department of transportation shall establish a Des 32 Moines area regional transit authority alternative funding 33 advisory committee to study the most effective and efficient 34 methods to increase funding for the Des Moines area regional 35 -20- HF 2579.4589.S (2) 89 mb 20/ 26
transit authority that are alternative to an increase in 1 property taxes. 2 2. The committee shall consist of five voting members and 3 four ex officio, nonvoting members. 4 a. The voting members of the committee shall be composed of 5 all of the following: 6 (1) The director of the department of transportation or a 7 designee. 8 (2) The director of the department of revenue or a designee. 9 (3) A Polk county supervisor appointed by the governor. 10 (4) A member of a city council or mayor of a city in Polk 11 county in which the Des Moines area regional transit authority 12 operates, appointed by the governor. 13 (5) A representative of the Des Moines area regional transit 14 authority appointed by the Des Moines area regional transit 15 authority. 16 b. The ex officio, nonvoting members of the committee shall 17 be two state representatives, one appointed by the speaker of 18 the house of representatives and one by the minority leader 19 of the house of representatives, and two state senators, one 20 appointed by the majority leader of the senate and one by the 21 minority leader of the senate. 22 3. Staffing services shall be provided by the department of 23 transportation in coordination with the department of revenue. 24 4. The committee shall submit a report containing its 25 findings and recommendations to the general assembly on or 26 before December 15, 2022. 27 5. This section is repealed January 1, 2023. 28 Sec. 20. EFFECTIVE DATE. The following, being deemed of 29 immediate importance, take effect upon enactment: 30 The sections of this division of this Act amending sections 31 15.261 and 15.262. 32 Sec. 21. 15.261 and 15.262. 1 DIVISION V 2 SPORTS TOURISM PROGRAM 3 Sec. 22. Section 15F.401, subsection 1, paragraph a, Code 4 2022, is amended to read as follows: 5 a. The authority shall establish, and, at the direction 6 of the board, shall administer a sports tourism marketing and 7 infrastructure program to provide financial assistance for 8 projects that promote sporting events or for infrastructure 9 projects supporting sporting events for organizations of 10 accredited colleges and universities, professional sporting 11 events, and other sporting events in the state. 12 Sec. 23. Section 15F.401, subsection 2, paragraph a, Code 13 2022, is amended to read as follows: 14 a. (1) A city or county in the state or a public entity, 15 including a convention and visitors bureau or a district, may 16 apply to the authority for financial assistance from the sports 17 tourism marketing program fund created in section 15F.403 for 18 a project that actively and directly promotes sporting events 19 for accredited colleges and universities, professional sporting 20 events, and other sporting events in the area served by the 21 city, county, or public entity. 22 (2) A city or county in the state or a public entity that 23 is a convention and visitors bureau or a district may apply to 24 the authority for financial assistance from the sports tourism 25 infrastructure program fund created in section 15F.404 for an 26 infrastructure project that actively and directly supports 27 sporting events for accredited colleges and universities, 28 professional sporting events, and other sporting events in the 29 area served by the city, county, or public entity. However, 30 financial assistance shall not be provided to an applicant 31 from the sports tourism infrastructure program fund created 32 in section 15F.404 for infrastructure projects located in a 33 reinvestment district as defined and approved by the authority 34 pursuant to section 15J.4 or to applicants that have received a 35 -22- HF 2579.4589.S (2) 89 mb 22/ 26
rebate of sales tax imposed and collected by retailers pursuant 1 to section 423.4, subsection 5. 2 Sec. 24. Section 15F.401, subsections 4, 5, and 6, Code 3 2022, are amended to read as follows: 4 4. a. An applicant shall demonstrate matching funds in 5 order to receive financial assistance pursuant to this section . 6 The amount of matching funds that may be required shall be at 7 the board’s discretion subject to the requirements of this 8 subsection . 9 b. An applicant under the program shall not receive 10 financial assistance from the sports tourism marketing 11 program fund created in section 15F.403 or the sports tourism 12 infrastructure program fund created in section 15F.404 in 13 an amount exceeding fifty percent of the total cost of the 14 project. 15 c. An applicant under the program shall not receive 16 financial assistance from the sports tourism infrastructure 17 program fund created in section 15F.404 until all financing 18 for the sports tourism infrastructure project is secured and 19 documented and the applicant can demonstrate the availability 20 of matching moneys for financing the sports tourism 21 infrastructure project in the form of a private and public 22 partnership with financing from city, county, and private 23 sources. 24 5. The board shall make final funding decisions on 25 each application and may approve, deny, defer, or modify 26 applications for financial assistance under the sports tourism 27 marketing and infrastructure program, in its discretion, in 28 order to fund as many projects with the moneys available as 29 possible. The board and the authority may negotiate with 30 applicants regarding the details of projects and the amount and 31 terms of any award. The total amount of financial assistance 32 provided to an applicant from the sports tourism marketing 33 program fund created in section 15F.403 in any one fiscal year 34 shall not exceed five hundred thousand dollars. final funding decisions pursuant to this subsection , the board 1 and the authority are exempt from chapter 17A . 2 6. a. A city, county, or public entity may use financial 3 assistance received under the program from the sports tourism 4 marketing fund created in section 15F.403 for marketing and 5 promotions. Whether an activity or individual cost item is 6 directly related to the promotion of the sporting event shall 7 be within the discretion of the authority. 8 b. All applications to the authority for financial 9 assistance from the sports tourism marketing fund created in 10 section 15F.403 shall be made at least ninety days prior to an 11 event’s scheduled date. 12 c. A city, county, or public entity shall not use financial 13 assistance received under the program from the sports tourism 14 marketing fund created in section 15F.403 or the sports tourism 15 infrastructure fund created in section 15F.404 as reimbursement 16 for completed projects. 17 Sec. 25. Section 15F.402, subsections 1 and 2, Code 2022, 18 are amended to read as follows: 19 1. Applications for assistance under the sports tourism 20 marketing and infrastructure program established in section 21 15F.401 shall be submitted to the authority. For those 22 applications that meet the eligibility criteria, the authority 23 shall forward the applications to the board and provide a staff 24 review analysis and evaluation to the sports tourism program 25 review committee referred to in subsection 2 and to the board. 26 2. A review committee composed of five members of the 27 board shall review sports tourism marketing and infrastructure 28 program applications forwarded to the board and make 29 recommendations regarding the applications to the authority. 30 The review committee shall consist of members of the board, 31 with one member from each congressional district under section 32 15F.102, subsection 2 , paragraph “a” , and one member from the 33 state at large under section 15F.102, subsection 2 , paragraph 34 “b” . 35 -24- HF 2579.4589.S (2) 89 mb 24/ 26
Sec. 26. Section 15F.403, subsection 1, paragraph a, Code 1 2022, is amended to read as follows: 2 a. The authority shall establish a fund pursuant to 3 section 15.106A, subsection 1 , paragraph “o” , for purposes of 4 financing sports tourism marketing projects as described in 5 this subchapter . The fund established for purposes of this 6 section may be administered as a revolving fund and may consist 7 of any moneys appropriated by the general assembly for purposes 8 of this section . 9 Sec. 27. Section 15F.403, subsection 2, paragraph a, Code 10 2022, is amended to read as follows: 11 a. Moneys in the fund are appropriated to the authority for 12 purposes of providing financial assistance to cities, counties, 13 and public entities under the sports tourism marketing program 14 established and administered pursuant to this subchapter . 15 Sec. 28. NEW SECTION . 15F.404 Sports tourism infrastructure 16 program fund. 17 1. a. The authority shall establish a fund pursuant to 18 section 15.106A, subsection 1, paragraph “o” , for purposes of 19 financing sports tourism infrastructure projects as described 20 in this subchapter. The fund established for purposes of this 21 section may be administered as a revolving fund and may consist 22 of any moneys appropriated by the general assembly for purposes 23 of this section. 24 b. Notwithstanding section 8.33, moneys in a fund 25 established for purposes of this section at the end of each 26 fiscal year shall not revert to any other fund but shall remain 27 in the fund for expenditure for subsequent fiscal years. 28 c. Notwithstanding section 12C.7, subsection 2, interest or 29 earnings on moneys in the fund shall be credited to the fund. 30 2. a. b. The board in its discretion shall allocate the available 1 moneys in the fund among the programs described in paragraph “a” 2 in the amounts determined by the board. 3 c. The authority may use not more than five percent of the 4 moneys in the fund at the beginning of each fiscal year for 5 purposes of administrative costs, technical assistance, and 6 other program support. 7 Sec. 29.
