Section 7E.3, subsection 4, Code 2022, is amended 6 to read as follows: 7 4. Annual report. Unless otherwise provided by law, submit 8 a report in November of each year to the governor and the 9 legislature on the operation of the department or independent 10 agency during the fiscal year concluded on the preceding June 11 30, and projecting the goals and objectives of the department 12 or independent agency as developed in the program budget 13 report for the fiscal year under way. Any department or 14 independent agency may issue such additional reports on its 15 findings and recommendations as its operations require. This 16 subsection shall not apply to the state board of regents or any 17 institution under the control of the state board of regents. 18 Sec. ___. Section 8.7, Code 2022, is amended to read as 19 follows: 20 8.7 Reporting of gifts and bequests received. 21 All gifts and bequests with a value of fifty dollars or 22 more received by a department or accepted by the governor on 23 behalf of the state shall be reported within twenty days of 24 receiving the gift or bequest to the Iowa ethics and campaign 25 disclosure board, using the board’s internet reporting system. 26 The Iowa ethics and campaign disclosure board shall, by January 27 31 of each year, submit to the fiscal services division of 28 the legislative services agency a written report listing all 29 gifts and bequests received during the previous calendar year 30 with a value over one thousand dollars and the purpose for 31 each such gift or bequest. The submission shall also include 32 a listing of all gifts and bequests received by a department 33 from a person if the cumulative value of all gifts and bequests 34 received by the department from the person during the previous 35 -1- HF 2575.4100 (2) 89 jda/tm 1/ 19 #1.
calendar year exceeds one thousand dollars, and the Iowa ethics 1 and campaign disclosure board shall include, if available, the 2 purpose for each such gift or bequest. However, the reports on 3 gifts or bequests filed by the state board of regents and the 4 Iowa state fair board pursuant to section 8.44 shall be deemed 5 sufficient to comply with the requirements of this section . 6 Sec. ___. Section 8.9, subsection 2, paragraph a, Code 2022, 7 is amended to read as follows: 8 a. All grant applications submitted and grant moneys 9 received by a department on behalf of the state shall be 10 reported to the office of grants enterprise management. The 11 office shall by January 31 of each year submit to the fiscal 12 services division of the legislative services agency a written 13 report listing all grants received during the previous calendar 14 year with a value over one thousand dollars and the funding 15 entity and purpose for each grant. However, the reports on 16 grants filed by the state board of regents pursuant to section 17 8.44 shall be deemed sufficient to comply with the requirements 18 of this subsection . 19 Sec. ___. Section 8.44, subsection 1, Code 2022, is amended 20 to read as follows: 21 1. a. Upon receiving federal funds or any other funds from 22 any public or private sources, except gifts or donations made 23 to institutions for the personal use or for the benefit of 24 members, patients, or inmates and receipts from the gift shop 25 of merchandise manufactured by members, patients, or inmates, 26 the state departments, agencies, boards, and institutions 27 receiving the funds shall submit a written report within 28 thirty days after receipt of the funds to the director of the 29 department of management. The report shall state the source of 30 the funds that supplement or replace state appropriations for 31 institutional operations, the amount received, and the terms 32 under which the funds are received. b. Notwithstanding paragraph “a” , the state board of regents 1 shall submit the written report required under paragraph “a” on 2 a quarterly basis in the format specified by the director of 3 the department of management. 4 Sec. ___. Section 8.57, subsection 6, paragraph d, Code 5 2022, is amended to read as follows: 6 d. Annually, on or before January 15 of each year, a 7 state agency that received an appropriation from the sports 8 wagering receipts fund shall report to the legislative services 9 agency and the department of management the status of all 10 projects completed or in progress. The report shall include 11 a description of the project, the progress of work completed, 12 the total estimated cost of the project, a list of all revenue 13 sources being used to fund the project, the amount of funds 14 expended, the amount of funds obligated, and the date the 15 project was completed or an estimated completion date of the 16 project, where applicable. This paragraph shall not apply to 17 the state board of regents or any institution under the control 18 of the state board of regents. 19 Sec. ___. Section 8.57A, subsection 5, Code 2022, is amended 20 to read as follows: 21 5. Annually, on or before January 15 of each year, a state 22 agency that received an appropriation from the environment 23 first fund shall report to the legislative services agency 24 and the department of management the status of all projects 25 completed or in progress. The report shall include a 26 description of the project, the progress of work completed, 27 the total estimated cost of the project, a list of all revenue 28 sources being used to fund the project, the amount of funds 29 expended, the amount of funds obligated, and the date the 30 project was completed or an estimated completion date of the 31 project, where applicable. This subsection shall not apply to 32 the state board of regents or any institution under the control 33 of the state board of regents. 34 Sec. ___. Section 8.62, subsection 3, Code 2022, is amended 15 to read as follows: 16 3. On or before June 30 of the fiscal year following the 17 fiscal year in which funds were encumbered under this section , 18 an agency encumbering funds under this section shall report 19 to the joint appropriations subcommittee which recommends 20 funding for the agency, the legislative services agency, the 21 department of management, and the legislative fiscal committee 22 of the legislative council detailing how the moneys were 23 expended. Moneys shall not be encumbered under this section 24 from an appropriation which received a transfer from another 25 appropriation pursuant to section 8.39 . This subsection shall 26 not apply to the state board of regents or any institution 27 under the control of the state board of regents. 28 Sec. ___. Section 8.62, Code 2022, is amended by adding the 29 following new subsection: 30 NEW SUBSECTION . 4. Moneys shall not be encumbered under 31 this section from an appropriation which received a transfer 32 from another appropriation pursuant to section 8.39. 33 Sec. ___. Section 8F.4, subsection 1, paragraph b, 34 subparagraph (2), Code 2022, is amended to read as follows: 35 -4- HF 2575.4100 (2) 89 jda/tm 4/ 19
(2) The recipient entity is the state board of regents, an 1 institution under the control of the state board of regents, 2 or is recognized by the Internal Revenue Code as a nonprofit 3 organization or entity and provides a copy of the internal 4 revenue service form 990 for all fiscal years in which service 5 contract revenues are reported. 6 Sec. ___. Section 12.88, subsection 4, Code 2022, is amended 7 to read as follows: 8 4. Annually, on or before January 15 of each year, a 9 state agency that received an appropriation from the revenue 10 bonds capitals fund shall report to the legislative services 11 agency and the department of management the status of all 12 projects completed or in progress. The report shall include 13 a description of the project, the work completed, the total 14 estimated cost of the project, a list of all revenue sources 15 being used to fund the project, the amount of funds expended, 16 the amount of funds obligated, and the date the project was 17 completed or an estimated completion date of the project, where 18 applicable. This subsection shall not apply to the state board 19 of regents or any institution under the control of the state 20 board of regents. 21 Sec. ___. Section 12.88A, subsection 4, Code 2022, is 22 amended to read as follows: 23 4. Annually, on or before January 15 of each year, a state 24 agency that received an appropriation from the revenue bonds 25 capitals II fund shall report to the legislative services 26 agency and the department of management the status of all 27 projects completed or in progress. The report shall include 28 a description of the project, the work completed, the total 29 estimated cost of the project, a list of all revenue sources 30 being used to fund the project, the amount of funds expended, 31 the amount of funds obligated, and the date the project was 32 completed or an estimated completion date of the project, where 33 applicable. The report shall include 8 a description of the project, the progress of work completed, 9 the total estimated cost of the project, a list of all revenue 10 sources being used to fund the project, the amount of funds 11 expended, the amount of funds obligated, and the date the 12 project was completed or an estimated completion date of the 13 project, where applicable. This subsection shall not apply to 14 the state board of regents or any institution under the control 15 of the state board of regents. 16 Sec. ___. Section 12F.5, subsection 2, unnumbered paragraph 17 1, Code 2022, is amended to read as follows: 18 On October 1, 2008, and each October 1 thereafter, each 19 public fund , except the state board of regents, shall make 20 available to the public, and file with the general assembly, an 21 annual report covering the prior fiscal year that includes the 22 following: 23 Sec. ___. Section 262.9, subsection 34, paragraphs a, b, and 9 c, Code 2022, are amended by striking the paragraphs. 10 Sec. ___. Section 262.9, subsection 35, Code 2022, is 11 amended to read as follows: 12 35. Implement continuous improvement in undergraduate 13 programs offered by an institution of higher education governed 14 by the board. A continuous improvement plan shall be developed 15 and implemented built upon the results of the institution’s 16 student outcomes assessment program for courses with typical 17 annual enrollments of one hundred or more students, whether in 18 one or multiple sections. In developing and implementing the 19 continuous improvement plan for each course, the instructor 20 or instructors for such a course shall each year evaluate 21 the results of the instructors’ students’ performances in 22 comparison with established course goals and shall formulate 23 recommendations for future goals and methods to achieve 24 improved student performance. The board shall annually 25 evaluate the effectiveness of the plans and shall submit an 26 executive summary of its findings and recommendations in its 27 annual strategic plan progress report, a copy of which shall be 28 submitted to the general assembly . 29 Sec. ___. Section 262.9, subsection 37, Code 2022, is 30 amended by striking the subsection. 31 Sec. ___. Section 262.9C, subsection 5, Code 2022, is 32 amended by striking the subsection. 33 Sec. ___. Section 262.14, subsection 3, paragraph f, Code 34 2022, is amended to read as follows: 35 -7- HF 2575.4100 (2) 89 jda/tm 7/ 19
f. Funds belonging to an institution governed by the board 1 may be invested in private enterprises if such investment is 2 made in furtherance of the institution’s mission. The board 3 shall annually, on or before November 1, submit a report to the 4 general assembly providing information regarding how the board 5 invested any funds in accordance with this paragraph, including 6 the amount invested, how long the board has invested such 7 funds, and the percentage of equity in each private enterprise 8 held by the board. 9 Sec. ___. Section 262.92, Code 2022, is amended to read as 10 follows: 11 262.92 College-bound program. 12 1. The board of regents shall establish or contract to 13 establish college-bound programs to provide Iowa minority 14 students with information and experiences relating to 15 opportunities offered at the regents’ universities. Programs 16 developed may include, but are not limited to, the following 17 elements: 18 a. Reinforcement of efforts to attract undergraduate 19 students from age groups currently served by traditional 20 methods of outreach which use high school and community college 21 services. 22 b. Extension of traditional student recruitment methods 23 which are designed to encourage minority students in grades 24 seven through twelve to pursue postsecondary academic courses 25 of study. 26 c. Identification, at each of the regents’ universities, of 27 courses of study to be targeted for the recruitment of minority 28 students. 29 d. Offerings at the regents’ universities of innovative 30 programs, which are experience oriented, for families with 31 minority children. 32 2. The board of regents shall establish a voucher program 33 for students in grades seven through twelve. Vouchers may be 34 obtained by any qualified secondary student at any regents’ 35 -8- HF 2575.4100 (2) 89 jda/tm 8/ 19
university upon completion of a college-bound program provided 1 under subsection 1 . Students may receive one voucher for each 2 program. One or more vouchers entitle a student to priority 3 over other persons applying for grants under the Iowa minority 4 academic grants for economic success program established in 5 section 261.101 . Vouchers shall be submitted with the grant 6 application within one year after a student graduates from high 7 school at any higher education institution which offers grants 8 under the Iowa minority academic grants for economic success 9 program. Vouchers earned can only be used by the person who 10 participated in the college-bound voucher program and are not 11 transferable. Vouchers issued by a university under this 12 program shall be signed by the president of the university. 13 3. 2. The board of regents shall adopt rules to establish 14 program guidelines for the universities under the board’s 15 control and for the administration and coordination of program 16 efforts. Rules adopted shall include methods of recording data 17 relating to voucher recipients and making the data available to 18 the college student aid commission. 19 Sec. ___. Section 262A.13, Code 2022, is amended to read as 20 follows: 21 262A.13 Reports to general assembly Financial information —— 22 projects funded by the issuance of bonds or notes . 23 1. The state board of regents shall determine, in 24 consultation with the legislative services agency, the 25 financial information to be included in line item budget 26 information for projects funded by the issuance of bonds or 27 notes under this chapter and shall submit the line item budget 28 information to the general assembly as requested. The state 29 board of regents shall submit quarterly reports to the general 30 assembly concerning the projects funded by the issuance of 31 bonds or notes under this chapter as follows: 32 a. Identification of both undercharges and overcharges for 33 line items of projects. 34 b. Identification of contracts in which any line item for a 35 -9- HF 2575.4100 (2) 89 jda/tm 9/ 19
project exceeds the adopted budget for that line item by ten 1 percent or more. 2 c. Identification of complaints received by an institution 3 regarding the construction of a project. 4 2. If the state board of regents approves a change in the 5 amount of the line item of a budget for a project, the change 6 shall be transmitted to the appropriations committees of the 7 house of representatives and senate, while the general assembly 8 is in session, and to the legislative council, when the general 9 assembly is not in session, for review. 10 Sec. ___. Section 262B.3, subsection 3, Code 2022, is 11 amended by striking the subsection. 12 Sec. ___. Section 266.39E, subsection 1, unnumbered 13 paragraph 1, Code 2022, is amended to read as follows: 14 A beginning farmer center is established as a part of the 15 Iowa cooperative extension service in agriculture and home 16 economics at Iowa state university of science and technology to 17 assist individuals beginning farming operations. The center 18 shall also assist in facilitating the transition of farming 19 operations from established farmers to beginning farmers, 20 including by matching purchasers and sellers of agricultural 21 land, creating and maintaining an information base inventorying 22 land and facilities available for acquisition, and developing 23 or evaluating models to increase the number of and educational 24 materials that promote family farming operations in this state. 25 The objectives of the beginning farmer center shall include, 26 but are not limited to, the following: 27 Sec. ___. Section 266.39E, subsection 2, Code 2022, is 28 amended to read as follows: 29 2. Programs and services provided by the beginning farmer 30 center shall include, but are not limited to, the development 31 of skills and knowledge in financial management and planning, 32 legal issues, tax laws, technical production and management, 33 leadership, sustainable agriculture, human health, the 34 environment, and leadership. 35 -10- HF 2575.4100 (2) 89 jda/tm 10/ 19
Sec. ___. Section 625.29, subsection 7, Code 2022, is 1 amended to read as follows: 2 7. Each agency that pays fees or other expenses for an 3 action for judicial review of an agency proceeding under 4 chapter 17A shall report annually to the chairs and ranking 5 members of the appropriate appropriations subcommittees of the 6 general assembly the amount of fees or other expenses paid 7 during the preceding fiscal year by that agency. In its report 8 the agency shall describe the number, nature, and amount of the 9 awards, the claims involved in the action, and other relevant 10 information which might aid the general assembly in evaluating 11 the scope and impact of these awards. This subsection shall 12 not apply to the state board of regents or any institution 13 under the control of the state board of regents. 14 Sec. ___. 2013 Iowa Acts, chapter 141, section 30, 15 subsection 3, paragraph a, subparagraph (2), is amended by 16 striking the subparagraph. 17 Sec. ___. 2013 Iowa Acts, chapter 141, section 30, 18 subsection 3, paragraph b, subparagraph (3), is amended to read 19 as follows: 20 (3) It is the intent of the general assembly that the 21 industrial incentive program focus on Iowa industrial 22 sectors and seek contributions and in-kind donations from 23 businesses, industrial foundations, and trade associations, 24 and that moneys for the institute for physical research and 25 technology industrial incentive program shall be allocated 26 only for projects which are matched by private sector moneys 27 for directed contract research or for nondirected research. 28 The match required of small businesses as defined in section 29 15.102, subsection 10 , for directed contract research or for 30 nondirected research shall be $1 for each $3 of state funds. 31 The match required for other businesses for directed contract 32 research or for nondirected research shall be $1 for each $1 of 33 state funds.
