Section 282.18, subsection 4, paragraph b, 3 subparagraph (1), Code 2022, is amended to read as follows: 4 (1) (a) “Good cause” means a change in a child’s residence 5 due to a change in family residence, a change in a child’s 6 residence from the residence of one parent or guardian to 7 the residence of a different parent or guardian, a change 8 in the state in which the family residence is located, a 9 change in a child’s parents’ marital status, a guardianship 10 or custody proceeding, placement in foster care, adoption, 11 participation in a foreign exchange program, initial placement 12 of a prekindergarten student in a special education program 13 requiring specially designed instruction, or participation in a 14 substance abuse or mental health treatment program, a change in 15 the status of a child’s resident district such as removal of 16 accreditation by the state board, surrender of accreditation, 17 or permanent closure of a nonpublic school, revocation of a 18 charter school contract as provided in section 256E.10 or 19 256F.8 , the failure of negotiations for a whole grade sharing, 20 reorganization, dissolution agreement, the rejection of a 21 current whole grade sharing agreement, or reorganization plan, 22 or if the child’s assigned attendance center in the district of 23 residence is identified as in significant need for improvement. 24 If the good cause relates to a change in status of a child’s 25 school district of residence, however, action by a parent 26 or guardian must be taken to file the notification within 27 forty-five days of the last board action or within thirty days 28 of the certification of the election, whichever is applicable 29 to the circumstances. 30 (b) “Good cause” includes when a child’s sibling or 31 stepsibling is enrolled in a receiving district pursuant to 32 this section, unless the receiving district has insufficient 33 classroom space for the child. > 34 2.
