House File 2381 H-8129 Amend House File 2381 as follows: 1 1. Page 7, after line 18 by inserting: 2 < Sec. ___. Section 479B.16, subsection 1, Code 2022, is 3 amended to read as follows: 4 1. A pipeline company granted a pipeline permit shall , 5 subject to subsection 4, be vested with the right of eminent 6 domain, to the extent necessary and as prescribed and approved 7 by the board, not exceeding seventy-five feet in width for 8 right-of-way and not exceeding one acre in any one location in 9 addition to right-of-way for the location of pumps, pressure 10 apparatus, or other stations or equipment necessary to 11 the proper operation of its pipeline. The board may grant 12 additional eminent domain rights where the pipeline company 13 has presented sufficient evidence to adequately demonstrate 14 that a greater area is required for the proper construction, 15 operation, and maintenance of the pipeline or for the location 16 of pumps, pressure apparatus, or other stations or equipment 17 necessary to the proper operation of its pipeline. 18 Sec. ___. Section 479B.16, Code 2022, is amended by adding 19 the following new subsection: 20 NEW SUBSECTION . 4. The board shall not grant a carbon 21 pipeline project the right of eminent domain unless the board 22 finds the project is built pursuant to a comprehensive state 23 atmospheric carbon reduction plan adopted by the general 24 assembly that is consistent with the obligations of the 25 United States in accordance with the nationally determined 26 contribution pursuant to the United Nations Framework 27 Convention on Climate Change, Dec. 12, 2015, T.I.A.S. 23 No. 28 16-1104. > 29 2.
