In supporting projects in watersheds and subwatersheds 2 as provided in paragraph “b”, all of the following shall apply: 3 (1) The demonstration projects shall utilize water quality 4 practices as described in the latest revision of the document 5 entitled “Iowa Nutrient Reduction Strategy” initially presented 6 in November 2012 by the department of agriculture and land 7 stewardship, the department of natural resources, and Iowa 8 state university of science and technology. 9 (2) The division shall implement demonstration projects as 10 provided in subparagraph (1) by providing for participation by 11 persons who hold a legal interest in agricultural land used in 12 farming. To every extent practical, the division shall provide 13 for collaborative participation by such persons who hold a 14 legal interest in agricultural land located within the same 15 subwatershed. 16 (3) The division shall implement demonstration projects on 17 a cost-share basis as determined by the division. Except for 18 edge-of-field practices, the state’s share of the amount shall 19 not exceed 50 percent of the estimated cost of establishing the 20 practice as determined by the division or 50 percent of the 21 actual cost of establishing the practice, whichever is less. 22 (4) The demonstration projects shall be used to educate 23 other persons about the feasibility and value of establishing 24 similar water quality practices. The division shall promote 25 field day events for purposes of allowing interested persons to 26 establish water quality practices on their agricultural land. 27 (5) The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record. 34 d. to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 e. The moneys appropriated in this subsection may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this subsection. 8 f. The moneys appropriated in this subsection may be used 9 by the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A . 15 g. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in this 17 subsection to carry out the provisions of this subsection on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 h. For purposes of section 8.33, unless 14 specifically provided otherwise, unencumbered or unobligated 15 moneys from an appropriation made in this division of this Act 16 shall not revert but shall remain available for expenditure for 17 the purposes designated until the close of the fiscal year that 18 ends two years after the end of the fiscal year for which the 19 appropriation is made. EFFECTIVE DATE. This division of this Act, being 13 deemed of immediate importance, takes effect upon enactment. 14 DIVISION IV 15 MISCELLANEOUS PROVISIONS 16 Sec. 10. Section 8.57C, subsection 3, paragraph a, Code 17 2021, is amended to read as follows: 18 a. There is appropriated from the general fund of the state 19 to the technology reinvestment fund for the following fiscal 20 years, the sum of seventeen million five hundred thousand 21 dollars to the technology reinvestment fund following amounts : 22 (1) The For the fiscal year beginning July 1, 2014, and 23 ending June 30, 2015 , the sum of seventeen million five hundred 24 thousand dollars . 25 (2) For the fiscal year beginning July 1, 2021, and ending 26 June 30, 2022, the sum of seventeen million seven hundred 27 thousand million dollars. 28 (2) (3) The For the fiscal year beginning July 1, 2021 29 2022 , and for each subsequent fiscal year thereafter , the sum 30 of seventeen million five hundred thousand dollars . 31 Sec. 11. Section 15.261, subsection 2, Code 2021, is amended 32 to read as follows: 33 2. Moneys in the vacant state buildings demolition fund 34 are appropriated to the authority for purposes of funding a 35 -15- HF 862.2587.S (1) 89 mb 15/ 19
grant program for the demolition of vacant buildings owned by 1 the state which are no longer used for a state purpose. Grant 2 program criteria shall provide that no more than fifty percent 3 of the cost of a project for the demolition of vacant buildings 4 shall be funded from a grant under the program. 5 Sec. 12. DEPARTMENT OF VETERANS AFFAIRS —— CEMETERY 6 INFRASTRUCTURE STUDY. The department of veterans affairs shall 7 conduct a study assessing infrastructure needs related to 8 veteran’s cemeteries located in the state, to include assessing 9 the adequacy of access to the cemeteries. The department shall 10 submit a written report to the general assembly, including its 11 findings and conclusions, by January 14, 2022. 12 DIVISION V 13 AUTISM SUPPORT FUND 14 Sec. 13. AUTISM SUPPORT FUND —— TRANSFER. There is 15 transferred from the autism support fund created in section 16 225D.2 to the rebuild Iowa infrastructure fund created in 17 section 8.57, for the fiscal year beginning July 1, 2021, and 18 ending June 30, 2022, the sum of seven hundred fifty thousand 19 dollars, notwithstanding any provision of section 225D.2 to the 20 contrary. 21 DIVISION VI 22 SPORTS TOURISM PROGRAM 23 Sec. 14. Section 15F.401, subsection 1, paragraph a, Code 24 2021, is amended to read as follows: 25 a. The authority shall establish, and, at the direction of 26 the board, shall administer a sports tourism program to provide 27 financial assistance for projects that promote sporting events 28 for organizations of accredited colleges and universities , 29 professional sporting events, and other sporting events in the 30 state. 31 Sec. 15. Section 15F.401, subsection 1, paragraph b, 32 subparagraph (3), Code 2021, is amended to read as follows: 33 (3) “Organization” means a corporation, conference, 34 association, or other organization which has as one of 35 -16- HF 862.2587.S (1) 89 mb 16/ 19
its primary purposes the sponsoring or administration 1 of extracurricular intercollegiate athletic contests or 2 competitions , or professional sporting events . 3 Sec. 16. Section 15F.401, subsection 1, paragraph b, Code 4 2021, is amended by adding the following new subparagraph: 5 NEW SUBPARAGRAPH . (4) “Professional sporting events” means 6 any sporting events for which the competing athletes receive 7 payment for their participation in such sporting event. 8 Sec. 17. Section 15F.401, subsection 2, paragraphs a, b, and 9 c, Code 2021, are amended to read as follows: 10 a. A city or county in the state or a public entity, 11 including a convention and visitors bureau or a district, 12 may apply to the authority for financial assistance for a 13 project that actively and directly promotes sporting events for 14 accredited colleges and universities , professional sporting 15 events, and other sporting events in the area served by the 16 city, county, or public entity. 17 b. A city, county, or public entity may apply for and 18 receive financial assistance for more than one project. The 19 board may require additional information to substantiate the 20 financial need for awarding more than one project in any fiscal 21 year. 22 c. A city, county, or public entity may apply for financial 23 assistance for a project that spans multiple two fiscal years 24 or may apply for renewal of financial assistance awarded in 25 a prior year if all applicable contractual requirements are 26 met. The decision as to whether to renew an award shall be 27 at the discretion of the board. The board may adopt by rule 28 certain metrics and return on investment estimates for purposes 29 of this paragraph. The authority may include such metrics and 30 estimates in a program agreement executed pursuant to this 31 section . 32 Sec. 18. Section 15F.401, subsections 4, 5, and 6, Code 33 2021, are amended to read as follows: 34 4. An applicant shall demonstrate matching funds in order 35 -17- HF 862.2587.S (1) 89 mb 17/ 19
to receive financial assistance pursuant to this section . The 1 amount of matching funds that may be required shall be at the 2 board’s discretion. An applicant under the program shall not 3 receive financial assistance from the sports tourism program 4 fund created in section 15F.403 in an amount exceeding fifty 5 percent of the total cost of the project. 6 5. The board shall make final funding decisions on 7 each application and may approve, deny, defer, or modify 8 applications for financial assistance under the program, in 9 its discretion, in order to fund as many projects with the 10 moneys available as possible. The board and the authority may 11 negotiate with applicants regarding the details of projects 12 and the amount and terms of any award. The total amount of 13 financial assistance provided to an applicant in any one fiscal 14 year shall not exceed five hundred thousand dollars. In making 15 final funding decisions pursuant to this subsection , the board 16 and the authority are exempt from chapter 17A . 17 6. a. A city, county, or public entity may use financial 18 assistance received under the program for marketing , and 19 promotions , and infrastructure . Whether an activity or 20 individual cost item is directly related to the promotion 21 of the sporting event shall be within the discretion of the 22 authority. 23 b. All applications to the authority for financial 24 assistance shall be made at least ninety days prior to an 25 event’s scheduled date. A city, county, or public entity shall 26 not use financial assistance received under the program as 27 reimbursement for completed projects. 28 Sec. 19. Section 15F.403, subsection 2, Code 2021, is 29 amended by adding the following new paragraph: 30 NEW PARAGRAPH . c. The authority may use not more than 31 five percent of the money in the fund at the beginning of each 32 fiscal year for purposes of administrative costs, technical 33 assistance, and other program support. 34 Sec. 20.
