Page 74, after line 30 by inserting: 2 < DIVISION ___ 3 CHILD CARE ASSISTANCE —— ELIGIBILITY PHASE-OUT 4 Sec. ___. NEW SECTION . 237A.14 Child care assistance —— 5 graduated eligibility phase-out. 6 1. At the time of a twelve-month eligibility 7 redetermination for a family receiving state child care 8 assistance, the family shall remain eligible to receive 9 child care assistance, subject to the graduated eligibility 10 phase-out program as specified in subsection 2, if either of 11 the following conditions are met: 12 a. The family’s nonexempt gross monthly income is determined 13 to be at least two hundred twenty-five percent but less 14 than two hundred fifty percent of the federal poverty level 15 applicable to the family size for children needing basic care. 16 b. The family’s nonexempt gross monthly income is determined 17 to be at least two hundred twenty-five percent but less than 18 two hundred seventy-five percent of the federal poverty level 19 applicable to the family size for children needing special 20 needs care. 21 2. a. A family with an income at the following percentages 22 of the federal poverty level applicable to the family size 23 for children needing basic care shall be responsible for the 24 following share of child care costs: 25 (1) A family with an income above two hundred twenty-five 26 percent of the federal poverty level but less than two hundred 27 thirty-five percent of the federal poverty level shall pay for 28 thirty-three percent of the family child care costs. 29 (2) A family with an income at or above two hundred 30 thirty-five percent of the federal poverty level but less than 31 two hundred forty-five percent of the federal poverty level 32 shall pay for forty-five percent of the family child care 33 costs. 34 (3) A family with an income at or above two hundred 35 -1- H 1484.2497 (3) 89 pf/rn 1/ 2 #1.

A family with an income at the following percentages of 4 the federal poverty level applicable to the family size for 5 children needing special needs care shall be responsible for 6 the following share of child care costs: 7 (1) A family with an income above two hundred twenty-five 8 percent of the federal poverty level but less than two hundred 9 forty-five percent of the federal poverty level shall pay for 10 thirty-three percent of the family child care costs. 11 (2) A family with an income at or above two hundred 12 forty-five percent of the federal poverty level but less than 13 two hundred sixty-five percent of the federal poverty level 14 shall pay for forty-five percent of the family child care 15 costs. 16 (3) A family with an income at or above two hundred 17 sixty-five percent of the federal poverty level but at or less 18 than two hundred seventy-five percent of the federal poverty 19 level shall pay for sixty percent of the family child care 20 costs. 21 c. The graduated eligibility phase-out as provided in 22 paragraphs “a” and “b” shall be implemented no later than July 23 1, 2022. 24 3. Child care provider reimbursement rates under the 25 graduated eligibility phase-out program shall be the same rates 26 as the child care provider reimbursement rates. 27 4. The department of human services shall adopt rules 28 pursuant to chapter 17A in accordance with this section. > 29 2.
