Section 124E.4, subsection 5, Code 2021, is 5 amended to read as follows: 6 5. Expiration date of card. A medical cannabidiol 7 registration card issued pursuant to this section shall expire 8 one year three years after the date of issuance and may be 9 renewed. 10 Sec. ___. Section 124E.9, subsections 14 and 15, Code 2021, 11 are amended to read as follows: 12 14. A medical cannabidiol dispensary shall not dispense 13 more than a combined total of four and one-half fifteen grams 14 of total tetrahydrocannabinol to a patient and the patient’s 15 primary caregiver in a ninety-day period, except as provided 16 in subsection 15 . 17 15. A medical cannabidiol dispensary may dispense more than 18 a combined total of four and one-half fifteen grams of total 19 tetrahydrocannabinol to a patient and the patient’s primary 20 caregiver in a ninety-day period if any of the following apply: 21 a. The health care practitioner who certified the patient to 22 receive a medical cannabidiol registration card certifies that 23 patient’s debilitating medical condition is a terminal illness 24 with a life expectancy of less than one year. A certification 25 issued pursuant to this paragraph shall include a total 26 tetrahydrocannabinol cap deemed appropriate by the patient’s 27 health care practitioner. 28 b. The health care practitioner who certified the 29 patient to receive a medical cannabidiol registration card 30 certifies that the patient has participated in the medical 31 cannabidiol program and that the health care practitioner 32 has determined that four and one-half fifteen grams of total 33 tetrahydrocannabinol in a ninety-day period is insufficient 34 to treat the patient’s debilitating medical condition.
