Page 11, after line 34 by inserting: 6 < (1) Of the moneys appropriated in this paragraph, the 7 division shall allocate $300,000 to hire three additional 8 full-time Iowa OSHA compliance safety and health officers to 9 conduct on-site investigations and inspections under chapter 10 88. Each of the three compliance safety and health officers 11 shall be assigned, as the officer’s primary duties, to 12 investigations and inspections of one of the following types 13 of employers: 14 (a) State correctional facilities and state mental health 15 institutes. 16 (b) County jails located in this state. 17 (c) Meat packing facilities located in this state. 18 (2) From the moneys appropriated in this paragraph, 19 the division shall establish and maintain a process on the 20 division’s internet site to allow individuals to electronically 21 submit a workplace safety or health issue complaint to Iowa 22 OSHA. > 23 4. Page 26, after line 6 by inserting: 24 < DIVISION ___ 25 IOWA OSHA COMPLAINT INVESTIGATIONS 26 Sec. ___. Section 88.6, Code 2021, is amended by adding the 27 following new subsections: 28 NEW SUBSECTION . 1A. Entrance and inspections —— warrantless 29 entry. The commissioner or the commissioner’s representative 30 shall not be required to obtain a warrant for entrance and 31 inspection under subsection 1, to enter any establishment, 32 workplace, environment, or other area of which the state of 33 Iowa, its various departments and agencies, or any political 34 subdivision of the state is the employer. 35 -1- HF 871.2368 (1) 89 ko/tm 1/ 2 #1. #2. #3. #4.
NEW SUBSECTION . 10. Procedures for complaints. The 1 division shall respond to any complaint of a violation of this 2 chapter within twenty-four hours of receiving the complaint. 3 The response shall confirm that the division has received the 4 complaint and shall describe the steps the division will carry 5 out to conduct an investigation of the complaint. The division 6 shall begin such an investigation within seventy-two hours of 7 receiving such a complaint. Upon request, and notwithstanding 8 subsection 8, the division shall provide the person who made a 9 complaint with an update on the progress of the investigation 10 and a projected timeline for its completion. > 11 5.
