Section 802.2, subsections 1 and 2, Code 2021, are 23 amended to read as follows: 24 1. An information or indictment for sexual abuse in the 25 first, second, or third degree committed on or with a person 26 who is under the age of eighteen years shall may be found 27 within fifteen years after the person upon whom the offense 28 is committed attains eighteen years of age, or if the person 29 against whom the information or indictment is sought is 30 identified through the use of a DNA profile, an information or 31 indictment shall be found within three years from the date the 32 person is identified by the person’s DNA profile, whichever 33 is later commenced at any time after the commission of the 34 offense . 35 -1- S 3153.2295.S (2) 89 mb 1/ 3 #1.

An information or indictment for any other sexual abuse 1 in the first, second, or third degree shall be found commenced 2 within ten years after its commission, or if the person against 3 whom the information or indictment is sought is identified 4 through the use of a DNA profile, an information or indictment 5 shall be found commenced within three years from the date the 6 person is identified by the person’s DNA profile, whichever is 7 later. 8 Sec. ___. Section 802.2A, Code 2021, is amended to read as 9 follows: 10 802.2A Incest —— sexual exploitation by a counselor, 11 therapist, or school employee , or adult providing training or 12 instruction . 13 1. An information or indictment for incest under section 14 726.2 committed on or with a person who is under the age of 15 eighteen shall may be found within fifteen years after the 16 person upon whom the offense is committed attains eighteen 17 years of age. An information or indictment for any other 18 incest shall be found within ten years after its commenced at 19 any time after the commission of the offense . 20 2. An indictment or information for sexual exploitation by 21 a counselor, therapist, or school employee , or adult providing 22 training or instruction, under section 709.15 committed on 23 or with a person who is under the age of eighteen shall may 24 be found within fifteen years after the person upon whom the 25 offense is committed attains eighteen years of age commenced at 26 any time after the commission of the offense . An information 27 or indictment for any other sexual exploitation shall be found 28 within ten years of the date the victim was last treated by the 29 counselor or therapist, or within ten years of the date the 30 victim was enrolled in or attended the school. 31 Sec. ___.
