Senate File 296 H-1350 Amend Senate File 296, as passed by the Senate, as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < Section 1. Section 155A.46, subsection 1, paragraph a, 4 Code 2021, is amended by adding the following new subparagraph: 5 NEW SUBPARAGRAPH . (7) An immunization or vaccination for 6 C0VID-19 as defined in section 686D.2. 7 Sec. 2. Section 155A.46, subsection 1, Code 2021, is amended 8 by adding the following new paragraph: 9 NEW PARAGRAPH . e. A pharmacist may, pursuant to statewide 10 protocols developed by the board in consultation with the 11 department of public health and consistent with subsection 2, 12 order and administer the following to patients ages six years 13 and older: 14 (1) Point-of-care testing and treatment for influenza, 15 streptococcus A, and COVID-19 as defined in section 686D.2 at 16 the point of interaction between a pharmacist and a patient. 17 (2) Point-of-care testing at the point of interaction 18 between a pharmacist and a patient in response to a public 19 health emergency. 20 Sec. 3. NEW SECTION . 155A.47 Collaborative pharmacy 21 practice —— agreements —— payment. 22 1. For the purposes of this section: 23 a. “Collaborative pharmacy practice” means a practice of 24 pharmacy whereby a pharmacist provides patient care and drug 25 therapy management services not otherwise permitted to be 26 performed by a pharmacist to patients under a collaborative 27 pharmacy practice agreement with another pharmacist or 28 practitioner which defines the nature, scope, conditions, and 29 limitations of the patient care and drug therapy management 30 services to be provided by a pharmacist in order to ensure that 31 a patient achieves the desired outcomes. 32 b. “Health benefit plan” means the same as defined in 33 section 514J.102. 34 c. “Health carrier” means the same as defined in section 35 -1- SF296.1802 (1) 89 ss/rh 1/ 2 #1.

Notwithstanding any provision of law to the contrary, a 2 pharmacist may engage in a collaborative pharmacy practice, in 3 accordance with rules adopted by the board pursuant to chapter 4 17A and under a collaborative pharmacy practice agreement, to 5 provide patient care and drug therapy management services to 6 a patient. 7 3. Notwithstanding any provision of a health benefit plan 8 to the contrary, whenever a health benefit plan provides for 9 payment or reimbursement for a service that is within the 10 lawful scope of practice of a practitioner or pharmacist 11 and the service is provided by a pharmacist pursuant to a 12 collaborative pharmacy practice agreement under this section, 13 the health carrier may provide payment or reimbursement for the 14 service. > 15 ______________________________ A.
