Section 155A.46, Code 2021, is amended to read 4 as follows: 5 155A.46 Statewide Administration of drugs —— statewide 6 protocols. 7 1. a. A pharmacist may, pursuant to statewide protocols 8 developed by the board in consultation with the department of 9 public health and consistent with subsection 2 3 , order and 10 administer the following to patients ages eighteen years and 11 older: 12 (1) a. Naloxone. 13 (2) b. Nicotine replacement tobacco Tobacco cessation 14 products. 15 c. Point-of-care testing and treatment for influenza, 16 streptococcus A, and COVID-19 as defined in section 686D.2 at 17 the point of interaction between a pharmacist and a patient. 18 d. Point-of-care testing at the point of interaction between 19 a pharmacist and a patient in response to a public health 20 emergency. 21 2. a. A pharmacist may prescribe and administer the 22 following to patients ages three years and older: 23 (3) (1) An immunization or vaccination recommended by 24 the United States centers for disease control and prevention 25 advisory committee on immunization practices in its approved 26 vaccination schedule for adults . 27 (4) (2) An immunization or vaccination recommended by the 28 United States centers for disease control and prevention for 29 international travel. 30 (5) A Tdap (tetanus, diphtheria, acellular pertussis) 31 vaccination in a booster application. 32 (3) Vaccines currently licensed for use in the United 33 States on the list issued by the United States food and drug 34 administration, including those related to COVID-19. 35 -1- HF794.1801 (1) 89 (amending this HF 794 to CONFORM to SF 296) ss/rh 1/ 4 #1.
(6) (4) Other emergency immunizations or vaccinations in 1 response to a public health emergency. 2 b. A pharmacist may , pursuant to statewide protocols 3 developed by the board in consultation with the department of 4 public health and consistent with subsection 2 , order prescribe 5 and administer the following to patients ages six months and 6 older: 7 (1) A vaccine or An immunization or vaccination for 8 influenza. 9 (2) Other emergency immunizations or vaccines vaccinations 10 in response to a public health emergency. 11 c. A pharmacist may, pursuant to statewide protocols 12 developed by the board in consultation with the department 13 of public health and consistent with subsection 2 , order and 14 administer the final two doses in a course of vaccinations for 15 HPV to patients ages eleven years and older. 16 d. c. Prior to the ordering prescribing and administration 17 of a vaccination or an immunization or vaccination authorized 18 by this subsection , pursuant to statewide protocols, a licensed 19 pharmacist shall consult and review the statewide immunization 20 registry or health information network. The board shall 21 adopt rules requiring the reporting of the administration of 22 vaccines and immunizations and vaccinations authorized by this 23 subsection to a patient’s primary health care provider, primary 24 physician, and a statewide immunization registry or health 25 information network. 26 2. 3. A pharmacist prescribing, ordering , or administering 27 a prescription drug, product, test, or treatment pursuant to 28 subsection 1 or 2 shall do all of the following: 29 a. Maintain a record of all prescription drugs, products, 30 tests, and treatments administered pursuant to this section . 31 b. Notify the patient’s primary health care provider 32 of any prescription drugs, products, tests, or treatments 33 administered to the patient, or enter such information in a 34 patient record system also used by the primary health care 35 -2- HF794.1801 (1) 89 (amending this HF 794 to CONFORM to SF 296) ss/rh 2/ 4
provider, as permitted by the primary health care provider. If 1 the patient does not have a primary health care provider, the 2 pharmacist shall provide the patient with a written record of 3 the prescription drugs, products, tests, or treatment provided 4 to the patient and shall advise the patient to consult a 5 physician. 6 c. Complete continuing pharmacy education related to 7 statewide protocols and immunizations and vaccinations 8 recognized and approved by the board. 9 Sec. 2. NEW SECTION . 155A.47 Collaborative pharmacy 10 practice —— agreements —— payment. 11 1. For the purposes of this section: 12 a. “Collaborative pharmacy practice” means a practice of 13 pharmacy whereby a pharmacist provides patient care and drug 14 therapy management services not otherwise permitted to be 15 performed by a pharmacist to patients under a collaborative 16 pharmacy practice agreement with another pharmacist or 17 practitioner which defines the nature, scope, conditions, and 18 limitations of the patient care and drug therapy management 19 services to be provided by a pharmacist in order to ensure that 20 a patient achieves the desired outcomes. 21 b. “Health benefit plan” means the same as defined in 22 section 514J.102. 23 c. “Health carrier” means the same as defined in section 24 514J.102. 25 2. Notwithstanding any provision of law to the contrary, a 26 pharmacist may engage in a collaborative pharmacy practice, in 27 accordance with rules adopted by the board pursuant to chapter 28 17A and under a collaborative pharmacy practice agreement, to 29 provide patient care and drug therapy management services to 30 a patient. 31 3. Notwithstanding any provision of a health benefit plan 32 to the contrary, whenever a health benefit plan provides for 33 payment or reimbursement for a service that is within the 34 lawful scope of practice of a practitioner or pharmacist 35 -3- HF794.1801 (1) 89 (amending this HF 794 to CONFORM to SF 296) ss/rh 3/ 4
and the service is provided by a pharmacist pursuant to a 1 collaborative pharmacy practice agreement under this section, 2 the health carrier may provide payment or reimbursement for the 3 service. > 4 ______________________________ A.
