Section 280.13C, subsection 6, paragraph b, Code 3 2021, is amended to read as follows: 4 b. Personnel of a school district or accredited 5 nonpublic school with enrolled students who participate 6 in an extracurricular interscholastic activity which is 7 a contest in grades seven through twelve shall develop a 8 return-to-learn plan based on guidance developed by the brain 9 injury association of America protocols supported by guidelines 10 of the centers for disease control and prevention of the United 11 States department of health and human services in cooperation 12 with a student removed from participation in an extracurricular 13 interscholastic activity and diagnosed with a concussion 14 or brain injury, the student’s parent or guardian, and the 15 student’s licensed health care provider to accommodate the 16 student as the student returns to the classroom. 17 Sec. ___. Section 280.13C, subsection 6, Code 2021, is 18 amended by adding the following new paragraphs: 19 NEW PARAGRAPH . c. The department of public health, in 20 collaboration with the department of education, shall adopt 21 rules pursuant to chapter 17A establishing return-to-learn 22 protocols based on guidelines of the centers for disease 23 control and prevention of the United States department of 24 health and human services that will allow for education 25 personnel and the families of students diagnosed with a 26 concussion or brain injury to collaborate with licensed health 27 care providers to provide a process for a student to return to 28 learn after a concussion or brain injury. 29 NEW PARAGRAPH . d. No later than January 6, 2022, personnel 30 of a school district or accredited nonpublic school shall 31 develop a district- or school-wide policy establishing a 32 process to develop and implement individualized return-to-learn 33 plans based on the return-to-learn protocols adopted by rule 34 pursuant to paragraph “c” . after July 1, 2022, the board of directors of each school 1 district and the authorities in charge of each accredited 2 nonpublic school shall provide the parent or guardian of each 3 student information on such protocols prior to the start of the 4 school year and shall also provide such information to a parent 5 or guardian of a new student arriving after the school year 6 has started. Any student in kindergarten through grade twelve 7 who has a concussion or other brain injury, regardless of the 8 cause of the injury, who does not qualify for a return-to-play 9 protocol under paragraph “a” or a return-to-learn plan 10 under paragraph “b” , may request that school personnel, in 11 coordination with the student’s parent or guardian, develop and 12 implement an individualized return-to-learn plan consistent 13 with the district- or school-wide policy that addresses 14 the student’s health and academic needs and follows the 15 return-to-learn protocols adopted by rule pursuant to paragraph 16 “c” . 17 Sec. ___. INFORMATION ON PROTOCOLS —— 2021-2022 SCHOOL 18 YEAR. For the school year beginning July 1, 2021, the board of 19 directors of each school district and the authorities in charge 20 of each accredited nonpublic school shall provide the parent 21 or guardian of each student information on the return-to-learn 22 protocols adopted by rule pursuant to section 280.13C, 23 subsection 6, paragraph “c”, as enacted by this Act, upon 24 implementation of the district- or school-wide policy developed 25 pursuant to section 280.13C, subsection 6, paragraph “d”, as 26 enacted by this Act, and shall also provide such information to 27 a parent or guardian of a new student arriving after the date 28 of such implementation. > 29 2.
