The state board shall not approve an application for a 4 charter school submitted under this section unless the question 5 of establishing the charter school is submitted to the eligible 6 electors in the public school district where the charter 7 school is proposed to be located and at least sixty percent 8 of those voting on the question support establishing the 9 charter school. The question shall be submitted to eligible 10 electors of the public school district only upon receipt by 11 the county commissioner of elections of a petition, in a form 12 prescribed by the state board, signed by not less than one 13 hundred eligible electors of the public school district. The 14 election shall be held on a date specified in section 39.2, 15 subsection 4, paragraph “c” , but not earlier than six months 16 prior to submission of the charter school application to the 17 state board. >> 18 2.
