HEALTH INSURANCE MANDATES —— STUDY. 5 1. The legislative council is requested to establish a 6 study committee to meet during the 2021 legislative interim to 7 accomplish the following: 8 a. Identify each health insurance mandate contained in 9 chapter 514C, and in any other provision of the 2021 Iowa Code, 10 and identify all of the following: 11 (1) The specific health insurance coverage required to be 12 provided by each health insurance mandate. 13 (2) Each class of contract, policy, plan, and agreement 14 that provides for third-party payment or prepayment of health 15 or medical expenses that is subject to each health insurance 16 mandate. 17 (3) Each class of contract, policy, plan, and agreement that 18 provides for third-party payment or prepayment of health or 19 medical expenses that is excluded from each health insurance 20 mandate. 21 (4) Each type of health carrier that is subject to each 22 health insurance mandate. For purposes of this section, 23 "health carrier" means an entity subject to the insurance laws 24 and regulations of this state, or subject to the jurisdiction 25 of the insurance commissioner, including an insurance company 26 offering sickness and accident plans, a health maintenance 27 organization, a nonprofit health service corporation, a plan 28 established pursuant to chapter 509A for public employees, or 29 any other entity providing a plan of health insurance, health 30 care benefits, or health care services. "Health carrier" 31 includes the department of human services, or a managed care 32 organization acting pursuant to a contract with the department 33 of human services to administer the medical assistance program 34 under chapter 249A or the healthy and well kids in Iowa 35 -1- HF838.1533 (2) 89 ko/rn 1/ 4 #1.
(hawk-i) program under chapter 514I. 1 (5) Each type of health carrier that is excluded from each 2 health insurance mandate. 3 b. For each health insurance mandate identified in 4 paragraph “a”, analyze all of the following: 5 (1) The fiscal impact to the state. 6 (2) The fiscal impact to each health carrier subject to each 7 health insurance mandate. 8 (3) The impact to the premiums for individuals covered by a 9 contract, policy, plan, or agreement of a health carrier under 10 subparagraph (2). 11 c. For a possible future health insurance mandate related 12 to continuity of care and nonmedical switching, analyze all of 13 the following: 14 (1) The potential fiscal impact to the state. 15 (2) The potential fiscal impact to each health carrier that 16 may be subject to the health insurance mandate. 17 (3) The potential impact to the premiums for individuals 18 covered by a contract, policy, plan, or agreement of a health 19 carrier under subparagraph (2). 20 d. For a possible future health insurance mandate related to 21 the diagnosis and treatment of infertility, analyze all of the 22 following: 23 (1) The potential fiscal impact to the state. 24 (2) The potential fiscal impact to each health carrier that 25 may be subject to the health insurance mandate. 26 (3) The potential impact to the premiums for individuals 27 covered by a contract, policy, plan, or agreement of a health 28 carrier under subparagraph (2). 29 e. For a possible future health insurance mandate related 30 to pediatric acute-onset neuropsychiatric syndrome (PANS) and 31 pediatric autoimmune neuropsychiatric disorders associated 32 with streptococcal infections (PANDAS), analyze all of the 33 following: 34 (1) The potential fiscal impact to the state. 35 -2- HF838.1533 (2) 89 ko/rn 2/ 4
(2) The potential fiscal impact to each health carrier that 1 may be subject to the health insurance mandate. 2 (3) The potential impact to the premiums for individuals 3 covered by a contract, policy, plan, or agreement of a health 4 carrier under subparagraph (2). 5 f. For a possible future health insurance mandate related to 6 medically necessary food and low protein modified food product 7 for individuals with certain inherited metabolic disorders, 8 analyze all of the following: 9 (1) The potential fiscal impact to the state. 10 (2) The potential fiscal impact to each health carrier that 11 may be subject to the health insurance mandate. 12 (3) The potential impact to the premiums for individuals 13 covered by a contract, policy, plan, or agreement of a health 14 carrier under subparagraph (2). 15 g. Identify the approximate number of Iowa residents that 16 are covered by each of the following types of insurance: 17 (1) Individual health insurance. 18 (2) Small group health insurance. 19 (3) Large group health insurance. 20 (4) The medical assistance program under chapter 249A. 21 (5) The healthy and well kids in Iowa (hawk-i) program under 22 chapter 514I. 23 2. The study committee shall have no more than fifteen 24 members and shall be composed of the following members: 25 a. Two members of the senate, one to be appointed by the 26 president of the senate and one to be appointed by the minority 27 leader of the senate. 28 b. Two members of the house of representatives, one to be 29 appointed by the speaker of the house of representatives and 30 one to be appointed by the minority leader of the house of 31 representatives. 32 c. The director of the insurance division of the department 33 of commerce, or the director’s designee. 34 d. The director of the department of human services, or the 35 -3- HF838.1533 (2) 89 ko/rn 3/ 4
director’s designee. 1 e. The consumer advocate of the consumer advocate bureau of 2 the insurance division of the department of commerce, or the 3 consumer advocate’s designee. 4 f. At least one representative from each of the following: 5 (1) One or more trade organizations based in Iowa whose 6 membership is comprised of independent insurance agents that 7 sell health insurance. 8 (2) One or more health insurance trade organizations 9 based in Iowa whose membership is comprised of companies or 10 individuals engaged in the business of health insurance. 11 3. The study committee shall submit a report with its 12 findings to the general assembly no later than December 31, 13 2021. The report shall not directly or indirectly disclose any 14 of the following: 15 a. The identity of a specific health carrier. 16 b. The identity of a specific contract, policy, plan, or 17 agreement that provides for third-party payment or prepayment 18 of health or medical expenses. > 19 2.
