NEW SECTION . 724.4F Disclosure of possession of 4 dangerous weapons to peace officer. 5 In the course of a peace officer’s duties, the peace officer 6 may ask a person if the person is in possession of a dangerous 7 weapon. A peace officer may request that a person carrying 19 a dangerous weapon present the officer with a form of 20 identification listed in section 49.78, subsection 2, paragraph 21 “a” , for verification of the person’s identity and date of 22 birth if the person’s behavior gives rise to a reasonable 23 suspicion of criminal behavior. A person who fails to present 24 such identification commits a serious misdemeanor. The 25 peace officer may seize the dangerous weapon until the person 26 produces valid identification and proof of purchase of the 27 dangerous weapon. > 28 6. Page 8, after line 18 by inserting: 29 < Sec. ___. Section 724.7, Code 2021, is amended to read as 30 follows: 31 724.7 Nonprofessional permit to carry weapons. 32 1. Any person who is not disqualified under section 724.8 , 33 who satisfies the training requirements of section 724.9 , 34 and who files an application in accordance with section 35 -1- H1219.1496 (2) 89 js/rh 1/ 4 #1. #2. #3. #4. #5. #6.
724.10 shall be issued a nonprofessional permit to carry 1 weapons. Such permits shall be on a form prescribed and 2 published by the commissioner of public safety, which shall 3 be readily distinguishable from the professional permit, and 4 shall identify the holder of the permit. Such permits shall 5 not be issued for a particular weapon and shall not contain 6 information about a particular weapon including the make, 7 model, or serial number of the weapon or any ammunition used 8 in that weapon. All permits so issued shall be for a period 9 of automatically renew every five years and shall be valid 10 throughout the state except where the possession or carrying of 11 a firearm is prohibited by state or federal law. 12 2. The commissioner of public safety shall develop a process 13 to allow service members deployed for military service to 14 submit a renewal of a nonprofessional permit to carry weapons 15 early and by mail. In addition, a permit issued to a service 16 member who is deployed for military service, as defined in 17 section 29A.1, subsection 3, 8, or 12 , that would otherwise 18 expire during the period of deployment shall remain valid for 19 ninety days after the end of the service member’s deployment. > 20 7. Page 8, after line 28 by inserting: 21 < Sec. ___. Section 724.9, subsection 6, Code 2021, is 22 amended by striking the subsection. 23 Sec. ___. Section 724.10, subsection 2, Code 2021, is 24 amended to read as follows: 25 2. The issuing officer, upon receipt of an initial 26 or renewal application under this section and upon the 27 automatic renewal of a permit issued under section 724.7 , 28 shall immediately conduct a background check concerning 29 each applicant by obtaining criminal history data from the 30 department of public safety , which shall include an inquiry 31 of the national instant criminal background check system 32 maintained by the federal bureau of investigation or any 33 successor agency. 34 Sec. ___. amended to read as follows: 1 3. The issuing officer shall collect a fee of fifty dollars 2 for an initial permit, except from a duly appointed peace 3 officer or correctional officer, for each permit issued. 4 Renewal permits or duplicate Duplicate permits shall be issued 5 for a fee of twenty-five dollars , provided the application 6 for such renewal permit is received by the issuing officer 7 within thirty days prior to the expiration of the applicant’s 8 current permit or within thirty days after the expiration of 9 the applicant’s current permit . A twenty-five dollar fee 10 shall be assessed upon the automatic renewal of a permit. 11 The issuing officer shall notify the commissioner of public 12 safety of the issuance of any permit at least monthly and 13 forward to the commissioner an amount equal to ten dollars 14 for each permit issued and five dollars for each renewal of 15 a permit or duplicate permit issued. All such fees received 16 by the commissioner shall be paid to the treasurer of state 17 and deposited in the operating account of the department of 18 public safety to offset the cost of administering this chapter . 19 Notwithstanding section 8.33 , any unspent balance as of June 30 20 of each year shall not revert to the general fund of the state. 21 Sec. ___. Section 724.14, Code 2021, is amended to read as 22 follows: 23 724.14 Nonprofessional permit —— change of residence to 24 another county. 25 If a permit holder of a nonprofessional permit to carry 26 weapons changes residences from one county to another county 27 after the issuance of the permit, the department of public 28 safety shall by rule specify the procedure to transfer the 29 regulation of the holder’s permit to another sheriff for the 30 purposes of automatically renewing a permit or issuing a 31 renewal or duplicate permit, or complying with section 724.13 . > 32 8.
