(1972),
and
to
guarantee
its
application
in

all
cases
where
the
free
exercise
of
religion
is
substantially

burdened
by
state
action.

chapter

interpreted
consistent
with
the

Religious
Freedom
Restoration
Act
of
1993,

U.S.C.
§2000bb
et

seq.,
federal
case
law,
and
federal
jurisprudence.

Definitions.

As
used
in
this
chapter,
unless
the
context
otherwise

requires:

“Demonstrates”
means
meets
the
burdens
of
going
forward

with
the
evidence
and
of
persuasion.

“Exercise
of
religion”
means
the
practice
or
observance

of
religion,
including
any
action
that
is
motivated
by
a

or
not
the
exercise
is

compelled
by,
or
central
to,
a
system

religious

color
of
law
of
the
state.

law”

Free
exercise
of
religion

1.
Government
shall
not
substantially
burden
a
person’s

exercise
of
religion,
even
if
the
burden
results
from
a
rule

of
general
applicability,
unless
it
is
demonstrated
that

applying
the
burden
to
that
person’s
exercise
of
religion
is
13
in
furtherance
of
a
compelling
governmental
interest
and
is
14
the
least
restrictive
means
of
furthering
that
compelling
15
governmental
interest.

A
person
whose
exercise
of
religion
has
been
burdened
17
in
violation
of
this
chapter
may
assert
such
violation
as
a
18
claim
or
defense
in
a
judicial
or
administrative
proceeding
19
and
obtain
appropriate
relief.
Standing
to
assert
a
claim
or
20
defense
under
this
chapter
shall
be
governed
by
the
general
21
rules
of
standing
under
state
and
federal
law.

chapter
applies
to
all
state
and
local
laws
and
the

implementation
of
state
and
local
laws,
whether
statutory

or
otherwise,
and
whether
adopted

Exemptions.

chapter

apply
to
the
department
of

corrections,

district

correctional
