Section 48A.7, Code 2021, is amended to read as 6 follows: 7 48A.7 Registration in person. 8 An eligible elector may register to vote by appearing 9 personally and completing a voter registration form at the 10 office of the commissioner in the county in which the person 11 resides, at a motor vehicle driver’s license station, including 12 any county treasurer’s office that is participating in county 13 issuance of driver’s licenses under chapter 321M , or at any 14 voter registration agency. A For paper registration forms, 15 a separate voter registration form shall be signed by each 16 individual registrant. 17 Sec. 2. Section 48A.8, subsection 1, Code 2021, is amended 18 to read as follows: 19 1. An eligible elector may request that a voter registration 20 form be mailed to the elector. The completed form may be 21 mailed or delivered by the registrant or the registrant’s 22 designee to the commissioner in the county where the person 23 resides or to the state commissioner of elections for a 24 program participant, as provided in section 9E.6 . A For paper 25 registration forms, a separate voter registration form shall be 26 signed by each individual registrant. 27 Sec. 3. Section 48A.18, subsections 1 and 3, Code 2021, are 28 amended to read as follows: 29 1. Each state motor vehicle driver’s license application, 30 including any renewal application or application for a 31 nonoperator’s identification card, submitted to the office 32 of driver services of the state department of transportation 33 shall serve as an application for voter registration unless 34 the commissioner of registration determines that the applicant 35 -1- HF590.822 (1) 89 ss/jh 1/ 21 #1.
is not an eligible elector or the applicant declines to 1 register to vote after receiving notification under subsection 2 4A . A completed application or paper voter registration 3 form submitted to the office of driver services of the state 4 department of transportation shall be considered to update any 5 previous voter registration by the registrant. 6 3. Information relating to the refusal decision of an 7 applicant for a driver’s license to apply decline to register 8 to vote shall not be used for any purpose other than voter 9 registration. 10 Sec. 4. Section 48A.18, subsection 4, Code 2021, is amended 11 by striking the subsection and inserting in lieu thereof the 12 following: 13 4. a. The state voter registration commission shall 14 establish schedules by which the department of transportation 15 shall transmit to the state registrar of voters electronic 16 records containing the legal name, age, residence, and 17 citizenship information for, and the electronic signature of, 18 each person submitting an application under this section. 19 b. The state voter registration commission shall establish 20 schedules by which the state registrar of voters shall make 21 accessible or transmit electronic records and electronic 22 signatures received under paragraph “a” to the appropriate 23 commissioner of registration. 24 c. The state voter registration commission shall establish 25 schedules by which the department of transportation shall 26 transmit any completed paper registration forms to the 27 appropriate commissioner of registration. 28 d. The state commissioner of elections shall adopt rules, 29 consistent with section 9E.6, for the registration of address 30 confidentiality program participants. 31 e. The state voter registration commission shall adopt 32 rules pursuant to chapter 17A to administer and interpret this 33 section, including rules to establish electronic and paper 34 forms and all procedures used by the office of driver services 35 -2- HF590.822 (1) 89 ss/jh 2/ 21
for voter registration purposes, rules to establish schedules 1 for transmission of electronic records, electronic signatures, 2 and completed paper voter registration forms, and rules and 3 forms to decline being registered to vote. 4 Sec. 5. Section 48A.18, Code 2021, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 4A. a. (1) Upon receiving the electronic 7 record for, and electronic signature of, a person under 8 subsection 4, the state registrar of voters shall transmit or 9 otherwise make accessible the electronic record and electronic 10 signature of the person to the commissioner of registration 11 of the county where the person resides. Upon reviewing the 12 electronic record received from the state registrar of voters, 13 along with any other relevant information, the commissioner of 14 registration shall determine if a person is an eligible elector 15 of the county. If the commissioner determines that a person is 16 an eligible elector of the county and is not registered to vote 17 in that county, the commissioner shall notify the person of the 18 separate processes to decline being registered to vote or to 19 declare a political party affiliation. 20 (2) If the person is registered to vote in the county, the 21 commissioner shall use the electronic record and information to 22 update the person’s voter registration if appropriate. 23 b. If a person notified under paragraph “a” does not decline 24 to be registered to vote within twenty-one calendar days after 25 the commissioner of registration issues the notification, the 26 person’s electronic record and electronic signature shall 27 constitute a completed voter registration form under section 28 48A.11, and the commissioner of registration shall register the 29 person to vote in that county. The commissioner shall send an 30 acknowledgment pursuant to section 48A.26. 31 c. A commissioner of registration shall not add a person 32 subject to registration under this subsection to a voter 33 registration list until at least twenty-one calendar days 34 after the commissioner has issued notification to the person 35 -3- HF590.822 (1) 89 ss/jh 3/ 21
as described in paragraph “a” . 1 d. The electronic record and electronic signature, received 2 under this subsection, of a person who does not qualify 3 as an eligible elector shall not constitute a completed 4 voter registration form under section 48A.11 and such a 5 person’s application for a driver’s license or nonoperator’s 6 identification card shall not be considered to be a voter 7 registration application for purposes of section 39A.2, 8 subsection 1, paragraph “a” . 9 Sec. 6. Section 48A.19, subsection 1, Code 2021, is amended 10 by adding the following new paragraph: 11 NEW PARAGRAPH . d. The department of education and all 12 state offices that collect personal information sufficient to 13 complete a voter registration application, as determined by the 14 state commissioner. 15 Sec. 7. Section 48A.19, subsection 4, paragraph a, 16 unnumbered paragraph 1, Code 2021, is amended to read as 17 follows: 18 The A voter registration agency that does not collect 19 personal information sufficient to complete a voter 20 registration application shall provide a form to applicants 21 that includes all of the following: 22 Sec. 8. Section 48A.21, Code 2021, is amended to read as 23 follows: 24 48A.21 Transmission of forms from agencies and driver’s 25 license stations . 26 1. The state registrar of voters shall adopt administrative 27 rules regulating the transmission of completed voter 28 registration forms from voter registration agencies and from 29 driver’s license stations, including county treasurer’s offices 30 participating in county issuance of driver’s licenses under 31 chapter 321M . All completed voter registration applications 32 in the possession of a voter registration agency , a driver’s 33 license station, or a county treasurer’s office that is 34 participating in county issuance of driver’s licenses at 5:00 35 -4- HF590.822 (1) 89 ss/jh 4/ 21
p.m. on the last workday of each week shall be transmitted 1 to the location designated by the state registrar of voters 2 by rule. Procedures or requirements for more frequent 3 transmissions may be specified by rule. 4 2. a. The state voter registration commission shall 5 establish schedules by which the voter registration agencies 6 pursuant to section 48A.19 that collect personal information 7 sufficient to complete a voter registration application shall 8 transmit to the state registrar of voters electronic records 9 containing the legal name, age, residence, and citizenship 10 information for, and the electronic signature of, each person 11 providing personal information as described in this section. 12 b. The state voter registration commission shall establish 13 schedules by which the state registrar of voters shall make 14 accessible or transmit electronic records and electronic 15 signatures received under paragraph “a” to the appropriate 16 commissioner of registration. 17 c. The state voter registration commission shall establish 18 schedules by which voter registration agencies shall transmit 19 any completed paper registration forms to the appropriate 20 commissioner of registration. 21 d. The state commissioner of elections shall adopt rules, 22 consistent with section 9E.6, for the registration of address 23 confidentiality program participants. 24 e. the electronic record and electronic signature of the person to 1 the commissioner of registration of the county where the person 2 resides. Upon reviewing the electronic record received from 3 the state registrar of voters, along with any other relevant 4 information, the commissioner of registration shall determine 5 if a person is an eligible elector of the county. If the 6 commissioner determines that a person is an eligible elector 7 of the county and is not registered to vote in that county, the 8 commissioner shall notify the person of the separate processes 9 to decline being registered to vote or to declare a political 10 party affiliation. 11 (2) If the person is registered to vote in the county, the 12 commissioner shall use the electronic record and information to 13 update the person’s voter registration if appropriate. 14 b. The electronic record and electronic signature, received 28 under this subsection, of a person who does not qualify as 29 an eligible elector shall not constitute a completed voter 30 registration form under section 48A.11 and such a person shall 31 not be considered to have submitted a voter registration 32 application for purposes of section 39A.2, subsection 1, 33 paragraph “a” . 34 Sec. 9. Section 48A.26, subsection 1, paragraph b, Code 35 -6- HF590.822 (1) 89 ss/jh 6/ 21
2021, is amended to read as follows: 1 b. (1) For a voter registration form or change of 2 information in a voter registration record submitted at a 3 precinct caucus, the commissioner shall send an acknowledgment 4 within forty-five days of receipt of the form or change of 5 information. 6 (2) For a voter registration application or change of 7 information in a voter registration record completed pursuant 8 to section 48A.18 or 48A.19, the commissioner shall send an 9 acknowledgment within seven working days of the person being 10 registered under either section. 11 Sec. 10. Section 48A.26, subsection 8, Code 2021, is amended 12 to read as follows: 13 8. An A completed voter registration application, 14 improperly transmitted under section 48A.18, subsection 15 4A, or under section 48A.21, subsection 2, or an improperly 16 addressed or delivered registration form shall be transmitted 17 or forwarded to the appropriate county commissioner of 18 registration within two working days after it is received by 19 any other official. The date of registration shall be the date 20 the completed application or registration form was received by 21 the first official. If the registration form was postmarked 22 fifteen or more days before an election and the registration 23 form was received by the first official after the close of 24 registration, the registration form shall be considered on time 25 for the election. 26 Sec. 11. Section 48A.36, subsection 1, Code 2021, is amended 27 to read as follows: 28 1. Voter registration agencies and the office of driver 29 services of the state department of transportation may 30 electronically transmit registration data to the state 31 registrar of voters, who shall distribute the information, 32 electronically or otherwise, to the appropriate commissioner 33 in accordance with rules of the state voter registration 34 commission and the state registrar of voters. driver services of the state department of transportation and 1 voter registration agencies that collect personal information 2 sufficient to complete a voter registration application 3 shall electronically transmit registration data to the state 4 registrar of voters as required pursuant to sections 48A.18 5 and 48A.21. The state agency originating the registration 6 data shall permanently retain an electronic copy of the 7 form completed by the registrant, including the registrant’s 8 signature, and shall develop procedures for the retrieval and 9 printing of that electronic document. A printed copy of an 10 electronic registration document shall be made only upon the 11 agency’s receipt of a court order. 12 Sec. 12. Section 331.557A, subsection 5, Code 2021, is 13 amended to read as follows: 14 5. Participate in voter registration according to the 15 terms of chapter 48A , and submit completed voter registration 16 forms to the state registrar of voters appropriate county 17 commissioner of registration . 18 Sec. 13. EMERGENCY RULES. The state voter registration 19 commission, in consultation with the department of 20 transportation and voter registration agencies, may adopt 21 emergency rules under section 17A.4, subsection 3, and section 22 17A.5, subsection 2, paragraph “b”, to implement the provisions 23 of this division of this Act and the rules shall be effective 24 immediately upon filing unless a later date is specified in the 25 rules. Any rules adopted in accordance with this section shall 26 also be published as a notice of intended action as provided 27 in section 17A.4. 28 Sec. 14. IMPLEMENTATION OF ACT. Section 25B.2, subsection 29 3, shall not apply to this division of this Act. 30 DIVISION II 31 VOTING BY CERTAIN CONVICTED PERSONS 32 Sec. 15. Section 39A.1, subsection 2, Code 2021, is amended 33 to read as follows: 34 2. The purpose of this chapter is to identify actions which 35 -8- HF590.822 (1) 89 ss/jh 8/ 21
threaten the integrity of the election process and to impose 1 significant sanctions upon persons who intentionally commit 2 those acts. It is the intent of the general assembly that 3 offenses with the greatest potential to affect the election 4 process be vigorously prosecuted and strong punishment meted 5 out through the imposition of felony sanctions which, as a 6 consequence, remove the voting rights of the offenders until 7 such rights are restored by the governor, by the president of 8 the United States, or by operation of law . Other offenses are 9 still considered serious, but based on the factual context in 10 which they arise, they may not rise to the level of offenses 11 to which felony penalties attach. The general assembly 12 also recognizes that instances may arise in which technical 13 infractions of chapters 39 through 53 may occur which do not 14 merit any level of criminal sanction. In such instances, 15 administrative notice from the state or county commissioner 16 of elections is sufficient. Mandates or proscriptions in 17 chapters 39 through 53 which are not specifically included in 18 this chapter shall be considered to be directive only, without 19 criminal sanction. 20 Sec. 16. Section 43.18, subsection 9, Code 2021, is amended 21 to read as follows: 22 9. A statement that the candidate is aware that the 23 candidate is disqualified from holding office if the candidate 24 has been convicted of a felony or other infamous crime and the 25 candidate’s rights have not been restored by the governor , or 26 by the president of the United States , or by operation of law . 27 Sec. 17. Section 43.67, subsection 2, paragraph i, Code 28 2021, is amended to read as follows: 29 i. A statement that the candidate is aware that the 30 candidate is disqualified from holding office if the candidate 31 has been convicted of a felony or other infamous crime and the 32 candidate’s rights have not been restored by the governor , or 33 by the president of the United States , or by operation of law . 34 Sec. 18. Section 44.3, subsection 2, paragraph i, Code 2021, 35 -9- HF590.822 (1) 89 ss/jh 9/ 21
is amended to read as follows: 1 i. A statement that the candidate is aware that the 2 candidate is disqualified from holding office if the candidate 3 has been convicted of a felony or other infamous crime and the 4 candidate’s rights have not been restored by the governor , or 5 by the president of the United States , or by operation of law . 6 Sec. 19. Section 45.3, subsection 9, Code 2021, is amended 7 to read as follows: 8 9. A statement that the candidate is aware that the 9 candidate is disqualified from holding office if the candidate 10 has been convicted of a felony or other infamous crime and the 11 candidate’s rights have not been restored by the governor , or 12 by the president of the United States , or by operation of law . 13 Sec. 20. Section 48A.6, subsection 1, Code 2021, is amended 14 to read as follows: 15 1. A person who has been convicted of a felony as defined 16 in section 701.7 , or convicted of an offense classified as a 17 felony under federal law. If the person’s rights are later 18 restored pursuant to section 914.8, or by a pardon issued by 19 the governor , or by the president of the United States, the 20 person may register to vote. 21 Sec. 21. Section 57.1, subsection 2, paragraph c, Code 2021, 22 is amended to read as follows: 23 c. That prior to the election the incumbent had been duly 24 convicted of a felony, as defined in section 701.7 , and that 25 the judgment had not been reversed, annulled, or set aside, nor 26 the incumbent pardoned by the governor or the president of the 27 United States or restored to the rights of citizenship by the 28 governor under chapter 914 pursuant to section 914.8 , at the 29 time of the election. 30 Sec. 22. Section 123.3, subsection 40, paragraph d, Code 31 2021, is amended to read as follows: 32 d. The person has not been convicted of a felony. However, 33 if the person’s conviction of a felony occurred more than five 34 years before the date of the application for a license or 35 -10- HF590.822 (1) 89 ss/jh 10/ 21
permit, and if the person’s rights of citizenship have been 1 restored by the governor pursuant to sections 914.1 through 2 914.6 , the administrator may determine that the person is of 3 good moral character notwithstanding such conviction. 4 Sec. 23. Section 161A.5, subsection 3, paragraph b, Code 5 2021, is amended to read as follows: 6 b. Every candidate shall file with the nomination papers 7 an affidavit stating the candidate’s name, the candidate’s 8 residence, that the person is a candidate and is eligible for 9 the office of commissioner, and that if elected the candidate 10 will qualify for the office. The affidavit shall also state 11 that the candidate is aware that the candidate is disqualified 12 from holding office if the candidate has been convicted of a 13 felony or other infamous crime and the candidate’s rights have 14 not been restored by the governor , or by the president of the 15 United States , or by operation of law . 16 Sec. 24. Section 277.4, subsection 2, paragraph b, Code 17 2021, is amended to read as follows: 18 b. Signers of nomination petitions shall include their 19 addresses and the date of signing, and must reside in the same 20 director district as the candidate if directors are elected 21 by the voters of a director district, rather than at-large. 22 A person may sign nomination petitions for more than one 23 candidate for the same office, and the signature is not invalid 24 solely because the person signed nomination petitions for 25 one or more other candidates for the office. The petition 26 shall be filed with the affidavit of the candidate being 27 nominated, stating the candidate’s name, place of residence, 28 that such person is a candidate and is eligible for the office 29 the candidate seeks, and that if elected the candidate will 30 qualify for the office. The affidavit shall also state that 31 the candidate is aware that the candidate is disqualified 32 from holding office if the candidate has been convicted of a 33 felony or other infamous crime and the candidate’s rights have 34 not been restored by the governor , or by the president of the 35 -11- HF590.822 (1) 89 ss/jh 11/ 21
United States , or by operation of law . 1 Sec. 25. Section 376.4, subsection 2, paragraph b, Code 2 2021, is amended to read as follows: 3 b. The petition must include the affidavit of the individual 4 for whom it is filed, stating the individual’s name, the 5 individual’s residence, that the individual is a candidate and 6 eligible for the office, and that if elected the individual 7 will qualify for the office. The affidavit shall also state 8 that the candidate is aware that the candidate is disqualified 9 from holding office if the candidate has been convicted of a 10 felony or other infamous crime and the candidate’s rights have 11 not been restored by the governor , or by the president of the 12 United States , or by operation of law . 13 Sec. 26. Section 914.2, Code 2021, is amended to read as 14 follows: 15 914.2 Right of application. 16 Except as otherwise provided in section 902.2 or 914.8 , a 17 person convicted of a criminal offense has the right to make 18 application to the board of parole for recommendation or to 19 the governor for a reprieve, pardon, commutation of sentence, 20 remission of fines or forfeitures, or restoration of rights of 21 citizenship at any time following the conviction. 22 Sec. 27. NEW SECTION . 914.8 Restoration of right to 23 register and to vote. 24 1. A person convicted of a felony criminal offense who has 25 been discharged from probation, parole, or work release or 26 who is released from confinement under section 902.6 because 27 the person has completed the person’s term of confinement 28 shall have the person’s right to register to vote and to vote 29 restored. 30 2. As soon as practicable, the department of corrections 31 or judicial district department of correctional services, 32 whichever is applicable, shall provide written notice to each 33 person, as described in subsection 1, who, on or after January 34 14, 2011, has been discharged from probation, parole, or work 35 -12- HF590.822 (1) 89 ss/jh 12/ 21
release or who, on or after January 14, 2011, has completed a 1 term of confinement, that the person’s right to register to 2 vote and to vote has been restored. The notice shall include a 3 voter registration form. 4 3. The department of corrections shall monthly provide a 5 list of all persons notified under subsection 2 in the previous 6 month to the state registrar of voters who shall provide the 7 information to the county registrars of voters as deemed 8 necessary. 9 4. A person described in subsection 1 may still make 10 application for a restoration of citizenship rights pursuant 11 to sections 914.1 through 914.6. Such an application, unless 12 withdrawn, shall be processed as required by this chapter. 13 5. This section shall not relieve a person of any unpaid 14 restitution, fine, or other obligation resulting from 15 conviction. 16 DIVISION III 17 ABSENTEE VOTING PERIOD 18 Sec. 28. Section 53.8, subsection 1, paragraph a, 19 unnumbered paragraph 1, Code 2021, is amended to read as 20 follows: 21 Upon receipt of an application for an absentee ballot 22 and immediately after the absentee ballots are printed, 23 but not more than twenty-nine days before the election, the 24 commissioner shall mail an absentee ballot to the applicant 25 within twenty-four hours, except as otherwise provided in 26 subsection 3 . When the United States post office is closed 27 in observance of a federal holiday and is not delivering mail 28 on the twenty-ninth day before the election, the first day to 29 mail absentee ballots is the next business day on which mail 30 delivery is available. The absentee ballot shall be sent to 31 the registered voter by one of the following methods: 32 Sec. 29. Section 53.10, subsection 1, Code 2021, is amended 33 to read as follows: 34 1. Not more than twenty-nine forty-five days before the 35 -13- HF590.822 (1) 89 ss/jh 13/ 21
date of the primary election or the general election, the 1 commissioner shall provide facilities for absentee voting in 2 person at the commissioner’s office. This service shall also 3 be provided for other elections as soon as the ballots are 4 ready, but in no case shall absentee ballots be available under 5 this section more than twenty-nine forty-five days before an 6 election. 7 Sec. 30. Section 53.11, subsection 1, paragraph a, Code 8 2021, is amended to read as follows: 9 a. Not more than twenty-nine forty-five days before the 10 date of an election, satellite absentee voting stations may be 11 established throughout the cities and county at the direction 12 of the commissioner and shall be established upon receipt 13 of a petition signed by not less than one hundred eligible 14 electors requesting that a satellite absentee voting station 15 be established at a location to be described on the petition. 16 However, if a special election is scheduled in the county on a 17 date that falls between the date of the regular city election 18 and the date of the city runoff election, the commissioner is 19 not required to establish a satellite absentee voting station 20 for the city runoff election. 21 Sec. 31. Section 53.42, Code 2021, is amended to read as 22 follows: 23 53.42 Voting in person in commissioner’s office. 24 Notwithstanding the provision as to time found in section 25 53.10 , any qualified voter in the armed forces of the United 26 States may personally appear in the office of the commissioner 27 of the county of the voter’s residence and there vote an absent 28 voter’s ballot at any time not earlier than forty forty-five 29 days before the primary or general election, as the case may 30 be. 31 DIVISION IV 32 ABSENTEE BALLOT REQUESTS 33 Sec. 32. Section 47.2, Code 2021, is amended by adding the 34 following new subsection: 35 -14- HF590.822 (1) 89 ss/jh 14/ 21
NEW SUBSECTION . 9. The commissioner shall provide for 1 the submission of electronic absentee ballot applications on 2 the commissioner’s internet site pursuant to section 53.2, 3 subsection 1, paragraph “c” . 4 Sec. 33. Section 53.2, subsection 1, Code 2021, is amended 5 by adding the following new paragraphs: 6 NEW PARAGRAPH . c. A registered voter may apply to the 7 commissioner for an absentee ballot through electronic means 8 either through electronic mail sent to the commissioner or 9 through the commissioner’s internet site. An electronic 10 application for an absentee ballot must be received by the 11 commissioner no later than 5:00 p.m. on the Friday before the 12 election. An electronic application for an absentee ballot 13 received by the commissioner more than seventy days prior to 14 the date of the election shall be retained by the commissioner 15 and processed in the same manner as an electronic application 16 received not more than seventy days before the date of the 17 election. 18 NEW PARAGRAPH . d. A registered voter may request an 19 absentee ballot from the commissioner by telephone. A request 20 by telephone must be received by the commissioner no later than 21 5:00 p.m. on the same day as the voter registration deadline 22 provided in section 48A.9 for the election for which the ballot 23 is requested. 24 Sec. 34. Section 53.2, subsection 4, paragraph a, Code 2021, 25 is amended to read as follows: 26 a. To request an absentee ballot, a registered voter shall 27 provide: 28 (1) The name and signature of the registered voter. 29 (1A) For an application submitted pursuant to subsection 1, 30 paragraph “a” or “b” , the signature of the registered voter. 31 (2) The registered voter’s date of birth. 32 (3) The address at which the voter is registered to vote. 33 (4) The registered voter’s voter verification number 34 or, for an application submitted pursuant to subsection 1, 35 -15- HF590.822 (1) 89 ss/jh 15/ 21
paragraph “c” , either the registered voter’s voter verification 1 number or the last four numerals of the registered voter’s 2 social security number . 3 (5) The name or date of the election for which the absentee 4 ballot is requested. 5 (6) Such other information as may be necessary to determine 6 the correct absentee ballot for the registered voter. 7 DIVISION V 8 ONGOING ABSENTEE VOTER STATUS 9 Sec. 35. NEW SECTION . 53.4 Ongoing absentee voter. 10 A registered voter applying for an absentee ballot under 11 section 53.2 may request to receive an absentee ballot for all 12 subsequent elections or for each subsequent general election 13 in which that person is eligible to vote and qualifies under 14 section 53.1. The state commissioner shall provide check boxes 15 on the prescribed form for this purpose. For all subsequent 16 elections or for each subsequent general election, the county 17 commissioner of elections shall automatically mail an absentee 18 ballot to the requesting voter, or automatically deliver an 19 absentee ballot if the requester is a person voting pursuant to 20 section 53.22. A voter’s status as an ongoing absentee voter 21 shall be terminated upon the request of the voter or by the 22 county commissioner if the voter fails to qualify under section 23 53.1 or if the voter fails to vote in two consecutive general 24 elections. 25 DIVISION VI 26 SATELLITE ABSENTEE VOTING LOCATIONS 27 Sec. 36. Section 53.11, Code 2021, is amended by adding the 28 following new subsection: 29 NEW SUBSECTION . 7. This section shall not be construed 30 to prohibit the commissioner from establishing a satellite 31 absentee voting station at the discretion of the commissioner. 32 DIVISION VII 33 VOTER IDENTIFICATION 34 Sec. 37. Section 49.78, subsection 2, paragraph a, Code 35 -16- HF590.822 (1) 89 ss/jh 16/ 21

(11) A Medicare or Medicaid card. 10 NEW SUBPARAGRAPH . (12) A long-term care identification 11 card. 12 NEW SUBPARAGRAPH . (13) A hunting license. 13 NEW SUBPARAGRAPH . (14) A fishing license. 14 NEW SUBPARAGRAPH . (15) An identification card issued by a 15 college or university. 16 NEW SUBPARAGRAPH . (16) An employee identification card 17 issued by a governmental entity. 18 NEW SUBPARAGRAPH . (17) An identification card issued by an 19 employer. 20 NEW SUBPARAGRAPH . (18) A union membership card. 21 NEW SUBPARAGRAPH . (19) A paycheck. 22 NEW SUBPARAGRAPH . (20) A debit or credit card. 23 NEW SUBPARAGRAPH . (21) A utility bill, whether presented in 24 print or in an electronic format. 25 NEW SUBPARAGRAPH . (22) A form of identification approved by 26 the Iowa state association of county auditors. 27 Sec. 38. Section 49.78, subsections 4 and 5, Code 2021, are 28 amended to read as follows: 29 4. A person who is registered to vote but is unable 30 to present a form of identification under subsection 2 or 31 3 may establish identity and residency in the precinct by 32 written oath of a person who is also registered to vote in 33 the precinct. The attesting registered voter’s oath shall 34 attest to the stated identity of the person wishing to vote 35 -17- HF590.822 (1) 89 ss/jh 17/ 21
and that the person is a current resident of the precinct. 1 The oath must be signed by the attesting registered voter in 2 the presence of the appropriate precinct election official. 3 A registered voter who has signed two oaths on election day 4 attesting to a person’s identity and residency as provided in 5 this subsection is prohibited from signing any further oaths as 6 provided in this subsection on that day. 7 5. The form of the written oath required of a registered 8 voter attesting to the identity and residency of the voter 9 unable to present a form of identification shall read as 10 follows: 11 I, ...... (name of attesting registered voter), do solemnly 12 swear or affirm all of the following: 13 I am a preregistered voter in this precinct or I registered to 14 vote in this precinct today, and a registered voter did not 15 sign an oath on my behalf. I will not sign more than two oaths 16 attesting to the identity and residence of any other person in 17 this election . 18 I am a resident of the ... precinct, ... ward or township, 19 city of ....., county of ....., Iowa. 20 I reside at ....... (street address) in ..... (city or 21 township). 22 I personally know ..... (name of voter), and I personally know 23 that ..... ELECTION MISCONDUCT 1 Sec. 39. Section 39A.4, subsection 1, paragraph c, Code 2 2021, is amended by adding the following new subparagraph: 3 NEW SUBPARAGRAPH . (12) Communicating false information to 4 a person to prevent the person from voting. 5 DIVISION IX 6 ABSENTEE BALLOT COUNTING 7 Sec. 40. Section 53.23, subsection 3, paragraph c, Code 8 2021, is amended to read as follows: 9 c. For the general election, the commissioner may convene 10 the special precinct election board on the day Saturday and 11 Monday before the election to begin counting absentee ballots. 12 However, if in the preceding general election the counting of 13 absentee ballots was not completed by 10:00 p.m. on election 14 day, the commissioner shall convene the special precinct 15 election board on the day Saturday and Monday before the next 16 general election to begin counting absentee ballots. The board 17 shall not release the results of its tabulation pursuant to 18 this paragraph until the count is completed on election day. 19 DIVISION X 20 ABSENT VOTING BY UNIFORMED AND OVERSEAS CITIZENS 21 Sec. 41. NEW SECTION . 53.54 Reports. 22 The state commissioner shall, before and after each 23 election, submit to the general assembly a report documenting 24 the availability of absentee ballots to voters under this 25 subchapter, the number of ballots transmitted, and the number 26 of ballots returned. 27 DIVISION XI 28 CANCELLATION OF REGISTRATION 29 Sec. 42. Section 48A.28, Code 2021, is amended by adding the 30 following new subsection: 31 NEW SUBSECTION . 4. A commissioner shall not conduct a 32 systematic program to remove records from the official list 33 of registered voters later than six months before a general 34 election. 35 -19- HF590.822 (1) 89 ss/jh 19/ 21
Sec. 43. Section 48A.30, Code 2021, is amended by adding the 1 following new subsections: 2 NEW SUBSECTION . 3. A voter registration shall not be 3 canceled solely on the basis that mail to the voter was 4 returned as undeliverable except as provided in section 48A.29. 5 NEW SUBSECTION . 4. A voter registration shall not be 6 canceled unless the commissioner verifies that the registration 7 belongs to an ineligible voter. The commissioner shall verify 8 that the identity of the ineligible voter matches the voter 9 registration to be canceled through one of the following means: 10 a. The voter’s full name. 11 b. The voter’s date of birth. 12 c. The last four digits of the voter’s social security 13 number. 14 d. Documentation from the electronic registration 15 information center that the voter is no longer a resident of 16 this state. 17 NEW SUBSECTION . 5. Prior to canceling a voter registration, 18 the commissioner shall publicly publish notice of the 19 cancellation as provided in chapter 618. 20 DIVISION XII 21 ABSENTEE BALLOT DROP BOXES 22 Sec. 44. NEW SECTION . 53.28 Absentee ballot drop boxes. 23 1. Each commissioner shall establish at least one drop box 24 to which a voter may return a completed absentee ballot per 25 twenty-five thousand residents of the county. 26 2. The state commissioner shall adopt rules for the 27 placement and security of absentee ballot drop boxes and the 28 return of absentee ballots to absentee ballot drop boxes. 29 DIVISION XIII 30 EFFECTIVE DATE 31 Sec. 45.
