Senate File 231 H-1054 Amend Senate File 231, as amended, passed, and reprinted by 1 the Senate, as follows: 2 1. By striking everything after the enacting clause and 3 inserting: 4 < Section 1. Section 321.194, subsection 2, paragraph a, 5 Code 2021, is amended by adding the following new subparagraph: 6 NEW SUBPARAGRAPH . (03) If the licensee is employed, the 7 licensee may operate a motor vehicle during the hours of 5:00 8 a.m. to 10:00 p.m. over the most direct and accessible route 9 between the licensee’s residence or school of enrollment and 10 the licensee’s place of employment, provided the driving 11 distance between the licensee’s place of employment and the 12 nearest point on the route on which the licensee is authorized 13 to travel under subparagraph (1), subparagraph division (a), or 14 subparagraph (2), subparagraph division (a), is no more than 15 fifty miles. 16 Sec. 2. Section 321.194, subsection 2, paragraph a, 17 subparagraph (3), Code 2021, is amended to read as follows: 18 (3) To a service station for the purpose of refueling, so 19 long as the service station is the station closest to the route 20 on which the licensee is traveling under subparagraph (1) , or 21 (2) , or (03) . 22 Sec. 3. Section 321.194, subsection 3, paragraph b, Code 23 2021, is amended to read as follows: 24 b. Upon receipt of a statement of necessity, the department 25 shall issue the driver’s license provided the applicant is 26 otherwise eligible for issuance of the license. The fact that 27 the applicant resides at a distance less than one mile from the 28 applicant’s school of enrollment is prima facie evidence of the 29 nonexistence of necessity for the issuance of a license. > 30 2.
