A health carrier shall reimburse a health care 4 professional for health care services, other than health care 5 services for mental health conditions, illnesses, injuries, or 6 diseases, provided by telehealth to a covered person who is not 7 located at a facility on the same basis that the health carrier 8 would apply to the same health care services provided to a 9 covered person by the health care professional in person, and 10 at a rate negotiated between the health carrier and the health 11 care professional. The negotiated rate shall not be less than 12 sixty-five percent of the rate that the health carrier would 13 reimburse the health care professional for the same health 14 care services provided to a covered person by the health care 15 professional in person. 16 c. A health carrier shall reimburse a health care 17 professional for health care services for a mental health 18 condition, illness, injury, or disease provided by telehealth 19 to a covered person who is not located at a facility on the same 20 basis that the health carrier would apply to the same health 21 care services for a mental health condition, illness, injury, 22 or disease provided to a covered person by the health care 23 professional in person, and at a rate negotiated between the 24 health carrier and the health care provider. The negotiated 25 rate shall not be less than ninety-five percent of the rate 26 that the health carrier would reimburse the health care 27 professional for the same health care services provided to a 28 covered person by the health care professional in person. 29 d. As a condition of reimbursement pursuant to paragraph “a” 30 or “c” , a health carrier shall not require that an additional 31 health care professional be located in the same room as the 32 covered person while health care services for a mental health 33 condition, illness, injury, or disease are delivered via 34 telehealth by another health care professional to the covered 35 -1- HF2192.4107 (2) 88 ko/rn 1/ 2 #1.

If the governor issues a proclamation of disaster 2 emergency pursuant to section 29C.6 that suspends the provision 3 of in-person nonessential health care services by health care 4 professionals, a health carrier shall reimburse a health care 5 professional and a facility for health care services provided 6 by telehealth to a covered person on the same basis and at the 7 same rate as the health carrier would apply to the same health 8 care services provided to a covered person by the health care 9 professional and a facility in person. For purposes of this 10 paragraph, “nonessential health care services” are health care 11 services that can be delayed without undue risk to the current 12 or future health of an individual, considering all appropriate 13 factors, including but not limited to the following: 14 (1) The threat to an individual’s life if a surgery or other 15 procedure is delayed. 16 (2) The threat of permanent dysfunction to an individual’s 17 organ systems or an individual’s extremities. 18 (3) The risk of an individual experiencing metastasis or a 19 progression in staging of a cancer-related condition. 20 (4) The risk of an individual developing rapidly worsening 21 or severe symptoms. 22 (5) The risk of severe pain, infection, or impact on an 23 individual’s normal oral functioning. > 24 ______________________________ COMMITTEE ON HUMAN RESOURCES ANNETTE SWEENEY, CHAIRPERSON -2- HF2192.4107 (2) 88 ko/rn 2/ 2
