Sexual abuse or sexual exploitation by a counselor, 5 therapist, or school employee. An action for damages for 6 injury suffered as a result of sexual abuse, as defined in 7 section 709.1 , by a counselor, therapist, or school employee, 8 as defined in section 709.15 , or as a result of sexual 9 exploitation by a counselor, therapist, or school employee 10 shall be brought within five years of the date the victim was 11 last treated by the counselor or therapist, or within five 12 years of the date the victim was last enrolled in or attended 13 the school , if the counselor, therapist, or school employee is 14 twenty-seven years of age or older, may be commenced at any 15 time after the commission of the offense . 16 Sec. ___. Section 614.1, Code 2020, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 12A. Sexual abuse. An action for damages 19 for injury suffered as a result of sexual abuse in the first 20 degree as defined in section 709.2, sexual abuse in the second 21 degree as defined in section 709.3, or sexual abuse in the 22 third degree as defined in section 709.4, committed against a 23 child by a person who is twenty-seven years of age or older, 24 may be commenced at any time after the commission of the 25 offense. 26 Sec. ___. Section 614.8A, Code 2020, is amended to read as 27 follows: 28 614.8A Damages for child sexual abuse —— time limitation. 29 1.
